1 City of RE AGENDA REPORT To: Honorable Mayor and City Council Members From: Steve Kohn, Assistant Planning Director, July 7, 2016 Agenda Item: 8E Motion to Adopt Ordinance No. 99, Fourth Series Approving Proposed Amendments to the Red Wing Zoning Ordinance Creating "Animal Grooming Facility" as a New Use Definition and Allowing the New Use in Several Zoning Districts Meeting Date: July 11, 2016 Attachments Ordinance No. 99, Fourth Series Background On June 27, 2016, the City Council introduced Ordinance No. 99, Fourth Series, which approves a zoning text amendment proposed by Mark and Cindy Woerpel, N5786 County Road J, Ellsworth, WI 54011, and the Red Wing Planning Commission to create a new Zoning use definition for a pet grooming facility, as described below, and to allow the new use in several zoning districts. Animal Grooming Facility An establishment engaged in the grooming and aesthetic enhancement of four or less domestic animals at any given time and that does not include medical or surgical treatment, boarding, breeding, raising, or training services. The proposal would allow the new use in the following zoning districts as a permitted use: Mixed Use Commercial Tourism ( MCT), General Business ( B- 2), Mixed General and Central Business ( B -2A), Central Business ( B- 3), Mixed Use Industrial/ Office Commercial ( MC), Light Industrial ( 1-1), and General Industrial ( 1-2); Conditional Use in the Local Business District ( B- 1). and as a An error in the MC District' s allowed uses section was also discovered during the Planning Commission' s review of Service" is listed as both a Permitted Use and a use requiring the proposal; " Veterinary a Certificate of Compliance. The correct reference is a Certificate of Compliance and is now proposed to be corrected in Division 40.
2 Staff worked with the applicant to create the new proposed use definition and attempted to create a very specific use that only allows grooming on a small scale. No boarding over -night or " doggy daycare") would be allowed. No healthcare services, no training services, and no breeding services would be allowed. A limit of four animals would be allowed on a site at any given time. More intense uses related to animal services would be addressed under the umbrella of a Commercial Kennel or Veterinary Service. The Planning Commission conducted a public hearing regarding the proposal on June 21, No comments were received from the public. Analysis The Planning Commission and City Council shall make findings with respect to the following ( Planning Commission findings are in bold): 1) Whether the amendment is consistent with the Comprehensive Plan. It appears that the proposal is consistent with the Comprehensive Plan. The Comprehensive Plan supports a variety of uses to occur within the community' s identified Activity Centers which emphasize commercial retail and services, institutions, and higher density residential. 2) Whether the amendment is in the public interest and is not solely for the interest of a single property owner. It appears that the proposal is in the public interest. The proposed amendment is intended to allow small animal grooming facilities to be located in multiple commercial, mixed- use, and industrial zoning districts where more intense activities related to Commercial Kennels or Veterinary Services may be objectionable. Planning Commission and Staff Recommendation The Planning Commission unanimously adopted a motion to recommend approval of the proposal as described above and detailed in the attached draft Ordinance No. 99, Fourth Series. Staff recommends a motion to adopt Ordinance No. 99, Fourth Series, as presented.
