The item requests that the Community Redevelopment Agency make a recommendation to the Board of County Commissioners to approve a resolution to allow the installation of pole banners for the general benefit of the County and for public convenience by creating a sense of place, fostering pride in the community and promoting cultural, civic and other events of public interest. 2 BACKGROUND/RELATED STRATEGIC GOAL: Pole Banners, as defined in the Florida Administrative Code, Regulation of Overhanging Encroachments; means a length of cloth, fabric, plastic, or other flexible material bearing a message which is located adjacent to the travel lanes of the roadway and is attached to a single existing permanent support. Neighborhood Advisory Committees in all of the County s redevelopment areas have expressed interest in the installation of pole banners within their individual CRA areas with the following objectives: - Create a sense of place and foster pride in the community, - Enhance and beautify Town Centers and main commercial areas by adding life and color to the streetscape, - Create awareness and promote cultural, civic and other events of public interest, and - Provide place identification for visitors and potential partnership with the Office of Tourism and Marketing to promote key tourism promotion events in the CRAs. Section A of the Land Development Regulations, Martin County Code, provides that the County Commission may itself allow the erection of signs on or over any public property and/or rights-of-way for the general benefit of the County as a whole or for the public convenience, necessity or welfare. The proposed Pole Banners meet these criteria. With the final approval of this resolution by the Board of County Commissioners, pole banners would be allowed on County/CRA streetlights along the County rights-of-way within the Community Redevelopment Areas within the unincorporated areas of the County. It is further proposed that pole banners be located in main commercial areas and areas proposed as Town Centers in the community redevelopment area s adopted community redevelopment plan. Staff level review and approval will be required for pole banners that contain name identification of the redevelopment area and the promotion of cultural and civic events that receive funding from the Office of Tourism and Marketing and have previously been reviewed by the Board of County Commissioners. Pole banners promoting other events and programs would require approval by the Community Redevelopment Agency as to sign design, location and duration within the individual Community Redevelopment Areas. A formal policy and process for approval of the pole banners will be developed by staff in accordance with direction from the Community Redevelopment Agency and Board of County Commissioners and incorporated into the Request for Service system on the County s website. A brief PowerPoint presentation and draft policy will be provided via Supplemental Memorandum. ISSUES: 1. Current Land Development Regulations do not include a provision for the installation of pole banners as defined in the Florida Administrative Code. 2. Section A of the Land Development Regulations, Martin County Code, Prohibited Signs, restricts signs on or over any public property, and/or rights-of-way to governmental signs of a public nature with the exception of such signs the County Commission may itself allow for the general benefit of the County as a whole or for the public convenience, necessity or welfare. 3. Adoption of the attached Resolution is essential to provide the necessary approval by the Board of County Commissioners. 8079f4de 2 of 20
3 LEGAL SUFFICIENCY REVIEW: To the extent this item contains legal issues, it has been reviewed for legal sufficiency; however, it is primarily a matter of CRA policy. RECOMMENDED ACTION: RECOMMENDATION 1. Recess as the Board of County Commissioners. 2. Convene as the Community Redevelopment Agency. Move that the Community Redevelopment Agency recommend the Board of County Commissioners approve the attached Resolution to allow the installation of Pole Banners in Community Redevelopment Areas. 3. Adjourn as the Community Redevelopment Agency. 4. Re-convene as the Board of County Commissioners. ALTERNATIVE RECOMMENDATIONS None. The purpose of this policy is to provide for the management, use, and content of pole banners in CRAs. Guidelines There are two types of permitted pole banners: Identification Banners and Event/Civic Banners. Banner Types Identification Banners: Identify a Community Redevelopment Area. Must be installed on poles within the area being identified. Permission to be installed requested from the Community Redevelopment Agency. Banners will remain in effect until rescinded either by request of the CRA or BOCC. Identification banners must be maintained by a sponsoring agency. Event/Civic Banners: Promote arts and cultural activities including events, festivals, tourism or civic programs, as well as major sporting and events of public interest. Celebrate an event and announce a specific date or time period. May be installed 30 days prior to event and must be taken down 5 days afterward. 6 of 20
7 Banner Requirements banners: Must meet all applicable FDOT and/or Martin County regulations Designs must be reviewed and approved by the relevant Neighborhood Advisory Committee and, subsequently, the CRA Will be installed on major streets within the CRA. Visually enhance the CRA s streetscape. Design & Dimensions Must be 24 inches horizontal by 48 inches vertical Feature simple and bold graphics visual impact Limit use of text Banners may not be used as an advertising medium for specific products and services. Pole Locations Pole banners in the CRA will be permitted on street poles that already have banner brackets. Banner Request - Submission Guidelines 1. Requests for identification banner designs must be submitted to the Office of Community & Strategic Partnerships (CSP) at least 60 days prior to the proposed installation date. 2. Event/Civic Banners requested for regular, approved events also promoted by the Office of Tourism and Marketing and listed and updated periodically in Exhibit 1 shall be authorized during the annual Road Permit meeting, which occurs in December and must be submitted per the road permit submission guidelines. 3. Requests for Events/Civic Banner for special events, not specified in the list, shall be submitted to the Office of Community and Strategic Partnerships (CSP), not less than 90 days in advance of the event. CSP will then present to the CRA for approval. 4. If pole banners are located along a state road the applicant must hold a permit issued by the Florida Department of Transportation. 5. If banner hangs over FDOT right-of-way, FDOT permit applications must be filed with CSP for sufficiency review and be signed by the County Administrator or designee prior to its submission to FDOT. 6. A copy of the applicant s certificate of liability insurance must be provided 7. A diagram or map of the specific poles to be used for banner installation, including the vertical pole numbers (the pole numbers are located on the street-side of the pole) and the streets on which the poles are located. 8. A proof of the banner design, including the actual colors to be used and the banner size. 9. If replacement brackets are to be installed, submit specifications for the bracket installation system and costs must be provided by sponsoring agency. 10. Applicants are responsible for installation and removal of the banners. 11. All requests are granted are on a first-come, first-served basis. 7 of 20
