Basic Information 1.1 Programme: 2013/ Framework Programme in support of the EU - Republic of Moldova agreements 1.2 Twinning Number: MD 13 ENPI EC TWL (MD/31) 1.3 Title: EU support for the National Institute for Standardization of the Republic of Moldova to comply with CEN and CENELEC full membership criteria 1.4 Sector: Trade 1.5 Beneficiary country: the Republic of Moldova 2. Objectives 2.1 Overall Objective: The overall objective of this project is to improve the trade competitiveness of the Republic of Moldova and to harmonize the quality infrastructure with international and European standards by adjusting the national standardization system to the European one. 2.2 Project purpose: The purpose of this project is for the National Institute for Standardization of the Republic of Moldova to conform to the CEN and CENELEC membership criteria described in the CEN- CENELEC Guide Contribution to National Development Plan/Cooperation agreement/association Agreement/Action Plan Moldova signed the Association Agreement - including a Deep and Comprehensive Free Trade Agreement - with the European Union on 27 June This is considered as an important step towards the further integration of Moldova with the EU and is expected to further deepen political, economic and trade relations between the two parties. Moldova thus remains a partner country within the European Neighbourhood Policy and the Association Agenda defines the strategic objectives of political, economic and institutional reforms. Development of efficient and accountable public administration as well as the institutional and functional development of public authorities, among other important elements, remain high in the EU-Moldova political agenda, and are defined as crucial cooperation areas in the Association Agreement. Comprehensive Institution Building Programme (CIB) 2

3 Many Moldovan institutions still lack the strength and expertise to perform their full role within the framework of the signed AA/DCFTA. On 24 November 2010, a framework for a Comprehensive Institution Building Programme was signed by the EU and the Government of Moldova. The institutions identified in the CIB framework are in three clusters: i) public administration, ii) rule of law, human rights & freedoms and iii) preparing for the DCFTA. The Assistance covered by these Terms of Reference is part of the third cluster of the CIB - implementation of the DCFTA. 3. Description 3.1 Background and justification: The National Institute for Standardization is acknowledged by law to be the sole National Standards Body, under the coordination of the Ministry of Economy of the Republic of Moldova. It was established in 2013 as a result of the splitting of the National Institute for Standardization and Metrology by the Governmental Decision no. 1066/ on some measurements of quality infrastructure reformation. INS mission consists of contributing to enhancing the competitiveness of the Moldovan economy, growth of population wellbeing and sustainable use of resources. This is being realized through transposition of European and international standards and promotion of the benefits of standards and standardization. As for its international cooperation, INS is a correspondent member of the International Standardization Organization (ISO), associated member of the International Electrotechnical Commission (IEC), affiliate member of European Committee for Standardization (CEN) and of the European Committee for Electrotechnical Standardization (CENELEC) and observer within the European Telecommunications Standards Institute (ETSI). According to a new governmental Decision adopted by the Governmental of Moldova (GoM) early 2017 but still to be officially published in the Monitor Official by end February, 2017, the National Action Plan for the Implementation of the Association Agreement (AA) with the European Union (EU) has been adopted. Under this new Action Plan Art. 73, amongst others foresees, that the Moldovan National Standards Institute (NSI), under management of the MoE, will strengthen in Quarter 4, 2017 the cooperation with existing system partners in view of further achieving the conditions for taking up full membership of the European Union Standardisation Bodies and this as a prerequisite to obtain full membership of CEN and CENELEC. In the same spirit Art. 173 also mentions that NSI will continue to actively develop the partnership with EU standardisation bodies in its capacity of associate member of CEN and CENELEC and observer member of ETSI, INS has to become full member of the European standardization organizations CEN and CENELEC and has to initiate the relevant procedures for this purpose in The full membership criteria are described in CEN- CENELEC Guide 20, whereas CEN-CENELEC Guide 22 comprises the organisational structure and processes for the assessment of the membership criteria of CEN and CENELEC. 3

