6 REGULATIONS FOR USAGE OF PORT CRANES 11 6.1 Crane usage Regular time refers to normal working hours for crane operators at the Port of Umeå. All other time is considered overtime. Pauses in work during overtime, with no charge, may only occur for predetermined meal breaks for the stevedore and dock workers. Each commenced half hour, both during regular time and overtime, shall be counted as a full half hour. Minimum fee, 1.0 hour. Fees are calculated from the time that the crane ordered is provided to the client. Should a vessel be delayed during ongoing work from one crane to another, the time for both cranes shall be combined and billed as if work continued without delay using a single crane. 6.2 Ordering of cranes The client, who desires to utilize a crane, shall place their order with the port office in good time. The order in which vessels are granted cranes is determined by the port office. Consideration is given, to the extent possible, to the order in which vessels arrived into the port and to the type of goods that will be handled by the crane. A crane shall be made available only if an order has been placed with the port office in accordance with below: a) For work during normal working hours, an order shall be placed with plenty of notice, preferably closest to the previous normal working day prior to when the crane will be used. b) For overtime work during normal meal breaks, this can be approved by way of exception, if the order is placed at least 1.5 hours before the start of the meal break. c) For overtime work up to 5.0 hours in conjunction with regular working hours, such an order shall be placed no later than 1:00 p.m. on the same day. d) For overtime work exceeding 5.0 hours in conjunction with regular working hours, such an order shall be placed no later than 3:00 p.m. on the previous regular workday. e) For overtime work during other periods, such an order shall be placed no later than 1:00 p.m. on the previous regular workday. The above order times also apply as the latest cancellation times. When ordering overtime work, its length and location shall be specified. If a crane is not put to use within 1.0 hours of the ordered time, or at the point at which the crane is provided for use, then the client will have lost the right to use the crane, but remains obligated to pay the fee for 1.0 hour in accordance with the port s fee schedule. Should the client thereafter still wish to make use of the crane and the port office approves, or should there be a waiting period after the crane has been in use for at least 1.0 hours and that pause is not caused by a problem with the crane, then a waiting fee will be charged. If a cancellation regarding overtime work has not been made within the prescribed time and the crane has not been put into use, the client is obligated to pay the waiting and overtime fees for 2.0 hours in accordance with item c) above and for 6.0 hours in accordance with item d) and e) above. Placing an order on a crane does not convey the right for the client to have the crane at their disposal during any other time or for a longer period of time than what the crane as been ordered for implementation of the intended work. If the client has rented the crane, it may not provide lifting for other clients even if the client who has rented the crane allows such a lift unless approval is granted by the port office. The party responsible for ordering the crane is the one renting the crane. 6.3 Provisions regarding performance of crane work. The client shall always follow the regulations that have been provided by the relevant crane or port employees regarding crane usage. The crane may not be used for lifting weights larger than the specified maximum weight, including the weight of the loading and unloading tools. Goods may not remain hanging from the crane longer than required to load or unload them. Goods may not be dragged by the crane on the wharf or onboard, nor be lifted until freed from adjacent goods or other hindrances.

12 Should the client specify weights of lifted individual items less than the actual or use the crane for weights larger than what the crane is specified for, then they well be held responsible and be obligated to pay a supplemental fee of SEK 1,000.00 per 100 kg of weight that the crane was overloaded with. When using a crane, the port shall provide the crane operator. It is incumbent on the client to hire and pay all other personnel required for the crane s usage. In addition, the client is obligated to provide sufficient assistance, i.e. monitoring of power cables during every move of the crane and to ensure that the crane track is free of hindrances. The client shall, at their own expense, furnish or rent the requisite materials for fastening the goods to the crane. An exception is made for grip scoops, which can be provided by the port for use with the appropriate goods. The port maintains the right to freely use the available crane resources without any legal ramifications for the port. 6.4 Responsibility for damages The port is not responsible for damages that could occur on the gangway, rope ladder or other extruding portions of vessels when moving cranes along the wharf. Nor is the port responsible for damages that could occur to individuals, goods that are hanging from cranes or other objects, due to the crane or portions thereof breaking. The port is responsible for damages if the crane shows obvious shortcomings or insufficient maintenance, or if the port s employees cause damages in some other manner. Furthermore, the port is not responsible for expenses that could fall on the client if the ordered crane cannot be put at their disposal or be used. The client is obligated to compensate for all damages that occur to the ports or someone else s property due to either the client s fault or negligence or that of their employees. 6.5 Crane fees If so required, crane fees shall be submitted when ordering the crane or collateral given for the estimated crane fee. For work that involves a significant departure from normal conditions, the port maintains the right to charge a reasonable supplementary fee based on the hourly rate for the crane. 6.6 Renting an outside crane Renting an outside crane for goods handling within the port area may only occur under the port s supervision, with the port receiving compensation for any costs arising in conjunction with such a rental.
