INTRODUCTION The (Port) obtained coverage as a Secondary Permittee under the Western Washington Phase II Municipal Stormwater Permit (Municipal Permit) on February 16, 2007. The Municipal Permit applies to all owners or operators of regulated small municipal separate storm sewer systems (small MS4s) located in Whatcom, Skagit, Snohomish, King, Pierce, Lewis and Skamania Counties. Secondary Permittees are those public agencies located in a Phase I or Phase II jurisdiction that are not a city, town, or county. The Port is covered individually under Permit No. WAR045700. Under the terms of the Municipal Permit, the Port developed a Stormwater Management Program (SWMP) for the coverage area over a period of five years. An overview of this program is contained in this SWMP document. The SWMP was revised annually during the Stormwater Management Program 1

five-year program development period to address progress toward required elements of the program. Public comment was accepted throughout the program development period via the Port s website. A work plan for the program development is provided in Section V below. The Port s SWMP is intended to protect downstream water quality by implementing six program elements: 1. Public education and outreach; 2. Public involvement/participation; 3. Illicit discharge detection and elimination; 4. Construction site stormwater runoff control; 5. Post construction stormwater management in new development and redevelopment; and 6. Pollution prevention/good housekeeping for municipal operations. The Port currently holds an NPDES Industrial Stormwater General Permit (Industrial Permit), which covers the Skagit Regional Airport and Port maintenance shop area. Pursuant to the Industrial Permit, the Port maintains a Stormwater Pollution Prevention Plan (SWPPP) for the covered facilities. Stormwater sampling is conducted quarterly for the Industrial Permit, at two discharge points located north and south of Ovenell Road, near Higgins Airport Way. The SWMP developed under the requirements of the Municipal Permit is compatible with and complementary to the Port s SWPPP and addresses both areas that are covered by the Industrial Permit, as well as areas that are outside the Industrial Permit coverage area. III. SWMP COVERAGE AREA The coverage area considered in this document includes approximately 1,800 acres of Port-owned land, including the Skagit Regional Airport and Bayview Business Park located on Bayview Ridge in Skagit County, Washington. The property is generally located approximately four miles northwest of the City of Mount Vernon and three miles west of the City of Burlington. Padilla Bay is the receiving water body for the coverage area watershed and is located approximately 1.2 miles west of the coverage area. A map of the coverage area is attached as Figure 1 of this document. Stormwater Management Program 2

IV. STORMWATER SYSTEM OVERVIEW The Port s Bayview Ridge stormwater system is a regulated small MS4 that conveys stormwater from the coverage area to three off-site discharge points, which ultimately drain to Padilla Bay. The Port s MS4 receives and conveys runoff from two off-site areas located north of Port property. The first area is up to and just north of Josh Wilson Road, and the second area is northwest of the Port s property on Bayview Ridge. Stormwater that discharges from Port property is conveyed to properties within Skagit County Dike, Drainage, and Irrigation District No. 12 and Skagit County Drainage and Irrigation District No. 19. Discharge to Dike, Drainage, and Irrigation District No. 12 occurs along Farm to Market Road at the intersections of Bayview and Ovenell Road. Discharge to Drainage and Irrigation District No. 19 occurs at the ditch crossing Higgins Airport Way, just north of SR 20. The Port s stormwater system is detailed in the 1998 Bayview Business and Industrial Park and Skagit Regional Airport Stormwater Management Master Plan (David Evans and Associates, Inc.). Operation and maintenance of the system is specified in the Master Plan. In general the system consists of three primary components: (1) collection and conveyance facilities including catch basins, pipes and open ditches; (2) on-site stormwater treatment for developed parcels including swales, ponds, or other accepted Best Management Practices (BMPs); and (3) a regional detention system consisting of three primary detention facilities. The first of the detention facilities is a series of four in-line cells located along the west side of Higgins Airport Way. These cells are designed to detain runoff to pre-development levels for the anticipated future build-out of the business park and