1 PROMOTIONAL TERMS AND CONDITIONS SPORTS FANTASY FREE FANTASY RUGBY LEAGUE COMPETITION (the Promotion ) Sports Fantasy Free Pty Limited is the promoter of this competition (hereafter referred to as Promoter or SFF ) Information on how to enter and prizes form part of these terms and conditions. Any entry not complying with these Terms and Conditions is invalid. Eligibility It is a condition of entry that all entrants accept these Promotional Terms and Conditions, the SFF Privacy Policy and the General Terms and Conditions of Sports Fantasy Free Pty Limited. Entry is open to residents of Australia only. Entrants must be at least 18 years of age. The Promoter can request proof of age at any time and this must be supplied by the entrant as soon as possible. Failure to provide this proof within this timeframe and/or to provide this proof to the Promoter s reasonable satisfaction will result in your disqualification. Employees of the Promoter, and immediate family members of employees are ineligible to enter. Entry Any entrant who complies with the steps set out in the Eligibility section and the remainder of these Terms and Conditions is considered an Eligible Entrant The Promotion commences at 9am AEST on 5 March 2016 and entries close on 6.59pm AEST on 5 September 2016 (the Promotion Period ) To enter, Eligible Entrants must register during the Promotion Period by one of the following means: 1) submitting their mobile phone number at the SFF website (the Website, www.sportsfantasyfree.com); or 2) sending a text to SFF text registrations service (mobile number 0419 226 472); or 3) downloading the SFF ios or Android app (collectively, the App ) and registering as a user in the App; or 4) registering as a user on the SFF online competition platform (the Platform, play.sportsfantasyfree.com). The Eligible Entrant must then submit an entry into a Challenge (see below)
2 Eligible Entrants that register by submitting their mobile number to the Promoter by text message or webpage warrant that the mobile number submitted is correct and operable. Entries submitted using a mobile number that is incorrect or inoperable will be automatically disqualified by the Promoter. The Promotion consists of 190 individual Fantasy Challenges (the Challenges ) that will be available during the Promotional Period. Each Challenge in this Promotion will be based on a single rugby league match organized by the National Rugby League (the NRL ). The up-to-date schedule of rugby league matches can be viewed on the NRL website: www.nrl.com. Each of these matches is referred to in these terms a Rugby League Match. Each Eligible Entrant will be provided a fantasy team comprised of players in the real-life Rugby League Matches ( Team ) by the Promoter. It is highly recommended that Eligible Entrants use the App or Platform to customize their Team, find out about the Rugby League Matches, view Team progress on live leaderboard and participate in other Challenges available via the App and/or the Platform. Eligible Entrants who register via submitting their mobile number to the Website or by text message should download the App or go to the Platform to customize their team and update their username and personal details in the Profile section of the App or Platform Entry into any single Challenge does not automatically provide entry into any other Challenge. Eligible Entrants who wish to enter more than one Challenge may do so within the App or Platform by selecting a Challenge and submitting an entry. Eligible Entrants may submit one entry only per Challenge during the Promotional Period. Each entry for each Challenge must be submitted prior to the commencement of the Rugby League Match for that Challenge. After initial entry to a Challenge, it is possible to make changes to that entry at any time prior to the commencement of the Rugby League Match for that Challenge. At any time entrants will be able to see the performance of their Team in the live leaderboard of the App or Platform. Competition entry is free but please note your mobile phone carrier may apply charges for sending text messages, downloading and using the App and/or using the platform. Please refer to your mobile carrier for further information. Prizes and winning Each Team entered into a Challenge by an Eligible Entrant will accrue fantasy points based on the real life performance of the real life players selected for the Team. Scoring is in accordance with the How to Play document available at www.sportsfantasyfree.com The top 3 winners in each Fantasy Challenge during the Promotional Period will
3 receive a $50 What s Your Team Gift Voucher Each Eligible Entrants best score from a Fantasy Challenge during the Promotional Period will be considered for a major prize. In the event that 2 or more Eligible Entrants within the Top 15 of the Overall Competition have the exact same score, the Entrants will be required to compete for their position in the Top 15 in an additional fantasy challenge conducted during the NRL Grand Final on 2 nd October, 2016. Prizes are not redeemable for cash. The Promoter is not affiliated with, sponsored by or endorsed by companies from whom we obtain the prizes.
