False Self-Employment and Illegal Use of Temporary Workers IT-based solution for fast and convenient assessment of individual cases

Risks involved in the use of external personnel not to be underestimated The use of external personnel is coming under increasing scrutiny by the social security agencies, with investigations by the relevant authorities including customs officials now more and more common. Legally incorrect use of external personnel exposes the employer to two risks that should not be underestimated. Firstly, the company may face substantial additional costs and large fines. Secondly, there is the risk of personal liability on the part of the responsible individuals, including criminal liability due to evasion of social security contributions. Media reporting on investigations by public prosecutors or customs authorities also typically results in considerable reputational damage for the company concerned. Online check on status of external personnel CMS has developed the online product FPE (Fremdpersonal einsatz = use of external personnel), a tool that allows businesses to avoid unintentional false self-employment and bogus contracts for work / services. It will enable your company to reliably assess the use of external personnel within a matter of minutes. FPE is based on the knowledge and experience gained by CMS in many thousands of real-life situations previously assessed by hand. Each employee authorised by the company can access FPE from anywhere and at any time. Substantial cost and time savings are possible compared with manual assessment by internal or external staff.

How does FPE work? Using Internet access and a password, you can log on to the FPE website and conduct the assessment. The questions require a simple Yes or No answer, with the number of questions and their content adapting to input during the assessment process. Rather than working your way through a standard list of questions, each assessment is thus tailored to the specific case. Your input is evaluated arithmetically on the basis of a dynamic flowchart and sophisticated weighting logic. No specialist legal knowledge is needed to answer the questions, thereby enabling the assessment to be performed within the individual departments. Users are presented with the result immediately, based on a traffic light system, together with a specific explanation. If the assessment outcome is green, for example, the task can be performed under a contract for work or services. If the result is red, either the circumstances under which external personnel are used must be changed significantly or a genuine temporary employment contract must be concluded, for example.
