2 File ID: Public Hearing Item 04 Description/Analysis Issue Detail: The applicant is requesting to establish an assembly use within an existing ±12,350-square foot office building on a 0.29-acre parcel in the Residential Office (RO) zone. This requires the approval of a Planning and Design Commission-level Conditional Use Permit. The Center of Praise Ministries church currently utilizes this building as their administrative offices, auxiliary Sunday school classrooms and for their children s program, with no individual areas designated for more than 49 people. Over the last few years, church membership has gradually increased and the youth program has grown. As a result, the applicant is proposing to add a total of ±1,807 square feet for assembly use on the upper levels of the existing office building. One area will be a space for worship, with 711 square feet located on the second floor, and the other area will be a space for their Sunday School program, with 1,096 square feet located in the mezzanine. The Center of Praise Ministries currently operates religious services at 2223 Capitol Avenue. The site at 2150 Capitol will complement that main assembly hall by providing space for children and teens. Public/Neighborhood Outreach and Comments: On September 15, 2017, staff routed the project to the Capitol Mansions District Preservation Association, the Midtown Association, the Midtown Neighborhood Association and Preservation Sacramento. Staff received an and phone call from a representative of the Capitol Mansions District Preservation Association with concerns regarding issues with parking in the area. As further discussed later in this report, the project complies with the minimum parking requirement. An Administrative Parking Permit was approved to allow the use of on-street parking along the project frontage to meet the minimum on-site parking requirement. Furthermore, staff supports the amount of parking provided given the new assembly area is primarily for Sunday School and other programs for children and teens who will not be driving to this site. On November 18, 2017, the Center of Praise Church held a town hall community meeting to let neighbors know about the project and to answer any questions the community may have. As a result of that meeting, the Pease Conservatory of Music, LLC provided a letter of support for the project. 3 File ID: Public Hearing Item 04 Policy Considerations: General Plan The General Plan designation of the subject site is Traditional Neighborhood Medium Density. This designation provides for higher-intensity and neighborhood-support uses including such as community centers, private social halls, religious institutions and other places of assembly. Some of the goals and policies supported by this project are: Goal LU 2.6 City Sustained and Renewed. Promote sustainable development and land use practices in both new development, reuse, and reinvestment that provide for the transformation of Sacramento into a suitable urban city while preserving choices (e.g., where to live, work, and recreate) for future generations. Policy LU Existing Structure Reuse. The City shall encourage the retention of existing structures and promote their adaptive reuse and renovation with green building technologies to retain the structures embodied energy, increase energy efficiency, make it more energy efficient, and limit the generation of waste. Goal LU 8.1 Public/Quasi-Public. Provide for governmental, utility, institutional, educational, cultural, religious, and social facilities and services that are located and designed to complement Sacramento s neighborhoods, centers, and corridors and to minimize incompatibility with neighborhoods and other sensitive uses. Policy LU Adequate Community Supporting Uses. The City shall seek to ensure that all manner of public and private community-supportive facilities and services are located throughout the city to provide places that serve the varied needs of the community, provide for community meeting places, and provide community and neighborhood landmark buildings and places. Goal LU 8.2 Special Uses. Provide for the development of Special Uses (e.g., assembly facilities, live-work studios, and care facilities) that are included within several Land Use and Urban Form Designation. Policy LU Assembly Facilities and Event Centers. The City shall encourage and support development throughout the city of assembly facilities for social, cultural, entertainment, sports, educational, and religious activities. The subject site is designated as Traditional Neighborhood Medium Density on the General Plan Land Use and Urban Form Diagram. This designation contains a wide diversity of development in urban form, housing choice, and neighborhood support services. Specifically, limited neighborhood-serving commercial on small lots are encouraged to promote complete and well-structured neighborhoods with diverse centers that accommodate different community needs. 4 File ID: Public Hearing Item 04 facilities for social, cultural, entertainment, sports, educational, and religious activities (General Plan Policies LU 1.1, 8.2, 8.2.1). The project supports the land use and community design goals of the Central City Community Plan because it permits the reuse of an existing building. Environmental Considerations: The Community Development Department, Environmental Planning Services has reviewed this project and has determined that the project is exempt from the provisions of CEQA, pursuant to Categorical Exemption 15301, Existing Facilities. This project qualifies for this exemption because it consists of the operation, repair, permitting and minor alteration of an existing private facility involving negligible or no expansion of use. 200-Year Flood Protection: State Law (SB 5) and Planning and Development Code chapter require that the City must make specific findings prior to approving certain entitlements for projects within a flood hazard zone. The purpose is to ensure that new development will have protection from a 200-year flood event or will achieve that protection by The project site is within a flood hazard zone and is an area covered by SAFCA s Improvements to the State Plan of Flood Control System, and specific findings related to the level of protection have been incorporated as part of this project. Even though the project site is within a flood hazard zone, the local flood management agency, SAFCA, has made adequate progress on the construction of a flood protection system that will ensure protection from a 200-year flood even or will achieve that protection by This is based on the SAFCA Urban level of flood protection plan, adequate progress baseline report, and adequate progress toward an urban level of flood protection engineer s report that were accepted by City Council Resolution No on June 21, 2016, and the SAFCA 2017 Adequate Progress Annual Report accepted by City Council Resolution No on November 7, Rationale for Recommendation: Staff recommends the Commission approve the requested entitlements based on the findings and subject to the conditions listed in Attachment 3. The proposal complies with the goals and policies of the General Plan, in that it supports social, cultural, educational, and religious activities and the proposed project is compatible with the surrounding neighborhood and has been conditioned to comply with good neighbor policies. 6 Summary The applicant is requesting to establish approximately 1,807 square feet of space for assembly use within an existing ±12,350-square foot office building on a 0.29-acre parcel in the Residential Office (RO) zone. The request requires a Conditional Use Permit (CUP) to establish the use. Staff notified all property owners within 300 feet of the site for this public hearing. On June 21, 1991, the Planning Commission approved a Variance to waive the required 6-foot high masonry wall along the west

