2 ArcelorMittal USA LLC Truckload Carrier Safety Standard SCOPE AND APPLICATION The standards contained in this document apply to contracted over-the-road truck carriers performing pickup and/or delivery service on ArcelorMittal Companies property. ArcelorMittal Companies" shall mean (i) ArcelorMittal USA LLC ( AMUSA ) and any person or entity directly or indirectly controlled by ArcelorMittal, (ii) I/N Kote, (iii) I/N Tek and includes idled ArcelorMittal facilities and related Company property. Any one of the ArcelorMittal Companies is an ArcelorMittal Company. The ArcelorMittal Companies have numerous facilities in the United States, any of which may be service locations. ArcelorMittal property includes all property owned, leased, operated or controlled by ArcelorMittal USA LLC and its affiliated companies located in the United States and includes entry roads, parking lots, grounds, and offices. Truckload carriers must strictly comply with AMUSA s standard terms and conditions in AMUSA-114 including the requirements in this standard. Truckload carriers performing pickup and/or delivery on ArcelorMittal Companies property must have in place for its employees and subcontractors, and follow, a policy containing standards that, at a minimum, meet the requirements in this Safety Standard. Under no circumstances should you ever take unnecessary risks. For the purpose of this document the term truckload carrier refers to owners and operators of transportation equipment, their employees and subcontractors and their employees performing pickup and delivery service. ArcelorMittal reserves the right to amend or add to its established rules, procedures and regulations affecting safety, health, environment and fire protection at any time. 1. GENERAL REQUIREMENTS a. Safety is a fundamental value at ArcelorMittal and as such will not be compromised. The safety, health and environmental performance of truckload carriers performing pickup or delivery service on ArcelorMittal property can have serious impact not only on their employees but the employees, equipment and property of ArcelorMittal as well. ArcelorMittal is committed to conducting its business safely and in an ethically, socially, and environmentally responsible manner that will protect human health, natural resources, and the environment in which we live. b. By issuing this standard, and by insisting that truckload carriers put in place for its employees and subcontractors, and follow, a policy containing similar minimum standards, ArcelorMittal does not undertake to manage, direct, control or otherwise assume responsibility for the safety performance of truckload carriers, nor does ArcelorMittal assume any duty with respect to the safety of the truckload carrier s or sub-truckload carrier s employees, invitees or licensees, not otherwise existing under federal, state, and local laws, rules, regulations, and orders ( Laws ) Common Law, Statute and/or Regulation. These rules are intended to ensure safe work performance by truckload carriers, but are in no manner intended to alter the status of truckload carriers as Independent Truckload carriers as defined by Laws. c. The safety, health and environmental standards and work practices contained in this document require the performance of injury-free work and minimizing the environmental impact by truckload carriers under contract with ArcelorMittal. These rules and work practices in no way relieve truckload carriers of their obligation to comply with all applicable Laws. These standards are minimum requirements and truckload carriers will be expected to observe and establish for the work being performed such additional standards and work practices as may be necessary. Truckload carriers must ensure the abatement/correction of all at-risk conditions and behaviors. d. Truckload carrier employees are not to enter areas where performance of the contracted work does not require their presence. Truckload carriers must only perform those duties and tasks authorized by ArcelorMittal and shall only access and/or use Company property necessary to do so; any unauthorized activity and/or access is strictly prohibited. 2