4 The Promoter reserves the right to vary prizes at the Promoters sole discretion if a prize that is advertised becomes unavailable. The Promoter reserves the right to use entries (team line-ups) for publicity. The Promoter reserves the right to contact entrants and use/disclose their data in accordance with SFF privacy policy. Your personal information may be used for the purpose of marketing Sports Fantasy Pro to you (in accordance with our privacy policy) and we may also promote Sports Fantasy Pro to you via the App or Platform. Each Eligible Entrant will be provided a fantasy team comprised of players in the real-life AFL Matches ( Team ) by the Promoter. It is highly recommended that Eligible Entrants use the App or Platform to customize their Team, find out about the AFL Matches, view Team progress on live leaderboard and participate in other Challenges available via the App and/or the Platform. 9 GENERAL TERMS AND CONDITIONS OF SPORTS FANTASY FREE PTY LIMITED 1. General 1.1. The Service www.sportsfantasyfree.com and associated mobile apps (collectively, the "Service") and the challenges available on the Service are operated by Sports Fantasy Free Pty Ltd ACN 135 299 473 ("SFF"). 1.2. The use of this Service is governed by these Terms and Conditions, and maybe amended at any time as required. By using this Service you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them as well as the Privacy Policy and the How to Play (available at www.sportsfantasyfree.com) 1.3. If you do not agree with these Terms and Conditions, the Privacy Policy or the How to Play (including any amendment to any of these documents), you should immediately cease using the Service. 1.4. SFF may modify these Terms and Conditions, the Privacy Policy and/or the How to Play at any time. Once we have made any changes, we will notify you of these changes on our Service. 1.5. By continuing to use the Service after any amendments have been made, you agree to be bound by these changed documents. It is your responsibility to review these documents to understand the changes that have been made. 1.6. SFF is committed to the responsible management of your information. For further details, view SFF's Privacy Policy (available at www.sportsfantasyfree.com). 2. Use of Service 2.1. The Service is intended for personal use only. 2.2. You must not use the Service unless you are aged 18 or over and a resident of Australia. 2.3. SFF will only provide any account related information to the account holder. 2.4. You must not use the Service to collect and/or store the personal data of any of our users. 2.5. You must not use the Service to facilitate the advertising of any third party unless you have our prior written consent. 2.6. Without limitation, you must not send our users spam mail and you must not post links to the website of any third party anywhere on the Service.
10 3. Account Registration 3.1. SFF operates fantasy sports challenges via the Service. To participate in a Challenge, you must hold an account with SFF. You acknowledge and agree that when you register for an account: 3.1.1. You must provide true and accurate information about yourself and ensure your details are kept up-to-date on your account; 3.1.2. if you provide any false or inaccurate information or, if SFF reasonably suspects that you have provided false or inaccurate information, SFF may prevent you from opening an account. 3.1.3. As part of the full registration process, you will be asked to select a user name and password. We recommend that you change your password regularly. 3.1.4. SFF may refuse to grant you a user name that impersonates someone else, is or may be illegal, is a name in which another person s may have intellectual property rights, is vulgar or otherwise offensive, may cause confusion, or is already in use by another user of the Service, as determined by SFF at its sole discretion. 3.1.5. You are solely responsible for maintaining the confidentiality of your user name and password and for any and all activities that are conducted using your account. 3.1.6. It is the Clients responsibility to notify SFF if they suspect any suspicious activity on their account. 4. Entering Challenges 4.1. To enter a Challenge, you must, before lock-out (which is the start time for the first match to which that Challenge relates), select a team and follow all instructions on the Service relevant to that Challenge. 4.2. Your participation in the Challenges, as well as the scoring of the Challenges, is governed by the How to Play document (available at www.sportsfantasyfree.com).
11 5. User Input 5.1. You grant to SFF a non-exclusive, perpetual and irrevocable royalty free licence to copy, adapt, publish, communicate to the public and otherwise use all or any part of the materials, information or ideas provided directly or indirectly by you through the Service. 5.2. You warrant that you are entitled to grant such rights to SFF and agree to indemnify SFF if any third party takes action against SFF in relation to information you provide. 5.3. All information received from you shall be deemed to be non-confidential. 5.4. For the avoidance of doubt, this clause does not apply to any personal information you provide us when registering for an account. 6. Links and Advertising 6.1. The Service will contain hyperlinks to third party websites and/or advertising for third parties' goods and services. 6.2. SFF neither controls such linked websites or advertising nor is it liable or responsible for their content. 6.3. Display of third party links or advertising on the Service does not imply any endorsement by SFF of those linked websites or any advertised goods or services. 6.4. The user is solely responsible for any charges or obligations that may be incurred as a result of any dealings with operators of linked websites or vendors of advertised products. Other websites may also have a link to the Service posted on their website. 6.5. SFF is not responsible for the content, or the actions of any operator, of any of these websites. 6.6. SFF may be entitled to payment from a third party after you visit a third party website that is advertised on the Service. You agree that you are not entitled to this payment. 6.7. SFF shares some of the same owners as Sports Fantasy Pro Pty Limited, a licensed wagering service. Your personal information may be used for the purpose of marketing Sports Fantasy Pro to you (in accordance with our privacy policy) and we may also promote Sports Fantasy Pro to you via the Service.
