3 - 3 - DEPARTMENT OF ROADS AND PUBLIC WORKS EASTERN CAPE GOVERNMENT Tenders are hereby invited for the following contract, relating to the Construction of Port St Johns Workshop CONSTRUCTION OF PORT ST JOHNS WORKSHOP SCMU 5 13/ [CIDB Grade: 7GB/6GBPE Category or higher] Principal Agent: FWJK Quantity Surveyors Tel: Project Leader (DRPW) Ms. U Ntintili Tel: Note: A compulsory pre-tender site inspection will be held at 11:00am on Tuesday, 08 April 2014 at the Port St Johns Workshop in Port St Johns and prospective tenderers are required to attend this inspection. Tender documents will be available from 08:00am on Friday, 28 March 2014 at the offices of the Department of Roads and Public Works, 3 rd Floor, Room No. 346, Qhasana Building, Independence Avenue, Bhisho, on payment of a non-refundable deposit of R per document. Tenderers are required to be registered on the Centralised Electronic Database before any contract can be awarded. Tenderers shall take note of the following tender conditions Project Value is in CIDB Grade 7GB Category Tenderers are required to have a CIDB Contractor grading designation of 7GB/6GBPE or Higher Tenderers to tender within their CIDB category grade only (see above) Penalties for late completion will be enforced Late tenders will not be accepted The appointed tenderer will be required to submit a Valid copy of a Letter of Good Standing from the Compensation Commission or the Federated Employers Mutual Assurance, within 21 days of tender award Failure to complete all supplementary information and the RETURNABLE SCHEDULES will lead to the bid being eliminated Preferential Procurement Regulation 2011 (B-BBEE) principles will apply, whereby a tenderer s submission will be evaluated according to the sum of the Award of Points in respect of the tender value and the B-BBEE status of the enterprise Tenderers are required to submit a completed Contractor Performance Report as attached in the returnable document upon completion of the project. The contractor s performance will be evaluated on a quarterly basis and on completion of the project in accordance with this form The successful tenderer must note that 20% of the value of the works is required to be sub-contracted to SMME s and incubator contractors in the region Tenderers are to note that if the successful tenderer has a CIDB grading of 7GB or higher, that they will be required to have a registered professional in their employment Adjudication criteria are as follows: 90 Points for Price 10 Points for B-BBEE status level of Contribution - 3 -

6 - 6 - C: IRM Mhlontlo and Umzimvubu 2 Years 6CE Tender documents will be available as from 08h00 on Friday 28 March, 2014 from the offices of the Department of Roads & Public Works, Room 3-46, Qhasana Building, Bhisho upon payment of a non-refundable deposit of R 200,00 per tender document. Bank certified cheques must be made payable to Department of Roads and Public Works. A compulsory briefing meeting will be held at 10:00 on Wednesday, 09 April, 2014 at the East London Golf Club. As this is part of a group of tenders for road maintenance contracts, one combined compulsory briefing meeting will be held. DOCUMENTS WILL NOT BE AVAILABLE AT THIS BRIEFING. Failure to attend the briefing will render the Tender nonresponsive and it will be disqualified. The completed tender document and any supporting documentation shall be placed in a sealed envelope endorsed with the project name and tender number and be deposited in the Tender Box, Third Floor, Department of Roads & Public Works, Qhasana Building, Bhisho, not later than 11:00 AM on Tuesday, 29 April, 2014 when tenders will be opened in public. Requirements for sealing, addressing, delivery, opening and assessment of tenders are stated in the Tender Data. Tenderers must take particular note of the following: It is a requirement of tender that a minimum of 25% of the Contract be sub-contracted to Micro Enterprises with a CIDB grading of 2 to 4 in the relevant category of works. Only tenderers complying with the requirements as specified in the Conditions of Tender will be considered. The tender will be evaluated according to the preferential procurement model in the Preferential Procurement Policy Framework Act (PPPFA Act 5 of 2000): Preferential Procurement Regulations, 2011 as well as the Supply Chain Management Policy of the Department of Roads and Public Works. The 90/10 preference point system will be applicable with 90 points allocated to Price and 10 points towards B- BBEE Status Level of Contribution. The tenderer s attention is drawn to Form SBD6.1 whereby Tenderers other than EMEs must submit their original and valid B-BBEE status level verification certificate or a certified copy thereof, substantiating their B-BBEE rating issued by a Registered Auditor approved by IRBA or a Verification Agency accredited by SANAS. Failure to do so will result in