Resolution 2015-02a CANNON RIDGE HOMES ASSOCIATION ARCHITECTURAL STANDARDS AND GUIDELINES ADOPTION OF ARCHITECTURAL CONTROL COMMITTEE; RULES RELATED TO EXTERIOR STEPS, HANDRAILS, SHUTTERS, HOUSE NUMBERS, TRASH AND RECYCLE CART SCREENS, ACCESSORY BUILDING, PET FOOD CONTAINERS, AND OPEN BURNING WHEREAS, Section 55-513 of the Virginia Property Owners Association Act (hereinafter referred to as Act), Article IV of the Articles of Incorporation and Article VI, Section 1, of the By-Laws (hereinafter referred to as By-Laws) of the Cannon Ridge Homes Association, Inc. (hereinafter referred to as Association) empowers the Board of Directors (hereinafter referred to as Board) to set policies for the Association and to adopt Rules and Regulations (hereinafter referred to as Resolutions) governing the use of the common area and facilities, and the personal conduct of members and their guests; and WHEREAS, Article IV of the Articles of Incorporation, Article VI of the By-Laws, and Article VIII, Section 1, of the Declaration of Covenants, Conditions And Restrictions (hereinafter referred to as Declaration) of the Association empowers the Directors to enforce all Covenants, Conditions and Restrictions of the Declaration and to establish, adopt and enforce Resolutions governing the use of the common area and facilities, and the personal conduct of members and their guests; and WHEREAS, Section 55-513 of the Act, Article VI, Section 1 of the By-Laws, and Article II, Section 1, of the Declaration provide the Board with the power to suspend use rights and assess charges against lot owners for violations of the Association Instruments and Resolutions for which the lot owner and family members, those entitled to occupy a lot, guests and other invitees are responsible; and WHEREAS, Section 55-515 of the Act requires that all lot owners, all those entitled to occupy a lot, all guests and invitees shall comply with all lawful provisions of the Act, all provisions of the Declaration, and Resolutions of the Association; and WHEREAS, Article VIII of the By-Laws provides that an Architectural Control Committee shall be appointed and shall operate in accordance with the terms of the Resolution of the Board designating the Committee and with rules adopted by the Board; WHEREAS, Article V of the Declaration of Covenants, Conditions, Conditions and Restrictions for the Cannon Ridge Homes Association (hereinafter referred to as Declaration ) provides that no exterior change or alternation to buildings, fences, walls, or other structures on the properties within the Association shall be made until the plans and specifications showing the nature, kind, shape, height, materials, and location of the same shall have been submitted to and approved in writing as to harmony of external design and location in relation to surrounding structures and topography and/or comparability with existing structures, by the Board or by an Architectural Control Committee composed of three (3) or more representatives appointed by the Board: WHEREAS, the Board has established architectural standards and guidelines in order to (1) assist homeowners in preparing an acceptable application to the Architectural Control

Committee, (2) increase homeowner s awareness of and understanding of the requirements set forth in the Covenants, Rules and Regulations, and Resolutions, (3) provide basic design principles and concepts in order to aid homeowners in developing exterior improvements which will be compatible and comparable with those of other homes and the immediate neighborhood and community as a whole, and (4) provide uniform minimum standards to be used by the Architectural Control Committee in reviewing applications; and WHEREAS, the Board recognized a need to formally designate an Architectural Control Committee and to appoint members thereto, and to implement uniform standards and guidelines related to the colors of exterior paint and stain. NOW, THEREFORE, BE IT HEREBY RESOLVED THAT The Board adopts the following Rules and Regulations: 1. The following addition shall be made to the Cannon Ridge Homes Association architectural review: Exterior Steps 1. Exterior steps leading into a unit shall not exceed eight (8) inches in height for each riser. 2. A maximum of three (3) risers is allowable without handrails. Four (4) or more risers require handrails. 3. Exterior steps leading into the front of a unit must be cast concrete only. Wood, metal, masonry or other material is prohibited. 4. Concrete steps may not be painted in any color. Concrete walks adjacent to exterior steps may not be painted in any color. Handrails To provide added safety to steps due to ice, slippery conditions, or reduced visibility, and to provide assistance to the elderly, physically disabled, and children, it is recommended that unit owners install handrails regardless of the number of steps. 1. Handrails must be configured so that fire hoses may not become entangled in the railing. A closed return or straight end is preferred.