east side of the airport. The remaining two detention facilities consist of two detention basins located in the southwest corner of the Port s property near the intersection of Ovenell Road and Farm to Market Road. These basins were designed to detain runoff from the development of lots in the Port s Divisions 5 & 7 area. The Master Plan includes basin and reach maps for existing and developed conditions on the property. The maps include locations of stormwater management facilities including ditches, pipes, culverts, catch basins, ponds, and detention cells, as well as points of discharge from Port property. These maps will be used as a template to develop a GISbased stormwater management map for internal data and facilities management at the Port, as well as to provide a user-friendly map for public education. VI. PROGRAM COMPONENTS A. Public Education and Outreach 1. Label Storm Drains All storm drain inlets in the coverage area were clearly labeled in 2010 using an epoxy marker, stenciling, or sticker with an appropriate stormwater drainage notice and prohibition on dumping, per the Municipal Permit requirements Currently the Port has an inventory of 94 catch basins located on the Skagit Regional Airport and Bayview Business Park properties. The catch basins are all labeled with either a stenciled message, an epoxy marker, or a sticker. Markers are labeled with the message No Dumping - Drains to Bay or Only Rain Down the Storm Drain. The Port included a message about storm drain markers in the summer 2008 quarterly newsletter, which is distributed to businesses and residents in the port district. The Port will continue to regularly inspect storm drain labels and re-mark as necessary. Labels that become worn so as to be indistinguishable will be re-marked within 90 days. 2. Distribute Educational Information The Port hosted two stormwater educational workshops in 2008. The first workshop, held February 26, 2008, was targeted for Port staff and focused on permit compliance, pollution prevention and good housekeeping for municipal operations, and operations & maintenance of the Port s stormwater system. The second workshop, held April 29, 2008, was targeted for Port tenants and focused on interfaces between the NPDES Industrial and Municipal Stormwater Permits, the Port s stormwater system, industrial stormwater BMPs, and staff training tools. The Port developed and distributed an educational brochure for trail users in 2008, which includes information about stormwater management and the importance of managing dog waste. In addition, the Port added six new dog waste stations with mitts and garbage receptacles to the trail and marina facilities in 2008 and installed three new signs with a message to pickup dog waste for the protection of our waterways. In 2010, the Port updated the Operations and Maintenance Plan and in 2011, the SWPPP for the Airport was updated. Port maintenance staff was informed of updates pertaining to pollution prevention and good housekeeping for municipal operations, Stormwater Management Program 6

and operations and maintenance of the Port s stormwater system. The Manager of Planning and Environmental Services conducted site inspections of the stormwater system and trained maintenance staff to conduct the Spring and Fall inspections and prepare the Stormwater Management System Inspection and Maintenance Schedule: Spring/Fall Inspection and Maintenance Logs. In March 2012, the Port created a pamphlet entitled Only Rain Down the Drain, describing best business practices for outdoor washing, hazardous materials storage and disposal, and spill clean-up. The pamphlet will distributed to all Port tenants in August 2012. B. Public Involvement and Participation The s Stormwater Management Program is available for public review and comment until February 16, 2013. The document is available for review at the Administrative Office, 15400 Airport Drive, Burlington, WA 98233 and on the Port s web site at www.portofskagit.com. C. Illicit Discharge Detection and Elimination The Port adopted an Illicit Discharge Stormwater Policy in January 2008. The policy prohibits the release of unauthorized non-stormwater discharges to the Port s stormwater system and prohibits illicit connections to the Port s stormwater system. The policy was distributed by mail to all Port tenants following its adoption by the Port Commission and was reviewed with tenants and staff in attendance at the February and April 2008 workshops. Port maintenance staff received training in illicit discharge detection and conduct regular inspections of the stormwater system including a visual inspection for illicit discharges. In 