3 e. Truckload carrier s employees when reporting to work and while on the job on ArcelorMittal s property are required to be fit for work and free from the effects of alcohol, illegal drugs, and the abuse or misuse of prescribed drugs and over-the-counter medications. ArcelorMittal retains the right to refuse entry to and have removed from its property any person whom ArcelorMittal believes is in violation of this substance abuse policy. Truckload carrier employees taking prescribed drugs or over-the-counter medications are responsible for following the instructions provided by the prescribing physician and the manufacturer of such medications. The manufacture, distribution, dispensation, possession, sale or use of alcohol or illegal drugs on ArcelorMittal property is strictly prohibited. f. ArcelorMittal forbids the possession of firearms and deadly weapons by carrier s employees on ArcelorMittal property. Truckload carriers are responsible to enforce this policy and ArcelorMittal retains the right to refuse entry to any person from its property who it believes is in violation of the ArcelorMittal policy. g. Entry of truckload carriers onto ArcelorMittal property constitutes consent to inspection of vehicles and personal effects when entering, while on or upon leaving ArcelorMittal property. Anyone refusing to permit inspection will be barred from ArcelorMittal property. h. Pets and non-cdl passengers are not permitted to ride in the carrier s vehicle while on ArcelorMittal property. 2. CRANES and MOBILE EQUIPMENT; SECURING LOADS a. Truckload carriers must be aware of cranes and mobile equipment. Under no circumstances may carrier s employees operate any ArcelorMittal overhead crane or mobile equipment, or walk on crane runways while overhead cranes are in operation. Truckload carriers must be constantly alert and keep a clear safe distance when working or walking near an overhead crane or mobile equipment. b. The truckload carrier may be responsible for directing the lifts and must take special precautions to keep clear of the load at all times. Truckload carrier employees are to use standard hand signals when directing the crane operator. The truckload carrier employees are not to stand on their truck while the crane is making the lift, nor stand in a pinch point area. c. Truckload carrier must completely secure their load in compliance with all Laws before leaving the loading facility or shipping area. 3. ELECTRICAL HAZARDS Truck cabs or trailers must not be moved or beds raised near energized electrical equipment. 4. ENVIRONMENTAL a. Hazardous Materials: The truckload carrier may not dispose of hazardous wastes or hazardous substances on the premises. b. Waste Water Discharges: No materials, whether or not hazardous, may be discharged or disposed of by the truckload carriers into the facility s industrial wastewater, non-contact cooling water, storm water, or sanitary wastewater systems, other water systems, or into any manholes. c. Spills and Releases: i. Truckload carriers are responsible for coordinating with ArcelorMittal in determining applicable emergency response procedures for releases or spills on ArcelorMittal property that can affect the environment. 3

4 ii. The truckload carrier shall contact the plant Environmental Department as soon as a release or spill caused by the carrier occurs on ArcelorMittal property. Any spills or releases of hazardous materials by the truckload carrier or any of its subcontractors, including, without limitation, any substance containing hazardous materials substances hazardous waste, pollutants or contaminants, or spills of other materials or substances that pose or could pose a threat to human health or the environment must be immediately reported to the appropriate facility person and to the ArcelorMittal USA Environmental representative. iii. In the event of a spill or release, steps must immediately be taken to stop and contain the spill in a safe manner and reported to the proper regulatory authorities, as applicable. In particular, steps must be taken to prevent the spilled material from entering waterways or storm water, sanitary sewer or other manholes. Steps also must be taken to prevent spilled material from contacting personnel involved in trying to contain the spill. iv. All spills and releases within the facility caused by the truckload carriers will be cleaned up by the facility, its designee or, at the facility s discretion, by the truckload carrier. The truckload carriers shall reimburse ArcelorMittal for all costs incurred by ArcelorMittal in responding to and cleaning up any such spill or release, including all documentation and analytical cost required for clean closure and any mandated responses, penalties and/or fines to regulatory authorities. All costs associated with any clean up performed by the truckload carriers will be borne by the truckload carriers and shall be performed to the facility s satisfaction. v. The truckload carrier shall investigate all releases or spills caused by the carrier that can affect the environment and investigate and resolve any environmental enforcement citations from environmental regulators. The truckload carrier shall promptly prepare a written investigation report, take corrective action as applicable and/or as instructed by the Environmental Department and provide a copy to the ArcelorMittal representative. d. Asbestos: All thermal system insulation and sprayed or troweled-on surfacing material at the facility, and all other generic types of potential asbestos-containing materials in the facility, such as flooring, roofing, siding, valve packing and gaskets, and electrical insulation and mounting materials, must be treated as asbestos unless the material is known or determined not to contain asbestos. Vermiculite that has been used as building insulation and or cable tray fire suppression should also be considered potential asbestos-containing material, unless known or determined not to contain asbestos. 5. VEHICLE TRAFFIC AND PARKING a. Observe established facility traffic rules, signs and speed limits at all times. b. Seat belts must be worn when driving in the plant. c. Truckload carriers must park only in designated parking areas. d. Emergency vehicle travel lanes must be kept open at all times. e. Truck drivers must ensure other individuals are in the clear prior to making any movement with their vehicle in all areas of the ArcelorMittal facilities, such as but not limited to marshalling yards, scales, loading docks and tarping areas. f. Always yield right of way to pedestrians, railroad trains, fixed rail equipment, coil carriers, slab carriers and all types of mobile equipment and vehicular traffic. g. The use of mobile phone, hands free device, or mobile or messaging device is not permitted while the vehicle is moving. h. Vehicle headlights must be on whenever the vehicle is in operation. i. All vehicle traffic must be limited to paved road surfaces and approved unpaved roadways approved by the facility for use. j. Vehicles must be loaded in a manner that prevents material spills during transport. 6. RAILROAD TRACKS AND RAIL SAFETY 4

