Minutes of the 30 th SEIAA Meeting held on 9 th March, 2010 The 30 th meeting of the State Level Environment Impact Assessment Authority was convened on 9 th March, 2010 at 11.30 A M at the Authority's office in M.P. Pollution Control Building, Paryavaran Parisar, Bhopal chaired by Shri Subroto Banerji, Chairman SEIAA. The following members attended the meeting: 1. Shri M. Hashim, Member 2. Smt. Shri Ganesh Acid Chemical (P) Ltd, Ward No 1, Mishra Nagar, Waraseoni, Distt Balaghat M.P., Borikheda manganese deposit, 5.977 hact. at village Borikehda, Teh Katangi, Distt Balaghat M.P, Case no. 271/2009. while scrutinizing the documents submitted by the project proponent observed that a photocopy of the Forest NOC has been submitted. It was decided to write to DFO directly to obtain fresh Forest Deptt. NOC as per the format decided in the 27 th SEIAA meeting. 2. Trilokinath Agrawal, Civil line Katnai M.P., Limestone mine 32.48 ha. at Nanawrakala, Teh Vijayrajghogarh, Katni M.P. Case no. 145/2008. original Forest Deptt. NOC has been submitted stating the distance of mining lease area from the forest boundary. But in the NOC the distance from the protected areas under Wildlife Protection Act, 1972 has not been mentioned. Hence it was decided to write to DFO requesting him to specify the distance of mining lease area from the protected areas under Wildlife Protection Act, 1972 Page no 1 of 7

3. Shri Raj Kishore Agarwal, C/o Ganesh Motors, Jabalpur Road, Katni M.P., Limestone and dolomite mines 18.09 ha. village Nanhwara, Teh Vijraojarh, Katni M.P. Case no. 72/2008. original Forest Deptt. NOC has been submitted stating the distance of mining lease area from the forest boundary. But in the NOC the distance from the protected areas under Wildlife Protection Act, 1972 has not been mentioned. Hence it was decided to write to DFO requesting him to specify the distance of mining lease area from the protected areas under Wildlife Protection Act, 1972. 4. M/s Narayan Metals and Minerals, Shop No.3, Bengali Club Market, Karamchand Chowk, abalpur M.P., Manganese ore blue dust laterite minerals 2900 TPA area 12.77 ha. at village Gosalpur Teh Sihora, Jabalpur M.P. Case no. 416/2009. Forest Deptt. NOC does not specify the distance of mining lease area from the forest boundary and from the protected area under Wildlife Protection Act, 1972. Same has not been submitted in original/attested copy. It was decided to writ to DFO requesting him to send a fresh NOC as per the format decided in the 27 th SEIAA meeting. An objection/suggestion by Nagrik Adhikar Association has been received. The Authority decided to write to SEAC asking about the objection/suggestion. 5. M/s Aruna Dolomite mines civil line, Tilak ward, Mandla M.P., Dolomite mine 6.60 ha. village Bhawartal Teh., Bichhiya, Distt. Mandla M.P. Case no. 48/2008. while scrutinizing the documents submitted by the project proponent observed that a photocopy of the Forest Deptt. NOC specifying only the distance from Kanha National Park has been submitted. Page no 2 of 7

It was decided that a fresh Forest Deptt. NOC may be obtained from DFO in the standard format, specifying the distance of mining lease area (a) from the forest boundary, (b) from the protected area under Wildlife Protection Act, 1972, (c) from the buffer zone of Kanha National Park and (d) from the State boundary. 6. Shri Marutaya Balaji Steels Pvt Ltd, 5, Bentinck street Kolkata, West Bengal, Limestone mine 18.935 hect. production capacity 1,00,000 TPA at Village Hadbadpur, Taluka Raghuraj Nagar, Distt Satna M.P. Case no. 291/2009 attested photocopy of the Forest Deptt. NOC specifying the distance of mining lease area from the forest boundary has been received and another NOC in original specifying the distance from protected area has been received. But part of this NOC is hand written. Hence the Authority decided to write to DFO requesting him to send an original NOC as per format decided in the 27 th SEIAA meeting. 7. The Maihar Stone & Lime Co. P Ltd, Station Road Maihar, Satna M.P., Lime stone & Dolomite nube 6.062 hact. At Bhatoora, Teh Maihar, Satna M.P. Case no. 221/2008. attested copy of a Forest Deptt. NOC specifying the distance of mining leas area from the forest boundary has been submitted. However it does not specify the distance from the protected area under Wildlife Protection Act, 1972. Hence it was decided to obtain a fresh original NOC from DFO as per the format decided in the 27 th SEIAA meeting. Page no 3 of 7

