PLEDGE TO THE FLAG Chairman Dave Burns led the pledge. IV. AGENDA APPROVAL Chairman Dave Burns asked if there were any changes to the agenda. Mr. RC Barenchik stated that item#4 Staffordshire should state zoning from PD to PD. Board Member Peter Higgins made a motion to approve the agenda with the corrected changes. Board Member Juanita Golden seconded the motion. The motion carried by unanimously. V. APPROVAL OF MINUTES Chairman Dave Burns asked if there were any corrections or additions to the February 27, 2017 meeting minutes. Board Member Alan Zipperer made a motion to approve the minutes as read. Board Member Juanita Golden seconded the motion. The motion carried by unanimously. NEW BUSINESS James Hagars, Mr. Charles Dobbins, Ms. Cheryl Knight, Mr. Oscar, Ms. Charity Daniels, Ms. Shannon Slaughter, Mr. Charles Futch, Ms. Sandra Jones, Mr. Read Brennan, Mr. Brian Horton, Mr. Dan Kennedy, Mr. Ryan Franz, Mr. Shawn Scott, Ms. Shirley Roberson, Ms. Maria Wallace, Mr. Junice Carter, Ms. Pauline Harden, Ms. Irma Davis Chairman Dave Burns stated all items voted on would be presented at the April 18, 2017 Board of Commissioners meeting as a public hearing (with the exception of residential business and pond requests) Coastal Empire Enterprises, LLC PUBLIC HEARING (1): The applicant requests to rezone.79 acres for [Map# 378B Parcel# 2] located at 3221 US Hwy 80 East from AR-1 to B-3 to allow for office space and to include equipment parking, no retail traffic. (First District) Mr. Mark Jacobs is doing business as Mr. Rooter Plumbing and they have been running their business out of their home and it is time to expand. They are looking for somewhere for some office space and equipment parking. There will not be any retail traffic, and all of the technicians drive their vehicles home every night and will only come to the office to drop off paperwork and pick up inventory. There is an existing driveway on Pineview Drive that they are hoping to use to gain access to the property. They plan to use a solid fence around the property to shield the equipment storage. There are other commercial businesses in the area, Omega Steel, a car dealership, a gas station and a flooring center. Mr. Richard Hagney who resides in the Thompson Subdivision is concerned about the traffic, stating between the hours of 7 and 9 am it is difficult to leave out of the subdivision. Mr. Mark Slaughter said that with the traffic on Hwy 80 there would be no physical way to back a trailer onto the property without causing traffic to back up. He also stated that he is concerned about his property values going down with a commercial business being in the front of his subdivision. Mr. Alton Jones is another resident from the Thompson Subdivision said that the traffic on Hwy 80 has sometimes backed up to Jimmy DeLoach Parkway, there is only one way in and out of the subdivision. Ms. Beverly Hodges is against having a business in the front of the subdivision, and believes there are covenants to the subdivision, also concerned with the traffic. Ms. Emily Davidson is against the property being rezoned to commercial. Mr. Mark Hines stated that the traffic and a backing a trailer into the property will just cause for more traffic problems. What about signage? A sign with a phone number will cause people to pull over and come to the property which is considered customer traffic. Ms. Colleen Lane asked about the business hours and sign lighting. If there is going to be a business there the access to the property should be from Hwy 80 and not - 2 -
through the subdivision on Pineview Drive. Mr. Charles Dobbins is a resident of Thompson subdivision whose property is on Hwy 80, he is concerned about the traffic and the wood fence that is proposed if the rezoning is granted. A wood fence will become an eye sore overtime without proper maintenance and from weathering. Mr. James Higgins is concerned about the traffic and stated that not one person who is a resident of the neighborhood wants the property to be rezoned to commercial. Ms. Cheryl Knight is not a residing neighbor but does come to the neighborhood frequently and stated that there is only one way in and out of the neighborhood and between certain times of the day it is almost impossible to exit the neighborhood on to Hwy 80. Mr. Oscar stated about the traffic and said that there is plenty more commercial property that they can run a place of business. Ms. Charity Daniels is the realtor that has been helping the Jacobs search for commercial property and as a realtor she is to search and find property that has the highest and best use for their business. Ms. Shannon Slaughter is a resident in Thompson Subdivision and a former employee of DOT, she stated that it is unlikely that DOT will grant a driveway from Hwy 80 because the property doesn t have enough road frontage from Pineview Drive. She is also concerned about there being children in the neighborhood. Board member Jamey Stancell stated that his opinion is that Hwy 80 should be commercial area but the access for the property is through the subdivision, and he feels like the access should be on Hwy 80. Mr. Jacobs stated that the only vehicles coming to the property would be the service vans that the technicians