12 7. Copyrights and Trademarks 7.1. The Service is protected by Australian copyright law. This copyright is owned by, or licensed to, SFF. 7.2. The Service also displays registered and unregistered trademarks, which are owned by, or licensed to, SFF. 7.3. Except for the direct purpose of viewing and accessing the Service for your own personal use (and this use must be in compliance with these Terms and Conditions), you must not reproduce, modify, communicate to the public, adapt, transfer, distribute or store any of the contents of the Service, including any Challenge, or incorporate any part of the Service into another website without SFF's consent. 7.4. Except as permitted by these Terms and Conditions, you are not permitted to use the trademarks or any other intellectual property of SFF or any other party whose intellectual property appears on the Service or whose intellectual property is used by SFF to develop and/or maintain the Service ( Third Party IP Owner ). 7.5. You acknowledge and agree that SFF and each Third Party IP Owner reserve their rights and may take action against you, including legal proceedings to protect their rights. 8. User Indemnity 8.1. Subject to the Australian Consumer Law you agree to defend, indemnify and hold harmless SFF and its employees, directors, and officers from any claims, actions, losses, damages, liabilities, judgments, settlements, and other costs and expenses (including legal fees and disbursements) arising out of or relating to: (i) any breach of your obligations under these terms and conditions, or (ii) the placement by you of a link to the Service on any website or in any e-mail. 8.2. This indemnity shall include any costs and expenses incurred by SFF in any actions taken to enforce this indemnity.
13 9. Disclaimer and Limitation of Liability 9.1. Subject to the Australian Consumer Law: 9.1.1. In no event shall SFF be liable (whether for breach of contract, negligence or for any other reason) for any loss arising from the use of the Service. 9.1.2. You agree that your use of the Service is on an as is and as available basis and that your use of the Service is at your sole risk. Except as expressly set out in these Terms and Conditions, SFF does not make any representations or warranties in relation to the Service (including any implied term relating to quality, fitness for a particular purpose). 9.1.3. You agree that SFF is not responsible for any statement or opinion expressed by any user on the Service. You agree that you are solely and fully responsibility for any comment you post on the Service. 9.1.4. SFF does not, and nothing in these Terms and Conditions shall act to, exclude or limit SFF s liability for death or personal injury resulting from its negligence or fraud.
14 10. Account Suspension/Closure and Termination 10.1. SFF has the right to suspend or close your account and/or terminate your participation in any Challenge if we have knowledge or a reasonable suspicion that: 10.1.1. You are in breach of these Terms and Conditions; 10.1.2. You are using your account to defraud SFF; 10.1.3. You are involved in any activity which may threaten the integrity of any sporting code; 10.1.4. You are using an account which is not registered in your name and/or you provided SFF with false or inaccurate information as part of the account registration; or 10.1.5. You are using or Service for illegal and/or unlawful or improper purposes. 10.2. In any of the circumstances set out in (10.1) above (inclusive), you agree that SFF may provide the relevant law enforcement authority and/or sports controlling body with any information it has relating to these circumstances, as well as your personal information. 10.3. In addition to our other rights under this clause 10, SFF reserves the right to revise the content of, amend links from, or withdraw access to the Service at any time without notice. 10.4. Your account and/or your ability to participate in all or certain Challenges may be terminated at any time without notice to you. 10.5. Any indemnities given by you and limitations on SFF's liability will survive termination of your use of the Service and/or the closure or suspension of your account. 11. Termination/Suspension of Services 11.1. SFF reserves the right to terminate or suspend any challenge at any time and/or cancel any individual s participation in any challenge at any time in our absolute discretion.
15 12. Governing Law and Dispute Resolution 12.1. Subject to both sub-clauses below, you irrevocably agree that the courts of New South Wales shall have exclusive jurisdiction to settle any dispute which may arise out of, or in connection with, these Terms and Conditions. 12.2. You agree that these Terms and Conditions, the Privacy Policy and the How to Play shall be governed by Australian law. 12.3. You agree that, if you have any complaint or dispute, you will first contact us at: customerservice@sportsfantasyfree.com 13. Miscellaneous 13.1. These General Terms and Conditions, Promotional Terms & Conditions, the Privacy Policy and the How to Play constitute the entire agreement in relation to your use of the Service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and SFF in relation to your use of the Service. 13.2.
