1 Version 2 Frequently Asked Questions A - GENERAL 1. Is the MCNet network fee paid before or after declaration processing? The MCNet network fee is paid at the same time as duties. The payment is done based on the Payment Invoice issued automatically by the system immediately after the submission of the declaration. Thus all taxes and fees are paid before the declaration is processed by customs. 2. What are the conditions for the importer to access the SeW? For an importer to have an access to the SeW, first should participate in training of module for Importers/Exporters and get registered to have credentials for SeW access. B - PROCEDURES 3. In which cases declaration can be cancelled? Declaration can be cancelled as errors results: By the initiative of customs, if there are legal grounds; By the initiative of the declarant/clearing agent; For lack of payment of taxes, duties and fees within stipulated deadlines. In this case, the declarant/ clearing agent is subject to the payment of a fine of 2.500,00 MT, established in line c), nº. 6, article 39 of the Ministerial Decree 16/2012 of February 1 st. 4. How to submit a declaration in which the goods benefit from exemption / reduction of taxes duties and fees? When completing the declaration a CPC for exemption/reduction should be selected, and attach the poof of the respective exemption/reduction. 5. How to act when I cannot find a BL in the system? The clearing agent should contact the shipping agent and cross-check the BL data with the data introduced into the system. They should also check that no change has been done to the BL. 6. How regime changes will be made in the SeW? The change of regime is requested to customs and when authorized, the clearing agent submits the respective declaration indicating the applicable CPC. 7. How is the application for packing done in the SeW? How to register and a get Freight Forwarder user access in SeW? To get registered as a freight forwarder, according to the Service Order 08/GD/DGA/2013 that sets the mandatory use of the SeW for the submission of Customs goods declarations for transit and warehousing regimes as well as Circular no. 03/GD/DGA/2013 establishing the requirements for the registration and subscription of Freight Forwarders, you should: Complete the registration form and submit to the Customs General Directorate or Regional Directorate and Provincial Services where your company is based. 2 Provide a guarantee in the terms of the Ministerial Decree DM 116/2013, of August 8 th that approves the Customs Transit Regulation. Deposit the guarantee at the Customs Secretariat of dispatch to initiate the transit operations. 9. How to proceed in cases where the freight forwarder has a headquarters and branches? The Freight Forwarder should submit only one application for registration, on which must fill up forms for the headquarters as well as branches as per the Service Order 08/GD/DGA/2013. Complete forms, one with information of the headquarters and another with information related to the branch. 10. Where the application for registration and of Freight Forwarder should be submitted? The Freight Forwarder should submit their applications at the Customs General Directorate or headquarters of the Regional Directorates and headquarters of Customs Provincial Services. 11. Who should provide the transit guarantee? As per nº. 2, article 16 of the Ministerial Decree 116/2013, of August 8 th, the guarantee should be provided by the declarant or transporter or transit warehouse operator authorized by the Ministry of Transport and Communication for bonded goods carrier. 12. What are the types of guarantee to be provided for the transit regime? The guarantee can be: Revolving, when it covers a certain number of operations done during a minimum period of 3 month up to 1 year renewable. Fixed, when it covers only one transit operation. 13. What should the guarantee cover? In case of fixed guarantee this should cover all customs duties and other taxes and fees of which the goods in transit are And when it refers to revolving guarantee this should cover: Goods with fiscal caution 20% of customs duties and other taxes and fees of which the goods in transit are Goods without fiscal caution 35% of customs duties and other taxes and fees of which the goods in transit are 14. What are the types of guarantee? Cash; certified Check; Insurance Policy; Bank Guarantee; Treasury Bonds; Terms of Responsibility 15. How to extend the guarantee? The applicant must request the extension of the guarantee at the Customs Secretariat of dispatch where it was registered. 16. When should transit customs declaration be submitted? The transit customs declaration and its documentation must be submitted to Customs any time until the moment the mean of transport arrives at the border with the goods. The number of partial shipments in each declaration must be equal or less than forty (40). 17. When does the guarantee trigger occurs? The guarantee trigger occurs at the moment that the means of transport arrives at the border. 18. When does the guarantee acquittal occurs? 3 19. When is the transit operation considered completed? The transit operation is considered completed when the goods and the means of transport are presented to customs officers at the exit border. In case of partial shipments, is considered completed transit operation when the last mean of transport declared on the transit DU is presented at the exit border. 20. What is the procedure for the acquittal of the transit guarantee? For the acquittal of the guarantee, the applicant must request Secretariat of dispatch where it was registered. 21. How to proceed with the guarantee use monitoring? The system controls the trigger and acquittal of the guarantees and whenever necessary it notifies the declarant about the need to increase the amount of the guarantee. The system also allows the visibility of the use of guarantee by the declarant. 