5 a. Truckload carrier vehicles are to stop, look, and listen before crossing railroad tracks when walking or driving whether marked by signs or lights or not. b. Extreme care must be taken particularly at posted equipment crossings to safeguard pedestrians and equipment. Failure to do so may result in termination of access to the facility. c. Do not park on railroad tracks. d. Keep railroad tracks unobstructed and maintain a minimum 10-foot clearance alongside(s) of track at all times. e. Cross tracks inside or outside of buildings at designated crossings. Do not step or stand on rails when crossing. They are tripping and slipping hazards. f. Stay at a safe distance from all railroad equipment. Be particularly attentive to distance from remote-controlled locomotives and railroad equipment transporting hot metal or slag. Hot metal or slag can erupt and splash a considerable distance. g. Avoid crossing between uncoupled railroad cars or around the ends of railroad engines and cars, or locomotive cranes, but if necessary maintain a 10-foot clearance from the body to any railroad equipment. Never cross between coupled railroad cars. Never stand on railroad cars. 7. FIRE PREVENTION AND FIRE PROTECTION Truckload carriers must obey all signs and rules regarding smoking, sparks and open flames. Smoking is limited to designated areas only. Truckload carriers are to implement fire prevention measures to protect all employees, equipment and buildings. 8. HORSEPLAY Truckload carriers must not engage in horseplay, practical jokes, or athletic activities of any kind while on the work site or on ArcelorMittal property. 9. HOUSEKEEPING The truckload carrier must dispose of all solid/liquid waste material in accordance with any instructions provided by a representative of the Environment Department. In no case is trash to be disposed of by open-fire burning. 10. PERSONAL PROTECTIVE EQUIPMENT Truckload carrier must a. Ensure personal protective equipment (PPE) and clothing is provided, used, and maintained by their employees; b. Comply with any established plant or department protective equipment specific use requirements; c. Ensure that their employees and contractor s employees inspect their PPE before each use, do not use defective or damaged PPE, and do not alter PPE; d. Training their employees: when PPE is necessary; what type; how it is worn; its limitations; proper care and disposal; e. Ensure that their employees and sub-contractor s employees have and wear safety hard hats of a non-conductive material at all times when outside the tractor cab; f. Ensure that their employees and sub-contractor s employees have and wear foot protection at all times when outside the tractor cab. As a minimum, a suitable work shoe with a closed toe, closed heel, and low/flat sole is required. Sandals are not permitted. g. Ensure that their employees and contractor s employees have and wear safety glasses with side shields at all times when outside the tractor cab. Persons who use corrective spectacles and are required to wear eye protection must wear either safety glasses with protective lenses providing optical correction or safety glasses or goggles over corrective glasses. Normal street wear frames and safety lenses are not in compliance. h. Ensure that their employees and contractor s employees have and wear work clothing consisting of long pants and waist length high visibility long sleeve shirts, vests or jackets at all times when outside the tractor cab. 5

6 11. SAFE WORK ENVIRONMENT a. Fundamental to truckload carrier safety is getting on and off equipment safely and preventing slips, trips and falls. Drivers must utilize THREE POINT CONTACT when getting on or off equipment. This means having one foot and both hands on the equipment or one hand and both feet in contact at all times. Drivers must exercise caution when getting on or off their trailers and cabs to protect against a fall. Drivers must also be aware mill areas may be slippery from process oils or lubricants and must be vigilant in preventing slips trips and falls wherever they might be in the mill environment. b. Many truckload carriers sustain serious injuries every year in industry as they are attempting to tarp down their vehicles. They must ensure they prevent against a fall during this task. c. In addition, drivers may sustain serious injuries while attempting to adjust their binding chains. Drivers must use utmost caution when performing this work to ensure they do not strike themselves or others when tightening their binders. d. Truckload carriers must not operate their engines within an enclosed area such that it would cause an adverse health effect on any persons in the area. e. When unloading or raising beds with potential frozen or compacted material, the truck must not be dumped if material creates a hazard in causing the truck to become unstable. A truck should not be moved with a raised bed unless sufficient overhead clearance exists. 6

7 Receipt and Approval The truckload carrier named above has been retained by ArcelorMittal to provide transportation services. The carrier named above acknowledges that it has been furnished with copies of: Truckload Carrier Safety and Health Standards document dated Truckload carrier represents that it has in place for its employees and subcontractors, and requires that the forgoing follow a policy containing standards that, at a minimum, meet the requirements in this Safety Standard. Further, the truckload carrier represents that its employees and its contractors and their employees who perform pickup, delivery or onsite services on ArcelorMittal properties (now and in the future) have been made aware of the same.