drive home with them every night and the vans pull a seven foot trailer behind them and a utility truck. They would not be backing any of the vehicles into the property. Ms. Sandra Jones stated that with a B-3 zoning that if the business did dissolve within the next six months or so what would the next business be that occupied the property? She is against the rezoning of the property. Mrs. Juanita Golden made a motion to deny the request. The motion was seconded by Mr. Peter Higgins. The motion was carried by all. Chairman Dave Burns called for a five minute break at 7:06 pm. At 7:11 pm the meeting was called back to order. Phillip Page, Sr. PUBLIC HEARING (2): The applicant requests to rezone 1.59 acres for [Map# 373 Parcel# 7] located on Blue Jay Road from B-2 to AR-1. (Second District) No one was present for or against the item presented. Mr. RC Barenchik stated that Mr. Page wanted to recombine the property with adjacent property. Mr. Alan Zipperer made a motion to approve the request with the following stipulations: 1. Lot meets the requirements of the AR-1 zoning district. - 3 -
2. Site development plans comply with the Effingham County Water Resources Protection Ordinance and the Stormwater Management Local Design Manual. 3. All wetland impacts permitted by USACE. 4. Recombination plat must be approved by the Zoning office. The motion was seconded by Mr. Peter Higgins. The motion was carried by all. Irma Davis PUBLIC HEARING (3): The applicant requests to rezone 4.51 acres for [Map# 395C Parcel# 1, 2, 31, 32, 33 & 34] located on Herbert Kessler Road from R-1 to AR-1 to recombine with adjourning 158 acres. (Second District) Ms. Irma Davis stated that she wants to recombine the property with other existing property. Mr. Alan Zipperer made a motion to approve the request. The motion was seconded by Mr. Peter Higgins. The motion carried unanimously. Read Brennan PUBLIC HEARING (4): The applicant requests to rezone 56.91 acres for [Map# 415 Parcel# 10] located on Blue Jay Road for Staffordshire Estates from PD to PD to amend the text document. (Second District) Mr. Read Brennan stated that they wanted to amend the text document to increase the number of lots from 155 to 184. The last two phases of Staffordshire Estates were intended for larger lot sizes and would like to change them to the same size lots that are in the other current existing phases. Mr. Brian Horton is a homeowner in Staffordshire Estates, he doesn t have any issues with the changes but he is concerned with the drainage issues currently and would like for that to be taken into consideration. Mr. Brennan and the county engineers as well as the county administrator are aware of the drainage issues in Staffordshire Estates and are working towards a solution. Mr. Dan Kennedy a resident of Staffordshire Estates asked for clarification if the changes were for multi-family or just single-family homes. Mr. Ryan Franz stated that the drainage issues be addressed for the flooding. Mr. Alan Zipperer motioned to approve the request. seconded the motion. The motion carried unanimously. Mrs. Juanita Golden Shirley Roberson PUBLIC HEARING (5): The applicant requests to rezone 4 acres for [Map# 381 Parcel# 23 & 23A] located at 179 Hurley Smart Road from AR-1 to AR-2. (Third District) Mrs. Shirley Roberson stated that they want to subdivide from family property. Mr. Jamey Stancell motioned to approve the request with the following stipulations; - 4 -
1. Lot meets the requirements of the AR-2 zoning district. 2. Site development plans comply with the Effingham County Water Resources Protection Ordinance and the Stormwater Management Local Design Manual. 3. All wetland impacts permitted by USACE. 4. Subdivision plat must be approved by the Health Department and the Zoning office. Mr. Alan Zipperer seconded the motion. The motion carried unanimously. Shawn Scott PUBLIC HEARING (6): The applicant requests a residential business for [Map# 349A Parcel# 59] located at 233 Wild Rose Road to allow to prep kitchen to obtain food service permit for a food truck, zoned R-1. (Fourth District) Mr. Shawn Scott stated that Environmental Health is requiring him to have a commissary kitchen area in the home to prepare the food before loading the food to sell. Mr. Jamey Stancell motioned to approve the request with the following stipulations; 1. Follow the requirements of Section 3.15A- Residential Businesses Mr. Peter Higgins seconded the motion. The motion carried unanimously. Maria Wallace PUBLIC HEARING (7): The applicant requests to rezone 1.04 acres for [Map# 367A Parcel# 43] located 640 Third Street from AR-1 to AR- 2. (Fourth District) Ms. Maria Wallace would like to rezone the property to be able to allow for two mobile homes on the property for immediate family. Mrs. Pauline Harvey owns property around here and stated that she is fine with Ms. Wallace putting two homes on the property. Mr. Jamey Stancell motioned to approve the request with the following stipulations; 1. Lot meets the requirements of the AR-2 zoning district. 2. Site development plans comply with the Effingham County Water Resources Protection Ordinance and the Stormwater Management Local Design Manual. 3. All wetland impacts permitted by USACE. 4.
