3 SEPA Purpose and Lead Agencies The purpose of the SEPA environmental review is to determine if there are potential significant impacts from a proposal and if so, can they can be mitigated. Washington State has multiple facility expansions and new facilities proposed to handle a variety of energy commodities. There are different SEPA lead agencies based on the permits required and other requirements. Could be a port, city, county or state agency. For proposals to construct facilities on a single site for storing a total of one million or more gallons of any liquid the lead agency shall be Ecology.

4 Why an Environmental Impact Statement? Under SEPA, an EIS is necessary if a proposal is likely to result in significant adverse environmental impacts This determination is made by the SEPA lead agency or co-lead agencies after scoping.

5 Permit decisions are made only after the EISs are completed. These permits are based on regulatory requirements for each agency responsible.

6 Elements of the Environment An EIS will evaluate: Affected Environment (existing conditions) Direct and Indirect Impacts of Proposal No Action Alternative Cumulative Impacts Potential Mitigation Measures

7 EIS Studies Many resource areas are being studied in each EIS. These are evaluated based on the proposals. For example: Rail Transportation Impacts Vessel Transportation Impacts Environmental Health Spill Risks Fire and Explosion Risks Tsunami and Seismic Risks

8 Example: Rail Impacts For the Westway and Imperium proposals, the Co-Leads are studying potential rail traffic impacts: Analysis of safety considerations of transport of crude associated with infrastructure, (trackage, grade crossings, water crossings) and safety of cars transporting oil Train and vehicle delays, and associated safety issues * The level of detail for the above will be commensurate with the significance of the impact in a particular location
