KINGS COURT HOMEOWNERS ASSOCIATION, INC. Architectural Review Board (ARB) Guidelines Approved by the Board of Directors at a duly held meeting on August 16, 2016. Revised by ARB and Approved by the Board of Directors at a duly held meeting on March 13, 2018 Request for any changes to the exterior of homes must have prior written approval from the ARB before any changes can be made as stated in Kings Court (KC) governing documents. It is understood that disregarding KC Documents and Rules and Regulations may require that any unapproved work be removed at the owner's expense. Homeowner could be subjected to fines and attorney costs. The established criteria used by the ARB for requests is as follows: 1. An ARB application must be submitted for review and approval by the ARB committee before any work requiring an approval begins. See attached. 2. It is understood that any changes to the exterior of unit/home must be consistent with the original design of the unit. 3. All work performed or delivered to improve Owner s unit by contractors or suppliers of services and materials are and shall be performed or delivered by such parties' agents exclusively for the unit owner, and not for the association or any other party. 4. Owner assumes full liability for all damages caused by any such agents to any person to the common area or the property of any other party and must be corrected immediately. 5. Owner is to hire the services of trade persons who are fully licensed and insured to perform such services as required by Miami-Dade County ordinances. Copies of current license(s) must be attached to the ARB Application. 6. The company(ies) hired to perform any work on the unit will provide the association with a current certificate of insurance with liability of $500,000 and workman s compensation coverage. Current certificates of insurance(s) must be attached to the ARB Application. 7. Where applicable, set of plans / specifications / samples / product approvals and/or Notice of Acceptance (NOA), must be attached to the ARB application. 8. Miami Dade County Permit: Owner will conform to the current applicable laws and codes in effect promulgated by MIAMI-DADE COUNTY. A copy of such permit application and plans must be provided to the association along with the ARB application 9. All work to be performed shall be done only during the hours of 8:00 a.m. to 7:00 p.m., Monday through Saturday and 10:00 a.m. to 6:00 p.m. on Sundays. 10. The disposal of all construction debris shall be the joint responsibility of the unit owner and/or the tradesperson(s), contractor(s), or company(ies) performing the job upon completion, not to exceed 5 days. 11. If and when approval by the ARB is granted, owner has 90 days to complete such work. If additional days are necessary, homeowner must contact the Association's Management in writing and notify that additional days are needed and list specific reason for the request. 12. If an installation is to be made below the back patio fence line, such as jacuzzi, pool, etc., owner is to obtain written approval from affected neighbors and include same to the ARB application. 13. It is understood that no structures are permitted in the backyard that are visible above the fence, with the exception of dome-type screen enclosures. (Examples: awnings, retractable awnings, tents, clothes poles, clothes hanging devices, freestanding lamppost(s), shed(s), oversized umbrellas, etc.) 14. BELOW ARE THE DETAILED REQUIREMENTS FOR ALL EXTERIOR MODIFICATIONS REQUIRING ARB WRITTEN APPROVAL: (Listed in Alphabetical Order) DRIVEWAY: STANDARDS & SPECIFICATIONS FOR REPLACEMENT OF HOMEOWNERS' DRIVEWAY (Approved by BOD 7/14/15) New driveways must meet Miami-Dade County Code Standards. Permit from Miami-Dade County is required and must use the current Florida Building Code. Homeowner must use a Licensed and Insured contractor. Driveway must line up with asphalt street. If asphalt is cut, homeowner is responsible for replacing asphalt removed on the street and re-applying seal coating in a 1' (1 ft.) strip across the length of the street at the driveway-to-street intersection. It is recommended to remove or trim roots under the existing slab and possibly putting in a barrier to prevent future root encroachment. Contractor must coordinate with No Cuts to come out and mark the underground utilities of the driveway to be replaced. "No Cuts" is a free service that must be called in by the homeowner, and they may be reached by