4 In this context, INS has to revise all its internal processes and procedures and to adjust them according to the provisions of CEN-CENELEC Guide 20, as well as to implement a Quality Management System according to the standard SM SR EN ISO 9001:2015. A certified QMS is a requirement of CEN and CENELEC for the self-assessment based on CEN-CENELEC Guide 22. At the moment, INS is one of the beneficiaries of the Twinning project Strengthening of the standards and metrology sector according to the best practice in the EU Member States, which covers, to some extent, the subject of CEN and CENELEC full membership. Nevertheless, there is a great amount of work to be done to fulfill the membership criteria for this status and this twinning light project shall ensure the support of EU to the Republic of Moldova, and especially to INS, to adjust the Moldovan standardization system to the European one, in order to comply with the CEN and CENELEC full membership criteria and be able to take active part in the European standardization process, expressing the national point of view. 3.2 Linked activities At the moment, INS is involved in: - Twinning project Strengthening of the standards and metrology sector according to the best practice in the EU Member States, which covers four components: legal approximation of Moldovan standardization, metrology and conformity assessment legislation aligned with the EU Acquis; international recognition of the metrology system; conformity assessment and standardization. The standardization component of the project refers to aspects like awareness rising, collaboration among the standardization body and other stakeholders, use of IT tools, participation in European standardization work, withdrawal of conflicting or obsolete standards and self-assessment based on CEN-CENELEC Guide 22 regarding the organizational structure and processes for the assessment of the membership criteria of CEN and CENELEC. - Technical assistance project Support to the implementation of the DCFTA process in Moldova, which aims at assisting the Government of the Republic of Moldova by providing capacity-building and institutional strengthening technical assistance services within the DCFTA context in the areas of quality infrastructure (standardization, metrology, conformity assessment, testing and international cooperation); market surveillance in the field of industrial and non-industrial products and services; developing and diversifying internal and external market conditions and opportunities; and assisting the Government in designing and carrying out public awareness activities promoting DCFTA benefits. - USAID and FHI 360 project on Informing the public and stakeholders about the European standards adopted under DFCTA, which has the main goal to support the European integration of Republic of Moldova by contributing at harmonization with European standards in education and business environment using best practices from Romanian experience. The project deals with challenges emanating from Moldova s entry into the Deep and Comprehensive Free Trade Area. This complex and lengthy process requires replacing the incompatible GOST standards with new ones. The Moldovan society is not sufficiently 4

5 informed about forthcoming changes, and universities lack access to up to date information which negatively affects the quality of education. This project has the objective to achieve improvements in this field and aims to raise the awareness of the latest EU standards, improve the skills of the academics, and increase the engagement of entrepreneurs in the discussion about how DCFTA contributes to the economy. - "Implementation of Eurocodes in the Republic of Moldova and enhancing access to standards" is a project to which INS applied together with the Ministry of Regional Development and Construction. The MS partner is the Czech Republic. INS shall receive support in enhancing online secured access to national standards to all stakeholders and shall develop a web platform for Technical Committee members to facilitate the standardization process. - Also, INS benefited previously of a World Bank project Competitiveness Enhancement Project, as a result of which a standards database was developed ( - There is another EU funded TA project under contracting on Quality infrastructure, to start in September Results: By the end of this project, INS shall have implemented Quality Management System (1); the internal processes and procedures shall be adjusted or comply with the provisions of CEN- CENELEC Guide 20 on membership criteria (2); and INS shall conform to CEN/CENELEC membership criteria(3). 3.4 Activities: The below listed activities are followed by an approximate indication of the inputs required from the MS. Component 0: Project Coordination Activity 0.1: Opening Conference A half day Opening Conference will be organized in the first month after the project start aiming at launching and presenting the project to the stakeholders, the media and the public at large. In order to guarantee large public information about the start of the project, the meeting will be concluded with a press release. The Conference will be organized by INS in cooperation with the EUD, the Ministry of Economy and the embassy of the MS involved. Benchmarks: Stakeholders, media and public informed about the start and content of the project by beginning of month 2. Resources: PL, 3 w/d, interpretation, rent of premises. 5

