Cheese Rolling Contest Contest Rules 1. The Cheese Rolling Contest (the Contest ) is held by Dairy Farmers of Canada (the Contest Organizer ). The Contest will run and will be advertised in approximately 30 MarketPlace IGA stores in British Columbia (the Participating Stores ) from 7:00 a.m. (PT) on July 20, 2008, to 11:59 p.m. (PT) on August 9, 2008 (the Contest Period ). ELIGIBILITY 2. The Contest is open to persons residing in British Columbia. Employees, agents and representatives of the Contest Organizer, its affiliates, their advertising and promotional agencies, Participating Stores, suppliers of prizes, materials or services related to this Contest, as well as members of their immediate family (brothers, sisters, children, father, mother), legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled, are not eligible. HOW TO ENTER 3. No purchase necessary. To enter, complete an entry form available on the ballot box in participating MarketPlace IGA stores by legibly writing your complete name and address (including the city, province and postal code), your home phone number (including the area code) and age, as well as the correct answer to the mathematical skill-testing question. Then, put your entry form in the ballot box located in-store no later than August 9, 2008 before closing time. 4. Limit. Entrants must respect the following limits, otherwise they may be disqualified. There is a limit of one entry per person for the Contest Period. PRIZES Secondary prizes 5. In each participating MarketPlace IGA store, a fifty dollar value ($50.00) cheese hamper will be offered to one customer from a random draw, for a total of approximately 30 cheese hampers. Grand prizes 6. Three (3) grand prizes are offered: each of them consists of a family getaway for 4 people to Whistler, British Colombia, of an approximate value of $1,600. The prize includes: a) 2-night accommodation, quadruple occupancy (in a standard condominium) in a 4 stars hotel-condominium in Whistler, at the contest organizer s choice; b) One thousand dollars ($1,000.00) for personal expenses remitted by cheque.
The following restrictions apply to each getaway: DRAW a) All expenses other than those specifically mentioned above shall be assumed by the winner and his/her guests, namely, roundtrip transportation fees from the place of residence to Whistler and transportation in Whistler, personal insurance, non-included taxes and gratuities, meals and beverages, Internet access charge, mini-bar charges, room service, local and long distance telephone calls, personal expenses or travel documents fees, is required; b) Subject to availability, the getaway must be taken before April 30, 2009, except for the following periods: from December 21, 2008 to January 11, 2009, from February 13, 2009 to February 20, 2009 and from April 4, 2009 to April 13, 2009, otherwise it will be null and void; c) Reservations related to the getaway are required to be made by the winner with the Contest Organizer within the prescribed deadline set by the Contest Organizer. The winner must provide the Contest Organizer with the name and personal coordinates of the persons accompanying him/her. Once the arrangements are completed, no modifications will be accepted ; d) If any part of the getaway is not used, no compensation will be awarded to the winner or to the persons who accompany him/her. 7. For each Participating Store, a random draw of one eligible entry form out of all entry forms received in this store during the Contest Period will be held on August 11, 12 or 13, 2008, in store and by the store manager, to award the cheese hamper described in these Contest rules. The winners of the cheese hampers will also be permitted to participate in the three (3) grand prizes draw. 8. A random draw of three (3) eligible entry forms out of all entry forms received during the Contest Period in all Participating Stores will be held between August 14 and 20th, 2008, at 11:00 a.m. (ET) at Attitude Marketing s offices located in St-Lambert, Quebec, to award the three (3) grand prizes described in these Contest rules. 9. Odds of winning. The odds of an entrant s entry form being selected for one of the grand prizes depend on the number of entry forms received in all Participating Stores during the Contest Period. The odds of an entrant s entry form being selected for one of the cheese hampers depend on the number of entry forms received during the Contest Period in the Participating Store where the entrant entered the contest. AWARDING OF THE PRIZES 10. To be declared a winner, the entrant whose entry form has been randomly drawn for one of the secondary prizes must: a) Be reached by telephone by the store manager within fourteen (14) days of the draw;
b) Have correctly answered the mathematical skill-testing question on the entry form; c) Claim his/her prize at the store where he/she entered, within fourteen (14) days following the store manager s phone call mentioned above (section 10 a)). 11. To be declared a winner, the entrant whose entry form has been randomly drawn for one of the grand prizes must: a) Be reached by telephone by the Contest Organizer within fourteen (14) days of the draw; b) Have correctly answered the mathematical skill-testing question on the entry form or over the phone by the Contest Organizer in the case of a person who has already won a secondary prize; c) Sign the Declaration and liability waiver form ( Declaration Form ) that the Contest Organizer will provide him/her by fax, e-mail or mail and return it by mail to the Contest Organizer within seven (7) days of its receipt; d) Provide an identification card, upon request and in a timely manner. 12. Within four (4) weeks following the receipt of the duly signed Declaration Form, the Contest Organizer will send a letter to the grand prize winners informing them on how to take possession of their prize. 13. Failure to comply with any one of the conditions above or any other condition in these Contest rules or refusal of the prize will cause the selected entrant to be automatically disqualified and forfeit the prize. In such a case, the Contest Organizer will hold a new random draw to award the prize according to these Contest rules until an entrant is selected and declared a winner, except in the case where a secondary prize winner fails to claim his/her prize, the prize will be cancelled. GENERAL CONDITIONS 14. Entry forms and Declaration Forms are subject to verification by the Contest Organizer. Any entry form or Declaration Form which is, as the case may be, incomplete, illegible, fraudulent, submitted late, not bearing the correct answer to the mathematical skill-testing question or otherwise noncompliant shall be rejected and will not entitle the entrant to be registered in the Contest or to win a prize. 15. The Contest Organizer reserves the right to disqualify an entrant or to cancel one or several entries by an entrant who participates or tries to participate in this Contest by using methods that do not comply with these Contest rules or that are unfair to the other entrants. Such an entrant may be reported to the appropriate legal authorities.
