Page 4 of 10 TERMS AND CONDITIONS 1. The tenderers should quote their rate per sq feet 2. The EMD of the tenderer will be forfeited, if the tenderer withdraws his tender after opening of the tender. 3. Firms should quote their rates (inclusive of all Govt. Taxes) as per BOQ, after visiting the site of work. No telegraphic or faxed bid will be acceptable. 4. The Jobs must be completed within 30 - days after issuance of work orders. 5. No transportation and carriage / mobilization charges will be allowed. 6. TDS & work contract tax will be deducted at source as per Government Rules. 7. The work, if done below prescribed specifications / standard, will not be accepted and the Firm concerned will have to do it again at his own risk and cost. 8. The bid with lowest total cost conforming to specifications and terms & conditions prescribed in tender document shall be considered for award of contract 9. Disputes and Arbitration:- Settlement of Disputes 26.1.1. The disputes and difference arising out of or in connection with services rendered and the performance of the contractor shall be referred to the Managing Director of FDDI. His decision with respect to interpretation of the situation shall be final, conclusive and binding on either parties hereto and shall be without appeal. 26.1.2. All other disputes and differences of any kind whatsoever arising out of or in connection with the contract or the carrying out of the work (whether during the progress of the work or after its completion and whether before or after determination, abandonment or breach of the contract) shall be referred to the Managing Director of FDDI whose decision shall be final and binding on the parties. 26.2. Arbitration All disputes between the parties to the contract arising out of or in relation to the contract shall after written notice by either party to the contract to the other party, be referred to sole arbitration of the Managing Director, FDDI or his nominee. The arbitration shall be conducted in accordance with the provisions of the; Arbitration and Reconciliation Act. 1996. The parties to the contract understand and agree that it will be no objection that the Managing Director, FDDI or the person nominated as Arbitrator had earlier in his official capacity to deal directly or indirectly with the matters to which the contract relates or that in the course of his official duties had expressed views on all or any of the matters in dispute or difference. The award of the Arbitrator shall be final and binding on the parties to this contract. In the event of the Arbitrator denying, neglecting or refusing to act or resigning or being unable to act for any reason or his award being set aside by the Court for any reason, it shall be lawful for the Managing Director or his successor, as the case may be either to act himself as the Arbitrator or to appoint another Arbitrator in place of the outgoing Arbitrator in the manner aforesaid. The Arbitrator may, from time to time, with the consent of both the parties to the contract, enlarge the time for making the award. Work under the contract shall be continued during the arbitration proceedings. The venue of the arbitration shall be the place from which the contract is issued or such other place as the Arbitrator at his discretion may determine.

Providing and laying commercial grade floor tiles 3600 ( As mention in scope of work) of approved size and Sq feet uniform thickness of any approved shade in flooring/skirting to all flats and passage at 4 heights set in cement mortar 1:3 12mm thick base with a floating coat of neat cement base with slurry to proper line as per drawing and design including cutting to the required size shape and fixing at corners splay and chambers etc. joints properly finished with white cement paste curing, cost, of all materials and labor, taxes, conveyance to site of work and including cleaning the surface with proper chemical solvent as per the direction of the AM- Maintenance. The materials for base course and including cement will be supplied by the tendered. AMOUNT (IN RUPEES) NOTE: 1. The area of work mention above may vary. 2. Total amount shall include work contract tax, VAT, Excise and any other statutory taxes costs due to Transportation, handling, and installation, etc. 3. TDS will be deducted as per government norms. 4. Do not attach any other sheet to this Annexure. 5. The tenderer are advised to ensure that the prices and other details are filled in correctly and completely in the above format. Submission of incorrect or incomplete information, and / or submission of the above format with arithmetical errors in compilation of the data would be at the tenderer's sole risk and the decision of FDDI in such cases would be final and binding.

Page 9 of 10 ANNEXURE-IV SCOPE OF THE CONTRACT The contractor will Supply and fix the floor tiles in One Bed Room Ground Floor 08 No. Flats and passage at FDDI Fursatganj. The following services are required to be provided by the contractor during normal working hours. 1. Removal of cemented flooring from the floor and compacting PCC with additional cement spreading cement mortor 1:3 ( 1 Cement 3 fine sand)for floor tile fixing jointing with gray cement slurry @3.3 Kg per Sq.mt including pointing in whitecement mixed with pigment of matching shade complete. The whole floor will be smooth and 00 level after laying the tiles. Complete filling of mortar below tiles shall be ensured by the contractor. 2. Removal of old scatting and fixing of scatting tiles shall be colored to match with floor tiles and of 4 size. These shall be laid over 12 mm thick cement mortar (1:3) and set and jointed in neat cement slurry and painted in white cement and colour pigment to match the tiles. 3. The vitrified tiles to be supplied of size 600mm X 600mm X 10mm thickness, make Somany/Orient

Whereas the contractor has offered to enter into contract with FDDI Fursatganj for the execution of work of Supply and fixing of floor tiles in One Bed Room Ground Floor 08 No. Flats and passage at FDDI Fursatganj with supply of men & material and other associated works in FDDI Fursatganj on the terms and conditions here in contained and rates approved by FDDI Fursatganj (copy of Rates annexed) have been duly accepted and whereas the necessary Security Deposits have been furnished in accordance with the provisions of the tender document and whereas no interest will be claimed on the security deposit. Now these presents willingness and it is hereby agreed and declared by and between the parties to these presents as follows. 1. The contractor shall during the period of work herein after mentioned, safely carryout, by means of labors employed and material required at his own expenses and by means of tools, implements and equipment etc to be supplied by him to his labor at his own expenses & all documents (annexed to the agreement), whenever required by A.M. Maintenance. It is deemed to be understood by the contractor that the quantity of work mentioned on the schedule is likely to change as per actual requirements as demanded by exigencies of services. 2. The notice Inviting Tender (NIT), Bid documents, Letter of Intent. Approved rates, annexed here to and such other additional particulars, instructions, work orders as may found requisite to be given, during execution of the work shall be deemed and taken an integral part of the contract and shall _ be deemed to be included in the expression 3. The contractor shall also supply the requisite number of workmen with men & materials as well as tools, appliance, machines, implements, vehicles for transportation, cartage etc required for the proper execution of work within the time prescribed in the work orders. 4. The contractor shall abide by the terms and conditions, rules, guidelines, construction practices, safety precautions etc. stipulated in the tender document including any correspondence between the contractor and Client having bearing on execution of work and payments of work to be done under the contract. 5.