6 Activity 0.2: Intermediate Steering Committee Meeting The Steering Committee will meet at least once every three months (first time in month 4). Progress in the areas of the project s interventions will be discussed with the beneficiary and the members of the Steering Committee. It will be organized by INS. Beneficiary shall also provide the Secretariat of the Steering Committee. Final Steering Committee will be held following the Closing Conference on the same day. Activity 0.3: Closing Conference A Closing Conference (wrap up meeting) will be held in the last month of the project at which the results and impact of the project will be presented. The Conference will present recommendations for possible follow-up and lessons learned for similar projects. Project will invite the beneficiary, Moldovan Government, interested parties in standardization, civil society, other donors and media to the closing conference. The Closing Conference will be followed by the final Steering Committee. The Closing Conference shall result with a press release. Benchmarks: Closing Conference organized, recommendations and lessons learned formulated and discussed; stakeholders, media and public informed about the results of the project at its end. Component 1: Quality Management System implementation according to ISO 9001:2015 Activity 1.1: Assessment of the management system of INS The project shall begin with the assessment by the expert of the current management system of INS, who shall develop, together with the INS involved staff, an Action Plan to be followed for the optimization of the current management system and the implementation of a QMS based on ISO 9001:2015, with responsible persons and deadlines included. After the first mission during activity 1.2, the expert shall perform a mid-term review that shall result in a report with nonconformities and corrective actions. After all documentation is developed in activity 1.2, the expert shall perform a final audit (precertification audit) of the QMS implementation process that shall prepare INS staff for the initiation of the certification process during the 5 th month of the project. Benchmarks: Assessments performed; a report indicating the gaps and weaknesses of the Management System documents based on a root cause analysis, the corrections and corrective actions proposed and recommendations of processes optimization, as well as the 6

7 training needs for an effective improvement of the management systems; Action Plan developed; mid-term review report; final audit report. Resources: 1 expert, 3 missions, 3x5 w/d, interpretation. Activity 1.2: QMS documentation development The expert shall consult and assist the INS responsible staff in structuring and developing the QMS documentation. Examples of QMS documents of the MS National Standards Body shall be presented to INS responsible staff in order to facilitate the development of QMS documents. After the audit performed by an Accreditation Body, the expert shall consult and assist the INS staff to finalize the optimization and implementation of the QMS, based on the results of the audit and the report of the Certification Body. Benchmarks: QMS documentation developed, nonconformities closed. Resources: 1 expert, 3 missions, 3x5 w/d, interpretation. Activity 1.3: Study visit to MS National Standards Body The INS staff shall perform a study visit to the MS National Standards Body to undertake MS best practice in the field of QMS implementation within a standardization body. Benchmarks: Study visit performed; study visit report. Resources: 5 INS staff, 1 visit, 5 w/d, interpretation. Activity 1.4: Preparing the INS internal auditors The expert shall train the relevant INS staff to be able to perform the internal audit, to observe the non-conformities and to suggest corrective actions during future audits. The training shall be done according to the latest versions of ISO 9001 and ISO The expert shall be an experienced auditor. Benchmarks: Training performed; auditor certificates issued; 6 months/1 year after the training, report on the implementation in the job of the lessons learnt. Resources: 1 expert, 1 mission, 5 w/d, interpretation. Activity 1.5: Trainings on the QMS implementation with reference to the developed QMS documentation After the implementation of QMS, the INS staff shall be trained regarding the organizational changes in INS due to QMS implementation (new processes and procedures). Benchmarks: trainings performed, certificates issued; 6 months/1 year after the training, report on the implementation in the job of the lessons learnt. 8 Component 2: Assessment of INS internal processes and procedures according to CEN-CENELEC Guide 20 provisions Activity 2.1: Expert mission assessing the INS internal processes and procedures according to CEN-CENELEC Guide 20 provisions The experts shall assess the current internal processes and procedures according to CEN- CENELEC Guide 20 provisions in a top-down approach: identify with INS-leader activities/departments potentially impacted through the requirements of Guide 20. Follow-up focusing on departments identified. An Action Plan shall be developed comprising all documents to be developed/adjusted according to CEN-CENELEC Guide 20 provisions, with responsible persons and deadlines included. Benchmarks: Assessment performed; assessment report developed; Action plan completed. Resources: 4 experts, 4x1 mission, 4x1x5 w/d, interpretation. Activity 2.2: Expert mission consulting the INS responsible staff in performing an intermediate self-assessment according to CEN-CENELEC Guide 20 and 22 provisions After all documents are developed/adjusted according to CEN-CENELEC Guide 20 provisions, the experts shall simulate, together with the INS responsible staff, an intermediate selfassessment to see the progress of the optimization and integration of the national standardization system into the European one. Benchmarks: Intermediate self-assessment performed, report developed. Resources: 4 experts, 4x1 mission, 4x1x5 w/d, interpretation. Activity 2.3: Expert mission consulting the INS responsible staff in performing the final self-assessment according to CEN-CENELEC Guide 20 and 22 provisions Close to the end of the project, the experts shall assist and consult the INS responsible staff in performing the final self-assessment according to the provisions of CEN-CENELEC Guide 20 and 22. 9 Component 3: Adjustment/development of INS internal processes and procedures according to CEN-CENELEC Guide 20 provisions Activity 3.1: Adjustment/development of INS internal processes and procedures according to CEN-CENELEC Guide 20 provisions The experts shall consult and assist the INS staff in drafting/adjusting the INS internal processes and procedures. Every membership criteria shall be examined and evidences provided. Examples of documents of the MS National Standards Body shall be presented to INS responsible staff in order to facilitate the development of procedures. Benchmark: Procedures developed/adjusted; evidences available for each membership criteria; INS fulfils CEN and CENELEC full membership criteria. Resources: 4 experts, 4x3 missions, 4x3x5 w/d, interpretation. Activity 3.2: Trainings on the implementation of CEN and CENELEC membership criteria with reference to the developed documentation The INS staff shall be trained regarding the organizational changes in INS due to CEN and CENELEC membership criteria implementation (new processes and procedures). Benchmarks: trainings performed, certificates issued; 6 months/1 year after the training, report on the implementation in the job of the lessons learnt. Resources: 3 experts, 1 joint mission, 3 w/d each expert (3x1x3), interpretation. 3.5 Means/ Input from the MS Partner Administration Profile and tasks of the Project Leader The Project Leader should be a high ranking civil servant or equivalent staff of Member State public administration or mandated body in the relevant field (Standardisation). The PL will be responsible for achievement of project results, ensuring the activities for the co-operation and information exchange between EU MS side and Beneficiary side and ensuring that all the required support of the management and staff of the EU side are available. He will coordinate the Project Steering Committee meetings on the EU MS side. The PL shall devote a minimum of three working days per month in his home administration, with an on-site visit to the Republic of Moldova at least every 3 months to participate in the PSC meetings. Profile: University level education in engineering or another field relevant to the scope of the project. 9