7 property line (P91-118). In 2005, the subject site was permitted for interior renovations for the office. In 2007, the subject site was permitted for a Certificate of Occupancy for the office use. In 2012, the Center of Praise Ministries church purchased the building to serve as the church administrative offices and auxiliary Sunday school classrooms and space for their children program. Over the last few years, church membership has gradually increased and the youth program has grown. As a result, the applicant is proposing to add a total of ±1,807 square feet for assembly use on the upper levels of the existing office building. One area will be a space for worship, with 711 square feet located on the second floor, and the other area will be a space for their Sunday School program, with 1,096 square feet located in the mezzanine. No exterior modifications to the building or the site are being proposed. Conditional Use Permit The subject site is located at the southwest corner of Capitol Avenue and 22 nd Street. It is surrounded by Capitol Avenue and medical office to the north, residential dwellings to the south, 22 nd Street and residential dwellings to the east, and parking lot to the west. The project is in the Residential Office (RO) zone. The proposed assembly use is an allowed conditional use that requires the approval of the Planning and Design Commission. The applicant is requesting to establish an assembly use and provide service to a group of approximately 175 people. The facility is currently utilized as the administrative offices for the Center of Praise Ministries church, with 10 staff members from 9:00am to 5:00pm Tuesdays through Fridays, with the heaviest use occurring on evenings and weekends. The building has a fiber-cement horizontal siding façade painted gray with blue trim and composition asphalt shingle roofing. The building s entrance is a storefront door with windows located on the northwest corner of the building. The ground floor plan includes an entry lobby with stairs and elevator, a reception area, administrative offices, a copy/coffee room, storage and 22 covered parking spaces. The second story floor plan includes a lobby and reception area, a craft room, conference rooms, additional administrative offices, restrooms, a breakroom, stairs that lead up to a mezzanine, and a worship area with a maximum capacity of 102 occupants. The mezzanine includes restrooms, a teen lounge and a large room for the Sunday School program with a

8 maximum capacity of 73 occupants. The applicant is not proposing to make any modifications to the exterior of the building, therefore Site Plan and Design Review is not required. The project is conditioned to not allowed amplified sound outside of the building, to minimize the potential disruptions to the adjacent residential uses. The project has also been conditioned to require a Good Neighbor Policy, which identifies a primary person who can be contacted if there are community concerns that need to be addressed. Access, Circulation and Parking The project site is located on the southwest corner of Capitol Avenue and 22 nd Street, bordered on the south by Matsui Alley. The main entrance to the building is located on Capitol Avenue. The project does not involve any changes to the existing site. Figure 2: Site Plan The parking requirement for an assembly use in the Traditional Parking District is one (1) space per five (5) occupants. The added assembly rooms have a combined maximum occupancy of 175 people and therefore, the project requires a minimum of 35 onsite parking spaces. There are 22 parking spaces in the garage located on the ground floor of the building and 2 onsite spaces, for a total of 24 onsite parking spaces. With the approval of an Administrative Parking Permit, the applicant was allowed to utilize on-street parking spaces along their project frontage to satisfy the remaining required spaces. There is a total of 15 on-street parking spaces: 3 parallel parking spaces on Capitol Avenue and 12 angled street parking spaces along 22 nd