zero points score for B-BBEE status level. Further, a trust, consortium or joint venture will qualify for points for their B-BBEE status level as an unincorporated entity, provided that the entity submits their consolidated B-BBEE scorecard as if they were a group structure and that such a consolidated B-BBEE scorecard is prepared for every separate tender. Eligibility and Functionality as detailed in Conditions of Tender will apply (see F3.8.1 in Section T1.2: Tender Data). Tenderers are required to demonstrate their ability to undertake the work and provide proof of experience and expertise. Tenders need to meet both the eligibility criteria as well as obtain a minimum score of 60% for Functionality to be considered further. Tenderers may tender for one or more of the contracts. All contracts will be scored separately. Only if the Tenderer has submitted separate suitable Site Agents and OHS Officers for each tender/project, may additional contracts be considered for award to a single tendering entity

7 - 7 - Tenderers should note that this forms part of a batch of tenders for seventeen projects, relating to routine maintenance on paved and gravel provincial roads in the Eastern Cape. Where it is found that a specific tenderer is eligible for award of more than one contract, the employer reserves the right not to award more than two projects (of the seventeen projects) per tendering entity. The Employer further reserves the right not to award one or multiple contracts to any contractor found to be at a high risk of non/underperformance based on a risk assessment of the current workload or past performance of that contractor. Further to the above, and in accordance with the Department s objective of enterprise development, the Employer reserves the right to award a minimum of 30% (6 of the 17 projects) of this group of projects to Contractors with a CIDB grading of 5CE or 6CE depending on the specific Contract grading requirements. The final allocation of Contracts to achieve the objectives mentioned above will also take into account the most economically favourable combination within the group of projects. The successful tenderers must submit a project specific Occupational Health and Safety Plan approved by the Client, within 21 days of being awarded the contract. Tenderers must complete the Compulsory Enterprise Questionnaire (Form T2.2R). Failure to submit will render the tender non-responsive. This condition also applies to all parties involved in a Joint Venture partnership. The successful Tenderer will be required to submit a valid and certified copy of their Letter of Good Standing from the Compensation Commissioner or FEMA within 21 days of receipt of Letter of Award. Tenderers are required to be registered for VAT and must submit an original valid SARS Tax Clearance Certificate with the tender otherwise the tender will be eliminated. This condition applies to all parties involved in a Joint Venture partnership. If the Tender is submitted simultaneously with other Tenders to the Department or the Tenderer has in the recent past submitted an original valid Tax Clearance Certificate that is valid at time of this Tender, then a copy of the original Tax Clearance Certificate must be included with the tender and a cross reference must be made to the Tender containing the original certificate. Failure to provide proof of a valid Tax Clearance Certificate will render the tender non-responsive. Failure to supply all supplementary/clarification information in terms of the PPPFA may result in the tender being deemed an incomplete tender and shall not be considered for award. Penalties will be applied as defined in Clause 5.13 of the Conditions of Contract (GCC 2010). All tenders shall remain valid for a period of 120 days after the tender closing date. The lowest, or any tender will not necessarily be accepted. Telegraphic, telephonic, telex, facsimile, and late tenders will not be considered. The Department of Roads & Public Works will not sign a contract with any service provider before the Registration on the Centralized Electronic Suppliers Database has been confirmed. Infrastructure Needs Tent One (Chamber/House) Frame marque tent with seating capacity of 1200 people which will serve as a Chamber (House). In front of the chairs there will be trestle tables seating 70 MPLS in a demarcated area across, a stage and some isles. This marque should have two (2) glass doors, one (1) door to be used by MPL s and the other for the invited guests. Elevated Flooring and carpeting should be done. In order to comply with Treasury Regulations 16A, the Institution developed a supplier database to be used by the Supply Chain Management Unit when sourcing quotations. The purpose of this database is to give all prospective suppliers an equal opportunity to submit quotations to the Institution and to enhance transparency and equality.