2009, 2010, 2011, and 2012 the Port monitored its primary stormwater outfall at Ovenell Road and Higgins Airport Way, using visual inspections, stormwater testing for turbidity and ph, and illicit discharges. In 2011, the Port received information on an illicit discharge conducted on Port property by a tenant (Intermountain Truck Rebuilder/Mountain Sales). The tenant was reported washing a propane tank onto pavement, where wash water entered a stormdrain. A letter written to the tenant, dated October 28, 2011 is attached. In the spring of 2011, the Port was notified that shotgun shells were littering the stormwater ditch and catch basin at the north end of the property, along Josh Wilson Road, near the Old Skagit Gun Club. Port staff notified Skagit County, who notified the Old Skagit Gun Club, as the discharge was coming from off site. Stormwater Management Program 7

The Port currently has a Spill Response Plan in place for use at its facilities. The Spill Response Plan was updated March 2010 and is compatible with the Port s Illicit Discharge Policy and SWMP. D. Construction Site Stormwater Management In accordance with state and federal law, the Port applies for and receives coverage under the NPDES Construction Stormwater General Permit for any project that will disturb more than one acre of ground prior to beginning any work at the construction site. The Port requires that all contractors working on projects covered under an NPDES permit comply with all permit conditions and have a Certified Erosion and Sediment Control Lead (CESCL) on site during the work. For projects that the Port completes internally, the Port contracts with a consulting CESCL for BMP guidance and monitoring. As appropriate, the Port trains maintenance staff on sediment and erosion control BMPs. The Port coordinates with Skagit County and Ecology on earth disturbing construction projects. E. Post-Construction Stormwater Management The Port will continue to comply with all local laws and regulations with respect to post-construction site stabilization and stormwater management. The Port will coordinate with Skagit County and Ecology on projects that would discharge to the Port s stormwater system. F. Pollution Prevention and Good Housekeeping The Port has implemented an Operations and Maintenance Plan for the purpose of minimizing stormwater pollution from operations and maintenance activities conducted by Port staff. The O&M Plan covers the following Port operations:! All routine and preventative maintenance of the Port s Bayview Ridge stormwater system.! Road and parking lot maintenance practices, including: deicing, snow removal, and sanding.! Vehicle fleet maintenance, including: mechanical repairs, fueling, and washing.! External building maintenance, including: exterior cleaning, washing, painting, and other maintenance activities. Stormwater Management Program 8

! Grounds maintenance, including: green waste disposal, trash management, and sediment and erosion control.! Fertilizer, herbicide, and pesticide application;! Materials storage, including: stockpiling of gravel or other debris and heavy equipment storage; and! Incidental Spill Response and Cleanup. The Port provided yearly staff training on the O & M Plan, as well as general stormwater management and illicit discharge detection & elimination. The Port recently updated training curriculum and prepared a Powerpoint presentation for Port staff. The most recent training occurred on August 24, 2012. VII. TOTAL MAXIMUM DAILY LOAD REQUIREMENTS At the time of permit coverage, there were no applicable Total Maximum Daily Loads (TMDLs) approved within the permit coverage area. If this should change in the future, the Port will look for opportunities to participate in the development of a TMDL for discharges affecting Port property. VIII. MONITORING The Port monitors stormwater on a quarterly basis for the Industrial Permit at the downstream end of the primary detention cell system along Higgins Airport Way. The Port will report any monitoring at this discharge point or any other supplemental monitoring conducted during the reporting period each year. In addition, any sampling conducted in order to characterize an illicit discharge will be reported in the annual report. IX. REPORTING REQUIREMENTS The Port prepared and submitted an annual report to the Department of Ecology, per the Municipal Permit requirements, no later than March 31 of each year, beginning in 2008 through March 31, 2012. 1. The Annual Report Form for Secondary Permittees. 