9 Street (see Figure 2). Therefore, the project complies with the parking requirements for the new assembly use. The applicant has also noted they intend to seek off-site street parking spaces in the parking structure at 2101 Capitol Avenue. The parking structure is one half block away from the project site. The church will work with the structured parking garage owner in cases where overflow parking is needed. Bicycle Parking: The additional assembly use requires the project to comply with the City s bicycle parking requirements. The project is required to provide nine (9) short-term spaces and two (2) long-term spaces. The project will be conditioned to provide the required bicycle parking spaces.

10 Attachment 3 Proposed Findings of Fact and Conditions of Approval Center of Praise Youth Center (P17-054) 2150 Capitol Avenue, Sacramento, CA Findings of Fact A. Environmental Determination: Environmental Exemption (Per CEQA Guidelines Section Existing Facilities). Based on the determination and recommendation of the City s Environmental Planning Services Manager and the oral and documentary evidence received at the hearing on the Project, the Planning and Design Commission finds that the Project is exempt from review under Section 15301, Existing Facilities of the California Environmental Quality Act Guidelines as follows: 1. The project consists of the operation and permitting of existing facilities involving negligible expansion of use beyond that existing at the time of the lead agency s determination. B. The Conditional Use Permit to establish ±1,807 square feet of space for assembly use within an existing ±12,325-square foot office building on a 0.29-acre parcel in the Residential Office (RO) zone is approved based on the following findings: 1. The proposed use and its operating characteristics are consistent with the General Plan designation of Traditional Neighborhood Medium Density, in that the proposed assembly will assist in meeting the need for services and will also promote a complete and well-structured neighborhood with a mix of uses for the area residents. 2. The proposed use and its operating characteristics are consistent with the applicable standards, requirements, and regulations of the zoning district in which it is located, and of all other provisions of this title and this code, in that the religious assembly is an allowed use in the RO zone, subject to the approval of a Planning and Design Commission Conditional Use Permit. 3. The proposed use is situated on a parcel that is physically suitable in terms of location, size, topography, and access, and that is adequately served by public services and utilities, in that the project has been analyzed by City departments and it has been determined that all streets and other public access ways and facilities, parking facilities, and utility infrastructure are adequate to serve the proposed assembly use. 4. The proposed use and its operating characteristics are not detrimental to the public health, safety, convenience, or welfare of persons residing, working, visiting, or recreating in the surrounding neighborhood and will not result in the creation of a nuisance, in that the project has been conditioned to limit the size of the assembly area, establish good neighbor policies, and prohibit the outside broadcasting of amplified noise.

11 Conditions of Approval B. The Conditional Use Permit to establish ±1,807 square feet of space for assembly use within an existing ±12,325-square foot office building on a 0.29-acre parcel in the Residential Office (RO) zone is approved based on the following Conditions of Approval: PLANNING B1. The applicant shall obtain all necessary building permits and encroachment permits prior to commencing construction. Exterior modifications have not been reviewed and approved as part of this permit; any exterior modification to the project shall be subject to Site Plan and Design Review and approval by planning staff prior to the issuance of building permits. B2. Development of this site shall be in compliance with the attached exhibits, except as conditioned. Any modifications to the project shall be subject to additional planning review and may require subsequent entitlements prior to issuance of building permits. B3. The additional assembly areas shall be limited to a maximum of 1,807 square feet. Should the operator need to expand the assembly in the future, additional planning review and approval will be required. B4. The assembly use is required to meet the Sacramento City Code regulations regarding bicycle parking (Chapter ). Bicycle parking shall be located in a secured area in close proximity to public view, in well-lit areas near building entrances, and shall be installed prior to the issuance of the Certificate of Occupancy for the additional assembly area. B5. Any signage shall comply with the City Sign Code requirements. All signage is subject to a separate review and approval process through a sign permit. B6. No amplified sound shall be broadcasted outside the building as part of the operations for the assembly use. B7. The assembly use shall be conducted consistent with the following Good Neighbor policies: a. Establish a process for neighbors to communicate directly with the management staff of the assembly should there be any problems or issues; b. Establish a policy and provide information to neighbors surrounding the project site including special events, operating dates and times that could impact parking; and c. Provide an emergency contact person and phone numbers on-site, in a clearly identified place. PUBLIC WORKS B8. Repair or replace/reconstruct any existing deteriorated curb, gutter and sidewalk adjacent to the subject property per City standards to the satisfaction of the Department of Public Works. FIRE B9. Any modification to the facility must be done under permit by way of plan review for

