In the event a claim is made with regard to defective materials or workmanship, Harvill industries shall have the option to replace or grant credit for its product if it is determined in its sole discretion to be defective at time of sale. The foregoing states Harvill Industries sole responsibility for breach of the warranty. In no event shall Harvill Industries be liable for consequential damages, including but not limited to loss of product and production down-time. This warranty shall not apply to any part or parts of hose products if it has been installed, altered, repaired or misused, through negligence or otherwise, in any way that in the opinion of Harvill Industries Products affects the reliability of, or detracts from, the performance of the product. Nor does this warranty cover replacements or repairs necessitated by loss or damage resulting from any cause beyond the control of Harvill Industries Products, including but not limited to acts of God, acts of government, floods and fires. All warranty claims shall be presented within thirty days after delivery of the product. In addition, claims in regard to bulk hose will be honored only if presented within six months of date of purchase.