Shutters 1. Shutters within Cannon Ridge shall be limited to two types: louvered or raised panel. a. b. Example of a. Louvered shutter and b. Raised Panel shutter (not to scale) 2. No other type of shutter or combination of styles of shutter shall be permitted. House Numbers To aid firefighters, police, rescue, and other emergency personnel to respond to critical situations, it is recommended that each unit owner install a street number on the rear of the unit within twenty-four (24) inches/two (2) feet of a sufficient light source; of a contrasting color to its background; material of metal or plastic, but not comprised of stick on numerals; at least three (3) inches in height; and with an unobstructed line of sight.

Trash and Recycle Cart Screens 1. In 2014, the City of Manassas issued one each 64-gallon waste and optional 64-gallon recycle carts to each townhouse unit in the city and prohibited disposing of trash in unsecured bags at curbside. Cannon Ridge governing documents require unit owners to store all trash or recycling carts, bins, or cans in the rear of the unit. Qualifying units do not allow access to the rear for these carts. 2 Trash and recycling carts or cans may be stored on the front or side of a unit only if all the following conditions are met. a. Access to the rear yard is not physically possible due to the geographical features in proximity to the entrance. b. A screen composed of clear or pigmented stained wood, or of a synthetic material such as resin designed specifically for outdoor application, for example the Suncast Model BMPF4836D or equivalent, and each panel measuring not less than forty-eight (48) inches/four (4) feet in height and thirty-six and one-quarter (36 1/4 inches)/three (3) feet one-quarter (1/4) inches in width for each cart to conceal two (2) views. c. Such screens to be maintained in accordance with the same requirements for fences and decks and limited to the same colors, i.e. stained with the clear pigmented stain and the only colors of stain that will be allowed shall be Behr Cedar Naturaltone #DP-533 or Behr Antique Brass #DP-374 or colors that have been approved by the Association as equivalent to one of those two (2) colors. c. Prefabricated synthetic panels, if paintable, may be painted white or match the unit color or trim upon approval. d. Trash or recycling cart screens must be staked into the ground. Trash or recycling carts, bins, or cans may not be stored on front or side porches, decks, balconies, or stoops. a. b. Accessory Building 1. No accessory building or shed shall be placed in a unit backyard that exceeds four (4) feet/ forty-eight (48) inches in height, three (3) feet/thirty-six (36) inches in depth, and four (4) feet/forty-eight (48) inches in width or equal to forty-eight cubic feet (48 cu ft) without an approved architectural application. 2. No accessory building or shed shall be placed in unit backyards that exceeds 8x4 by 8 feet in height at its peak or equal to two hundred fifty-six cubic feet (256 cu ft), equal to original builder construction. An architectural application must be submitted for approval and Manassas City building permit obtained for building or shed between forty-eight (48) cubic feet and two hundred fifty-six (256) cubic feet. 3. No accessory building or shed shall be placed in unit side or front yards. 4. Accessory building or shed must be constructed of appropriate materials, may not be permanent structures or contain electrical or plumbing, and may be stained or painted with an approved stain or paint from the list of accepted colors. 5. No combination of accessory building or shed may exceed a total of two hundred fifty-six (256) cubic feet per unit. Pet Food and Water Containers 1. Pet food in open containers such as but not limited to automatic feeders or bowls attract insects and vermin. Standing water in open containers provides breeding opportunities for insects and mosquitos. 2. Pet food and water in open containers are prohibited in the front, sides, or rear of any unit. Open Burning

1. Open burning containers such as but not limited to metal cans, fire pits, fire bowls, fire columns, fire domes, fire tables, chimeneas, torches, open patio heaters, fireplaces, to include cooking grills or barbeques, on balconies or decks, or within one hundred eighty (180) inches/fifteen (15) feet of another structure is strictly prohibited. 2. Only fire tables with manually regulated propane flame used for decorative light as for instance in lieu of a candle and not to be used for heating or cooking will be considered for exclusion and shall be restricted to a flame height of not more than three (3) inches or within one hundred eighty (180) inches/fifteen (15) feet of another structure is strictly prohibited. Damage to Association Property All damage to Association property or grounds must be repaired as it occurs. If not repaired within twenty-four (24) hours of the homeowner receiving notice, the Association will complete the repair and assess the charge against the homeowner at the time the homeowner was notified of the damage. EFFECTIVE DATE This Resolution shall become effective on September 8, 2016.
