Box 457 Camden, AR 71701 RE: AFIN: 52-00598 Permit Tracking No.: 0487-WG-SW-1 Dear Mr. Reynolds: On, February 28, 2012, Chris Voss, ADEQ Inspector, and I performed a routine compliance inspection of the referenced facility in accordance with the provisions of the Arkansas Water and Air Pollution Control Act and the regulations promulgated thereunder. This inspection revealed the following violations: 1. Free standing oil was observed around Leo Berg Y # 3 SWD well head and at Dan Reynolds # 3 production well. This is a violation of Part I A. 6. of the permit. 2. The system sign at Leo Berg Y # 3 tank battery had the wrong permit number listed. This is a violation of Part II A. 3. B. of the permit. 3. All three tank batteries had low firewall berms. The NOI stated that all berms were to be 3 deep. The firewall berm on the Leo Berg Y # 3 battery had erosion noted on it. This is a violation of Part II A. 4. of the permit. 4. The Leo Berg Y # 3 battery had excessive vegetation (i.e bushes) growing on the firewall berm. This is a violation of Part II A. 5. of the permit. 5. Excessive vegetation was noted on a transmission line into/out of the Leo Berg Y # 3 battery. The permit requires all transmission lines to free of excessive vegetation to allow for inspection. This is a violation of Part II A. 7. of the permit. 6. An overflow pipe was noted from one of the SWD tanks to a pit behind the tank battery. This overflow pipe to the pit must be removed. This is violation of Part I.A6.B of the permit.

This pit had a large overflow pipe in it from one of the SWD tanks. This pit is not permitted on the NOI. The water in the pit was not salt water. Pertaining to Items #3, #4 and #5, we have hired Ramsey Contractors of Smackover, Arkansas, to build up all firewalls to 3' and above, and to remove all excessive vegetation. I hope you received my response on 3/11/2012 notifying you that I had complete item number 1, 2, and 6 and would finish the rest as soon as possible. This letter is to notify you that all ADEQ requirements have been completed. Below are some comments: 1. Pictures number 1 through 5 are of the Leo Berg # 3 SWD Tank Battery. In order for me to number these pictures with Leo Berg name I had to use the number after the name so don't confuse this as well numbers. I hope this is not confusing if so contact me. A.) There is a new sign placed at the Leo Berg #3 well that has the correct well name, permit number, location description and county. Your photo # 3. B.) Your letter appears to adequately address the discrepancies identified during the visit. The Department expects the corrective actions taken will be maintained to ensure consistent compliance with the requirements of the permit. Acceptance of this response by the Department does not preclude any future enforcement action deemed necessary at this site or any other site. The Department will keep the inspection and response on file. If future violations occur that require enforcement action, the Department will consider the inspection and response as required by the Pollution Control and Ecology Commission Regulation No. 7, Civil Penalties.
