3 UNIFORM WORK RULE 1.0 PURPOE 1.1 he purpose of this procedure is to establish the required Uniform Work Rules for all McCarl s employees. 2.0 COPE 2.1 his procedure is applicable to all McCarl s employees. 3.0 REPONIBILIIE 3.1 he Project Manager/upervisor is responsible for implementing and enforcing this procedure. 3.2 he afety Department is responsible for monitoring compliance with this procedure. 4.0 APPENDIX Appendix A - Disciplinary Action Form Appendix B - ign-off heet Appendix C Employee ermination Form 5.0 UNIFORM WORK RULE GENERAL INFORMAION Page Verbal Warnings shall be documented in the job log. 5.2 Written violations shall be documented using the Disciplinary Action Form (Appendix A). Disciplinary Action Forms shall be maintained in the project file system and available for review by authorized supervision. he employee shall be given a copy of the completed Disciplinary Action Form. A copy of the completed Disciplinary Action Form shall be forwarded to the afety Department. Where appropriate, the employees union representative will be notified when written warnings are issued. 5.3 In the event of suspension, the General Manager shall determine the duration with input from the Project Manager.
4 5.4 In the event of termination, the General Manager shall specify when the employee will be eligible for rehire, if ever. 5.5 Compounding of violations by an individual shall result in applying the most stringent penalty. 5.6 Unless more stringent rules or regulations are required by the owner, all employees must abide by McCarl s rules and regulations. 5.7 Discipline shall be fair, soon, certain and significant. 5.8 A violation of state, federal or local law in any of the Uniform Work Rules may result in additional action by governing authorities. 5.9 Other violations of the Employee afety, Health, Quality and Employment Rules, including the Employment Policies, not listed in these, shall be on a case-by-case basis and the appropriate action shall be taken by the Project Manager. 5 6.0 UNIFORM WORK RULE Number VIOLAION Recommended discipline subject to the discretion of the General Manager All trenching/excavation must meet the minimum 1 requirements of Federal OHA 1926 and be conducted with the guidance of a competent person. Fall protection (i.e., personal fall arrest equipment, 2 standard guardrails or safety nets) must be in place when an employee is exposed to falls greater than 6 Feet. 3 No part of the body may ever be permitted under a raised load. A person may only enter a confined space after 4 required training and hazard analysis has been conducted per McCarl s afety Guidelines. (Confined pace Entry) All stored energy must be released, moving parts blocked and zero energy verified by a competent 5 person and lockout/tag out in place per site specific requirements prior to performing service or maintenance on machinery or equipment. 6 (Lock-out/ag-out) Intentional sabotage or willful misuse, destruction, or damage to Owner or Company property/equipment, including Fire Protection ystem, is strictly forbidden. 7 Possession of firearms, ammunition or firearms of any kind on the Company or project premises. 8 tealing or attempting to steal property from the 1 st site 9 Initiating fighting or threatening of violence. 10 Being in an unauthorized area without Company Owner or Project upervision permission. Unauthorized entry or exit from the site, such as refusing to show security badge, submit to vehicle and/or property search, climbing fence, failure to 11 check in/out or checking in/out for another individual. Violation of the Company s Drug and Alcohol 12 Policy, as specified in the Policy, is strictly forbidden. Only qualified trained employees are permitted to operate fork trucks, mobile cranes, bucket trucks, 13 aerial man-lifts, and overhead cranes. Further, all rigging must be performed with the guidance of a competent person. 2 nd 3 rd Page 3
6 Number Page 4 VIOLAION Recommended discipline subject to the discretion of the General Manager Employees are not permitted to ride as a passenger on moving equipment, railroad cars, cranes, highlifts, tractors or pickup truck beds. Employees working near, or blocking, railroad tracks must comply with the site policy (Blue Flag/Derailer) for barricading railroad tracks. All scaffolding shall be assembled, used, maintained and dismantled under the supervision of a McCarl s designated Competent Person. 17 Falsifying or giving misleading information pertaining to Incident Investigations. 18 Insubordination Refusal to carry out work related instructions. 19 moking is strictly forbidden (except in authorized areas) 20 Project supervision not enforcing safety requirements or these rules. Removing safety guards without authorization of 21 supervision or rendering tools and equipment unsafe. 22 Using property of another person or company 23 without that person s or company s permission. Failure by an employee or manager to comply with McCarl s requirement to report an employee s job related injury to his or her supervisor or the afety Department. 1st 2nd 3rd 24 Violation of the Ladder afety Policy. W 27 Use of personal cell phone other than during W scheduled breaks. 28 Unauthorized work breaks W 29 Failure to remain at work station until specified quitting time. W Failure to notify the company that you are unable to 30 report due to illness or any other reason, prior to the prescribed starting time (Exact details for reporting W are provided by the Project upervision). 31 Absenteeism or tardiness without sufficient reason. W 32 Practical joking, horseplay or other misconduct. W W = Warning = uspension = ermination