calling 811. Contractor should administrate this process. Natural color concrete that conforms with the rest of the community must be used. No stain or color is permitted. Any damages to common areas and/or another homeowner's property is the responsibility of the originating homeowner to repair at his/her cost. Size of the driveway must be consistent with the original design in that it may not deviate in size, width, or any dimensions. FRONT COURTYARD GATE: Must be wood permanently attached (no temporary baby/pet gates). Height must not be taller than the courtyard wall. Must be painted the approved color immediately after installation. FRONT DOOR: Must be identical or similar to the original door and is to be painted the approved color immediately after installation. Door must not have any windows or glass panels. FRONT EXTERIOR LIGHTS: Must be no less than 7" in height and no larger than 15 in height. Must be "carriage" style. Colors to be bronze or black. A picture of the fixture must be submitted with the application. No spot lights or vapor lights are permitted. GARAGE DOOR: Must be 5 panels in height and 4 squares across. No windows across the top. It must meet Miami-Dade County Code. Door to be painted the approved color immediately after installation. GLASS PANEL NEXT TO FRONT DOOR: Panel only permitted on the Ensenada model in keeping with the original exterior design of that model. Size of the glass panel must remain the same as the original in width and height. HURRICANE SHUTTERS (Accordion/Roll down): Must meet Miami-Dade County requirements. Color is to be ivory. IMPACT WINDOWS & DOORS: Must meet Miami-Dade County Code requirements. Frame color must be bronze, glass must be bronze in color, if tinted. Second floor bedroom windows must be casement in style with no extra framing on the glass. ROOF REPLACEMENT: The approved roof tile to be used in Kings Court is manufactured by Boral, Galena consisting of a 3 color blend as follows: Terracotta w/black Antique (part #1GQCS6230AA); Tan w/black Antique (part #1GQCS0332AA) and Cedar w/black Antique (part #1GQCS6203AA). Make sure to remind your contracted roofing company, as they would normally order a blend by name, they must now order 1/3 of each of the three colors shown above and must use part number. This three color blend was previously known and approved by the Board of Directors on 04/23/18 as "Grand Cay Blend." A copy of proof of purchase is required to be sent to our office no need to show the cost. Also, it is understood that painting of the flashing is the responsibility of the unit owner, please do not leave any metal/wood showing. It must be painted. Vents and stacks excluded. SKYLIGHT(S): If the request is to replace and/or install skylight(s), frame color must be bronze. SCREEN DOOR (Front): Must be of the approved design and it must be painted the same color as the front door or may remain the original bronze or black color. SCREEN ENCLOSURE (Back Patio Only): Must meet Miami-Dade County requirements. The structure must be bronze in color. The screen must be dark gray or bronze in color. Design must be dome style. WALKWAY: If the request is to replace and/or install tiles or brick pavers, it is understood that they must be in terracotta color family or pattern. WINDOWS: Must meet Miami-Dade County Code requirements. The frame must be in bronze color; the glass must be bronze in color, if tinted. The design must be as similar to the original design as possible. BELOW ARE THE DETAILED REQUIREMENTS FOR EXTERIOR MODIFICATIONS NOT REQUIRING ARB WRITTEN APPROVAL: (Listed in Alphabetical Order) BACKYARD FENCE: Must be replaced same style (shadowbox privacy) and height as the original being removed. Must be painted approved color immediately after installation. FRONT COURTYARD WALL/FENCE AND/OR GATE: If the front courtyard wall, fence and/or gate needs to be replaced they must be the same material, size, height, width and length as the original being removed in keeping with the original design of the unit. Must be painted the approved color immediately after replacement. GUTTERS: Must be painted same color as existing trim and downspouts must match color of the existing stucco. IRON BARS: Must be installed on the inside of the unit, not on the outside of the unit. TRELLIS: If the front trellis(es) needs to be replaced, it must be same in quantity, size, width, and length as the original being removed in keeping with the original design of the unit.
