JOB DESCRIPTION Director of the agency s enforcement division, reporting to the Executive Director. Highly visible role performing advanced legal work, public education and outreach, and investigations. Work involves investigating, prosecuting and litigating high-level violations of statutory laws. Work also involves interpreting laws, regulations, and rules; preparing legal documents and agency administrative rules; rendering legal advice and counsel; consulting with attorneys; supervising and conducting investigations of statutory violations; supervising and assisting the preparation of enforcement cases for hearings and/or trial; drafting and negotiating settlements; drafting and analyzing bills for legislative consideration; and testifying before legislative committees and responding to legislative members and staff during legislative sessions. Serves as agency spokesperson to the press and public on agency enforcement matters, and provides education and training to individuals and organizations subject to the agency s laws and regulations. Trains, coordinates, and leads the work of others. Works under moderate supervision with latitude for the use of initiative and independent judgment. SPECIFIC JOB FUNCTIONS: Manages, formulates, plans, and organizes activities of all functions of the agency s Enforcement Division in a highly charged political environment. Work includes investigation and litigation in trials and hearings, including hearings subject to the Administrative Procedure Act. Develops, implements, and administers policies, procedures and standards. Manages and directs staff responsible for investigating violations of state laws under the agency s jurisdiction and taking corrective action. Directly reports to Commission members on Commission requested inquiries for investigations. Advises on the interpretation, application, and enforcement of agency laws and regulations. Reviews laws, rules, and regulations affecting agency operations and administration. Approves investigative plans and manages lawyers and support staff to ensure timely and quality investigations. Takes the lead or supervises and guides attorneys and investigators during discussions with outside counsel, in settlement negotiations, and preparing for testimony and hearings. Regularly meets with the Executive Director to provide case progress reports on all open investigations and sworn complaint matters. Regularly meets with agency staff to review progress of investigations, identify risks and issues, answer questions, and provide guidance on future investigative steps. Regularly meets with agency staff to review progress of facial compliance reviews and audits of reports filed with the agency. Provides legal advice to the agency on policy decision making. Provides statements on enforcement matters to the press and public. Provides updates on pertinent legal issues affecting the agency. Prepares and presents training materials to the regulated community and members of the public in seminars and other training events.
Drafts legal documents, bills, administrative rules, and amendments for legislative and Commission consideration. Assists with the development of agency programs and the establishment of agency procedures. Assists in the agency s strategic planning process. Assists in the representation of the agency by the Office of the Attorney General or outside counsel in civil or criminal actions brought by or against the agency. Assists in the referral of matters to the Office of the Attorney General and other law enforcement agencies for enforcement or collection of civil penalties. Assists management with the development of appropriate legal solutions related to the agency s internal business operations. Conducts and participates in special projects as required. May conduct interviews to obtain facts of a case. May attend various meetings on behalf of the agency and its governing body. May represent the agency in cases brought before the State Office of Administrative Hearings and in litigation in state and federal court. May advise agency management on programs and issues involving legal risks. May assist in drafting and negotiating contracts and related documents. May train, coordinate, and lead the work of others. May travel on agency business. Performs related work as assigned. MINIMUM EDUCATION AND EXPERIENCE REQUIREMENTS: Minimum Qualifications: Demonstrated enforcement experience, including experience prosecuting or defending misdemeanor and felony-level crimes, including white-collar crimes. Demonstrated experience prosecuting or defending regulatory enforcement cases before the State Office of Administrative Hearings, the district courts, or the courts of appeals. Demonstrated administrative experience, including experience serving in a supervisory capacity. Demonstrated advanced communications skills, including public speaking experience. Graduation from an accredited law school with an LLB or JD degree. Member in good standing with the State Bar of Texas. Licensed to practice law in Texas for minimum of 5 years. KNOWLEDGE, SKILLS, AND ABILITIES Knowledge of legal principles, practices, and proceedings; of state and federal laws, regulations, and rules; and of agency administrative rules and regulations. Skill in identifying problems and reviewing related information to develop and evaluate options and implement solutions; in using logic and reasoning to identify the strengths and weaknesses of alternative solutions, conclusions, or approaches to problems; and in reconciling differences.
Ability to prepare legal documents; to prepare policies and procedures; to conduct research; to interpret and apply laws; to summarize findings; to prepare cases for trial; to conduct hearings; to communicate effectively; and to train, coordinate, and lead the work of others. Ability to handle multiple assignments and prioritize work to meet strict deadlines. Ability to plan, assign, and/or manage the work of others. Ability to devise solutions to administrative problems. Ability to develop and evaluate administrative policies and procedures. REGISTRATION, CERTIFICATION, OR LICENSURE Must be licensed as an attorney by the State of Texas.