22. When should the guarantee value be increased? The guarantee should be increased when the amount of duties, taxes and fees chargeable for the goods in transit exceeds the amount of the guarantee provided. 23. With the implementation of transit in the SeW, will there be a need to return the documents to the border of entry or the Customs office? No. Transit declarations are submitted to Customs electronically, as well as the subsequent processes. The officers at the borders, both at the entry and at the exit, receive the declaration electronically and update the information about the entry and exit of goods in the system. 24. How to obtain information about the status of the declaration? Based on the declaration number or reference, the declarant through the system can view and follow the status and any other information related with transit operations. 25. When goods crosses the border of exit what is the confirmation that the Freight Forwarder or clearing agent can get in order to know that the goods have crossed the border, since that the guarantee is active? The agent or clearing agent confirms the exit of the goods through the view of the status completed clearance on the system. 26. What are the procedures to be followed when the driver transporting goods in transit arrives at entry point? And what type of document is to Customs? Road transportation mode: The transporter/driver upon arrival at the border should provide to Customs the number or reference or printed transit declaration (SAD 502) that replaces the transit form M-14. After the verification of compliance and necessary updates on the system the transporter/driver will be given a transit declaration (SAD 502).and immediate authorization to proceed. By sea and by air: The shipping agent should submit the cargo manifest. The declarant must submit the transit declaration until the moment of the arrival of the goods. 27. What document should the driver present to customs control points along the route? Along the transit route, the transporter/driver should present the declaration (SAD 502) approved by Customs at the customs entry border. D - CUSTOMS WAREHOUSING 28. When the warehouse guarantee is acquitted? 4 29. How to proceed to register a Customs warehouse in the SeW? Have a Customs warehouse and a guarantee arranged on the terms of the Ministerial Decree 12/2002, of January 30 th, that approves the Regulation of the Customs Warehouses. Deposit the guarantee at the Customs Secretariat of dispatch for registration in the SeW. Submit the request for registration of the customs warehouse, according to the Service Order nº o. 08/DGA/2013, related to mandatory use of the Single Electronic Window System for the submission of customs declaration for warehouse and transit goods. Where does request for registration of a customs warehouse request be submitted? The warehouse operators should submit their requests at the General Directorate of Customs and Regional Customs Directorates in the Center and North depending on the region where the operator is located. 31. What is UCR? E - UNIQUE CONSIGNMENT REFERENCE (UCR) It is the number issued/assigned automatically by the system for all international commercial transactions in it s genesis, able to identify uniquely a given consignment, either at national or international level. 32. What is the structure of the UCR? The UCR reference is alphanumeric, where: The first digit is reserved for the year (within a period of 10 years). The following two digits indicate the ISO alpha-2 code of the Country (Attributes the uniqueness at country level) Followed by a number from 0 to 9 (attributes the uniqueness of the transaction) 33. What is the UCR for? To be presented to the customs authorities and other entities involved in the customs clearance process when requested at any moment of the transaction or customs procedures. To enable the facilitation and legitimacy of international trade by the customs authorities maintaining the levels of security necessary. To enable an efficient exchange of information and statistics between Customs authorities. 34. What is the UCR applicable for? It is applied to all consignments of goods subject to Customs control. 35. Who should apply for the UCR? International trade operators through their representatives before customs. 36. At what moment an UCR should be for? The reference should be requested before the start of any transaction for international trade, in other words, before the start of the first act process ending in customs clearance of goods, since it should be mentioned in all transactions related to a certain consignment, for example:, commercial banks payment abroad transactions, issue of licences or permits from the Ministries and/or controlling agencies, issue of transport document or ownership title of goods - consignment ( Bill of Entry, AWB, and others) and submission of the customs declaration. 37. Where and how to get the reference and how much does it cost? The reference is available in customs SeW platform. The issue is automatic, free of charge and the assignment is, immediately after the successful submission of the application for UCR. 38. What are the benefits of the UCR? Promotes the safety between borders and access to the information for customs clearance. Enable a better management of the processes and provides operators from parties involves with compensations in the procedures and facilitates the integration and treatment in the whole transaction. Allows the processing of data in advance before the submission of the customs declaration. Contributes to faster clearance of goods through customs. 5 Eliminates the redundancy of information submitted by the transporter and importer. Reduces the quantity of information requested when clearing goods through customs. Provides an additional tool to the management of the arrival/receipt of the global cargo. Promotes more cooperation between Customs authorities. 39. Is it mandatory to use UCR? Yes. Since the mandatory use of SeW for application and issuance of Letter of Commitment for Bank Intermediation for Export of goods through AVISO 01/GBM/2013.