16. The prizes must be accepted as described in these Contest rules and may not be transferred to another person, replaced by another prize or exchanged in whole or in part for cash, with the exception of the personal expenses included in the grand prizes and except as provided in the section below. 17. In the event that it is impossible, difficult and/or more costly for the Contest Organizer to award a prize (or a portion thereof) as described in these Contest rules, the Contest Organizer reserves the right to replace a prize (or portion thereof) with one of the same kind and of equivalent value or, at its sole discretion, with the cash value of the prize (or portion thereof) as indicated in the Contest rules. 18. Each entrant selected for a prize releases and holds harmless the Contest Organizer, its affiliates, their advertising and promotional agencies, Participating Stores, their employees, agents and representatives from and against any damage resulting from the acceptance or use of the prize. To be declared a winner, and prior to obtaining his/her prize, each entrant selected to win a grand prize (and parent or legal guardian in the case of a minor) must sign a statement to this effect on the Declaration Form. Moreover, the guests and the parent or legal guardian of these guests (if the person is a minor), must also sign the Declaration Form, otherwise the guests will not be able to take part in the getaway. 19. Each person selected for a grand prize acknowledges that from the moment the reservations are made, the fulfillment of prize-related obligations becomes the full and sole responsibility of the various service suppliers. A statement to such effect will be included in the Declaration Form. 20. The Contest Organizer reserves the right, at its sole discretion, to cancel, modify or suspend this Contest in whole or in part, or to terminate it, should human intervention or an event take place that could modify or affect the administration, security, impartiality or conducting of the Contest as provided in these Contest rules. 21. In the event that participation in the Contest must be terminated in whole or in part before the ending date of the Contest as provided in the Contest rules, the Contest Organizer will proceed with the draw among the entry forms received up to the date of the event terminating participation in the Contest. 22. In no event shall the Contest Organizer, its affiliates, their advertising and promotional agencies, the suppliers of prizes, materials or services related to this Contest be required to award more prizes than indicated in these Contest rules or to award a prize otherwise than in accordance with these Contest rules. 23. Persons who enter or try to enter this Contest release the Contest Organizer, its affiliates, their advertising and promotional agencies, Participating Stores and their employees, agents and representatives from any liability for damage these said persons may incur as a result of their participation or their attempt to participate in the Contest. 24. Each selected entrant authorizes the Contest Organizer and its representatives to use, if required, its name, photo, likeness, statement regarding the prize, place of residence and/or voice for publicity purposes, without additional compensation. A statement to such effect will be included in the Declaration Form.
25. Any decision by the Contest Organizer or its representatives regarding this Contest is final and without appeal. 26. For the purposes of these Contest rules, the entrant is the person whose personal information appears on the entry form. It is to this person to whom the prize will be awarded if he/she is selected and declared a winner, except as provided in the section below. 27. In the case of a minor, the prize will be awarded to his/her parent or legal guardian on his/her behalf. 28. All entry forms received at Participating Stores are the property of the Contest Organizer and will not be returned to entrants. No communication or correspondence related to this Contest shall be exchanged with entrants except as provided for in the present Contest rules or at the Contest Organizer s initiative. 29. Entrants personal information collected for the purposes of the Contest will be used only to administer the Contest. No commercial or other communications unrelated to the Contest will be sent to entrants, unless they have otherwise agreed to receive such communications. 30. If a section of the Contest rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law. 31. Any attempt to deliberately sabotage the legitimate course of this Contest constitutes a violation of civil and criminal laws. Should there be any threats of violations, the Contest Organizer reserves the right to reject the entrant s registrations and obtain legal or equitable relief under the applicable laws.