2. The status of implementation of each component of the SWMP. 3. An assessment of the Port s progress in meeting the minimum performance standards established for each of the minimum control measures of the SWMP. 4. A summary of the Port s evaluation of our SWMP, according to Section S8.B.2 of the permit. 5. Updated information from the previous year s annual report. 6. Certification and signature pursuant to G19.D., and notification to any changes to authorization pursuant to G.19.C. 7. Notification of any jurisdictional boundary changes resulting in increase or decrease in the Port s geographic coverage area during the reporting period and any implications for the SWMP. XI. DEFINITIONS Best Management Practices ( BMPs ): The schedules of activities, prohibitions of practices, maintenance procedures, and structural and/or managerial practices approved by the Department that, when used singly or in combination, prevent or reduce the release of pollutants and other adverse impacts to waters of Washington State. BMP: Best Management Practice. Discharge: Any discharge to or from the stormwater system. Illicit Connection: Any man-made conveyance that is connected to a municipal separate storm sewer without a permit, excluding roof drains and other similar type connections. Examples include sanitary sewer connections, floor drains, channels, pipelines, conduits, inlets, or outlets that are connected directly to the municipal separate storm sewer system. Illicit Discharge: Any discharge to a municipal separate storm sewer that is not composed entirely of storm water except discharges pursuant to a NPDES permit (other than the NPDES permit for discharges from the municipal separate storm sewer) and discharges resulting from fire fighting activities. National Pollutant Discharge Elimination System (NPDES): The national program for issuing, modifying, revoking, and reissuing, terminating, monitoring and enforcing permits, and imposing and enforcing pretreatment requirements, under sections 307, 402, 318, and 405 of the Federal Clean Water Act, for the discharge of pollutants to surface waters of the state from point sources. These permits are referred to as NPDES permits and, in Washington State, are administered by the Washington Department of Ecology. Outfall: Point source as defined by 40 CFR 122.2 at the point where a municipal separate storm sewer discharges to waters of the State and does not include open conveyances connecting two municipal separate storm sewer systems, or pipes, tunnels, or other conveyances which connect segments of the same stream or other waters of the State and are used to convey waters of the State. Phase II Municipal Stormwater Permit: NPDES permit coverage under 33 U.S.C. Sec. 1251 and RCW 90.48, which applies to all regulated small municipal separate storm sewer systems (MS4s). Point Source: Pollution that can be traced back to a single origin or source. Stormwater Management Program 12

Secondary Permittee: An operator of a regulated small MS4 that is not a city, town or county. Small Municipal Separate Storm Sewer System (Small MS4): A conveyance, or system of conveyances including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, man-made channels, or storm drains which is: a. owned or operated by a city, town, county, district, association or other public body created pursuant to State law having jurisdiction over disposal of sewage, industrial wastes, stormwater, or other wastes, including special districts under State law such as sewer districts, flood control districts or drainage districts, or similar entity. b. designed or used for collecting or conveying stormwater. c. Not a combined sewer system. d. Not part of a Publicly Owned Treatement Works (POTW) as defined at 40 CFR 122.2. e. Not defined as large or medium pursuant to 40 CFR 122.26(b)(4)&(7) or designated under 40 CFR 122.26 (a)(1)(v). Stormwater: Runoff during and following precipitation and snowmelt events, including surface runoff and drainage. Stormwater Management Program (SWMP): A set of actions and activities designed to reduce the discharge of pollutants from a regulated small MS4 to the maximum extent practicable and to protect water quality, and comprising the components listed in S5 or S6 of the Western Washington Phase II Municipal Stormwater Permit and any additional actions necessary to meet the requirements of applicable laws and regulations. Waters of the State: Those waters as defined as waters of the United States in 40 CFR Subpart 122.2 within the geographic boundaries of Washington State and waters of the state as defined in Chapter 90.48 RCW which includes lakes, rivers, ponds, streams, inland waters, underground waters, salt waters and all other surface waters and water courses within the jurisdiction of the State of Washington.