M/s Kunjilal Iswari Prasad, Agarwal P O, Jaitwara, Satna M.P., Bauxite Ochre, white earth and laterite mine 45.892 ha. 75000 PA, Village Koldiha No.2, Teh New Ramnagar, Satna M.P, Case no. 274/2009. while scrutinizing the documents submitted by the project proponent observed that a copy of the Forest Deptt.NOC has been submitted which contains some hand written text. Hence it was decided to get an original Forest Deptt. NOC from DFO in the format decided in the 27 th SEIAA meeting. 9. Ranjan Grover, Civil Line, Katni M.P., Lime stone and Dolomite mine 19.360 ha. at Village Ametha Teh Vijay Raghavgarh, Katni M.P. Case no. 57/2008. original Forest Deptt. NOC has been submitted specifying the distance of mining lease area from the forest boundary. However it does not specify the distance of mining lease area from the protected areas under Wildlife Protection Act, 1972. Hence it was decided to ask for a fresh NOC from DFO specifying the distance of mining lease area from the protected areas under Wildlife Protection Act, 1972. 10. Hukumchand stone lime Co. Nai Basti, Katni M.P. Lime stone mine 10.56 ha. At Village Bhatonra, Teh Maihar, Sata M.P., Case no. 253/2008. Forest Deptt. NOC submitted by the project proponent specifies that the mining area is located at a distance of 190 m from the forest boundary. The proponent has not submitting a fresh Forest Deptt. NOC issued by the competent Authority in such type of cases. Hence the Authority decided to reject the above case. Page no 4 of 7

11. M/s Ramasthan, Shri Shravan Kumar Pathak, Chayanakyapuri, Satna M.P., Limestone mine 32.374 hect. At village Ramasthan, Taluka Raghuraj Nagar, Stana M.P, Case no. 289/2009. part of the Forest Deptt. NOC is hand written. Hence it was decided to obtain a fresh Forest Deptt. NOC directly from the DFO in the format decided in the 27 th meeting of SEIAA. 12. M/s Parsvnath Developers Ltd, New Delhi, Residential Township "Parsvnath City" phase I at village Raukhedi Teh. Sanwer, Distt. Indore, Case no. 44/2008.. while scrutinizing the documents submitted by the project proponent observed that CGWA has given NOC to extract only 134 KLD of ground water only, while no other firm commitment letter of the Commissioner Municipal Corporation, Indore has been submitted by the project proponent. Similarly the proponent has not submitted the attested copy of Revenue Records (Rin Pustika), showing the ownership of land in the revenue record in his name. The above project is proposed in Indore district. As per the office memorandum no J 11013/5/2010 IA II (I) dt 13/01/2010 the project proposed at Indore should be kept pending till August, 2010. Although the Authority has already sought a clarification from the Ministry about the memorandum. Same has not been received yet. Hence it was decided to keep the case pending till a clarification from the Ministry is received. A reminder letter may be written to the Ministry as a follow up action. Page no 5 of 7

Satguru Cement Pvt Ltd, 102, Golden Tower 94/47, Sneh Nagar, Main Road, Indore M.P., Mini cement plant 30,000 TPA to 95,000 TPA at village Ghursal, Jeerabad, Teh Gandwani, Distt Dhar M.P., Case no. 248/2008. project proponent has proposed to use ground water for manufacturing process. But not submitted any CGWA, NOC for the same. Project proponent may be asked to submit a detailed water requirement (including water for additional proposed production), its source and the permission from CGWA to draw ground water. Hence it was decided to send the case back to SEAC for reconsideration on the above ground. (B) Other cases 1. M/s Smt Vandana Modi, W/o Shri Abhay Modi, Bara Bazar, Shahgarh, Teh Banda Sagar M.P., Iron ore & dolomite mines 11.82 ha. at Tigoda, Banda Sagar M.P. Case no. 236/2008 It was decided in the 28 th SEIAA meeting that a fresh NOC from DFO, Sagar may be obtained. Same has been received from the DFO. The Authority observed that it is as per the standard format and hence decided to accord the prior environmental clearance to the above project. 2. M/s Bhanu Prakash Power Projects Pvt Ltd Hydrabad, 10 mw Biomass based power plant 15 H village Majhguan, Teh Garhakota, Sagar M.P. Case no. 35/2008 It was decided in the 28 th SEIAA that the project proponent should be asked to furnish a declaration regarding the type and quantum of auxiliary fuel proposed to be used in the above project. Project proponent submitted a reply stating that it is proposed to use C/D grade coal as auxiliary fuel limited to 15% of the total fuel and such projects are exempted from prior environmental clearance as per EIA notification amendment issued on S.O 3067 (E) dt 1/12/2009. Hence the Authority decided to allow the project proponent to withdraw his proposal. Meeting ended with a vote of thanks to the chair. Page no 7 of 7