12 compliance to the Fire and Building Codes. B10. Obtain a Fire Clearance by requesting a fire and life safety inspection from the Sacramento City Fire Prevention Division. B11. Obtain any required operational permits from the Sacramento City Fire Prevention Division. B12. Provide documentation to verify that any fire and life safety systems such as fire suppression and fire alarm systems have been serviced, maintained and certified in accordance with the required maintenance schedules as may be applicable (quarterly, annual and 5-year service). POLICE B13. New exterior parking lot lighting shall be white using LED lamps with full cutoff fixtures to limit glare and light trespass. Color temperature shall be between 2700K and 4100K with a color rendering index of 75 or better and a light loss factor of.95 or better. When choosing lamps, the applicant should look for efficiency of 110 lumens per watt or better. Existing exterior fixture in the alley shall be replaced with fixture that meets this requirement. B14. Broken or damaged exterior or parking lot lighting shall be repaired or replaced within 48 hours of being noted. B15. Exterior lighting shall be shielded or otherwise designed to avoid spill-over illumination to adjacent streets and properties. B16. All mature landscaping shall follow the two-foot, six-foot rule. All landscaping shall be ground cover, two feet or less and lower tree canopies of mature trees shall be above six feet. This increases natural surveillance and eliminates hiding areas within the landscape. B17. Tree canopies shall not interfere with or block lighting. This creates shadows and areas of concealment. The landscaping plan shall allow for proper illumination and visibility regarding lighting and surveillance cameras through the maturity of trees and shrubs. B18. An emergency evacuation plan and a shelter in place plan will be developed within six (6) months of approval and practiced routinely. B19. No more than 33 percent of the square footage of the windows and clear doors shall be blocked by advertising, signs, shelves or anything else. B20. The applicant is responsible for reasonably controlling the conduct of persons on the site and shall immediately disperse loiterers. B21. All dumpsters shall be kept locked or in locked enclosures. B22. Any graffiti painted or marked upon the premises or on any adjacent area under the control of the applicant shall be removed or painted over with matching paint within 72 hours of being applied. B23. The operator shall be responsible for the weekly removal of all litter from the site. REGIONAL SAN B24. Developing this property may require the payment of Regional San sewer impact fees

13 (connection fees). Regional San sewer impact fees shall be paid prior to the issuance of building permits. For questions pertaining to Regional San sewer impact fees, please contact the Sewer Fee Quote Desk at (916) Advisory Notes BUILDING ADV 1. UTILITIES ADV 2. The egress system shall comply with the provisions of Chapter 10 of the California Building Code (CBC), including the minimum width and minimum number of exits as per CBC 1005 and 1006 based on use. Note: The above comments are Code requirements and cannot be waived. Please note that this is a cursory review based on the information given and that further issues may arise during the formal review of construction documents. The project is served by the Combined Sewer System (CSS). However, based on the project s description, the applicant will not be required to pay combined sewer system impact fee. REGIONAL SAN ADV 3. The City of Sacramento (City) is responsible for providing local sewer service to the proposed project site via their local sanitary sewer collection system. Regional San is responsible for the conveyance of wastewater form the City collection system to the Sacramento Regional Wastewater Treatment Plant (SRWTP). SACRAMENTO AREA SEWER DISTRICT ADV 4. The subject property is outside the boundaries of SASD but within the Urban Service Boundary and Sacramento Regional County Sanitation District (Regional San) boundaries. Regional San will provide ultimate conveyance and treatment of the sewer generated from this site, but the Sacramento City Utilities Department s approval will be required for local sewage service.