10 At least 10 years' experience within a Quality Infrastructure Body, of which at least 5 in the field of standardisation or related regulatory field in a EU Member State 1 Excellent command of English. Experience in project management. Indicative minimum profile of the Short Term experts: University degree in the field relevant to the scope of the project Working knowledge of English. At least 5 years of professional experience in a National Standards Body (inclusive during last 3 years). 4. Institutional Framework The beneficiary institution of this project is the National Institute for Standardization of the Republic of Moldova. According to the Law on Standardization no. 590/ , INS is acknowledged as the National Standards Body. It is a public, non-profit institution subordinated to the Ministry of Economy of the Republic of Moldova. INS has a staff of 42 persons: Director 1 person; Deputy Director 1 person; Standardization Department 12 persons; National Standards Fund 10 persons; 1 In any of the current 28 EU Member States regardless the number of membership years to EU from any given EU MS. 10

INS has attributions granted by law, including: - setting of standardization principles and methodology; - developing the National Standardization Program; - adoption and dissemination of national standards; - coordination of technical committees activity; etc. 5. Sustainability The achievements of the twinning light project (mandatory results) should be maintained as a permanent asset to the Beneficiary administration even after the end of the project implementation. This presupposes, inter alia, that effective mechanisms are put in place by the Beneficiary administration to disseminate and consolidate the results of the project. 9. 13 Participation will be open to both female and male personnel, regardless of their ethnic background, political affiliation or religious believes. Records of staff participating in training and other project activities will reflect this statement. The gender structure within the public authorities, entities and bodies on state and local level where are the majority of procurement purchases is well balanced. This enables fair male/female deployment in the execution of the project itself. Poverty Reduction The project supports economic development and increases the opportunity for Moldovan economic operators to do business with the European Union counterparts and beyond. Based in the notion that raising waters lift all boats, the project will ultimately contribute to the reduction of poverty in Moldova. Environment The project is not envisaged to have a direct impact on the environment nor is it specifically targeted to address environmental concerns. There may be some positive impacts on the environment due to adoption of European and international standards with concern to the environment. Good Governance and Human rights The project will support Good Governance by ensuring that legislation currently in force is implemented even-handed and the reliability of documents provided by mandated bodies is improved, thus leading to a higher level of trust by the citizens in the administrate system of Moldova. A correctly implemented Quality Management System ensures confidence of standards users in INS and serves as an example of good practice to other institutions. 10. Conditionality and sequencing The Government of Moldova commits to follow its current EU path, in particular, towards the transposition of European legislation and standards. As well, the management of INS ensures that its staff will be made available to contribute to the success of the project and achievement of its purpose. Annexes ANNEX 1: Logical Framework Matrix 13
