3 KG BP3: Briefs Kogi is implementing the Private Sector Participation (PSP) policy for the first time during the GYB administration through the landmark establishment of the State Bureau for Public Private Partnerships (B P3). The Bureau is mandated under the Kogi State Public Private Partnership (PPP) Law (2014), to implement the administration epoch-making PSP and PPP funding paradigm that will expectedly contribute about 40% of total investment requirement to fund the private and public sector streams of the administration Development Blueprint, between The Bureau is presently operating from a temporary location in the New Block of the SSG s Office aside from the Office of the HC for Finance,.

4 KG BP3: Briefs The Bureau is presently structured and operating under 5 Departments including Legal, Risk Management, Communication and Information Technology, Infrastructure and Contracts as well as Administration and Finance. As a strategic implementation approach, the Bureau has established through the HOS, Heads of MDAs, and Local Government Department. Desk Offices with competent posting of over 70% Desk Officers has been achieved already. The Bureau has finally commenced solicitation for EOIs for selected State Assets with new PPP initiatives. The Bureau is looking forward to the formal Launch of the State PPP Pipeline projects across the sectors A full list of statutorily designated State PPP infrastructure and Assets will be published end Q2, 2017 Desk Officers are the liaisons between the MDAs and Bureau for PPP-flavored investment proposals from Line MDAs. Generally, PPP Investment proposals are also expected from the Office of HE, the State Economic and Investment Team, the Bureau and other Sources. (See Kogi State PPP Procurement Governance Process)

5 KG BP3: Briefs Desk Officers are also expected across the LGCs as the Bureau looks to domesticating the State PPP Law to that all-important tier of government in the medium to long term. This action will revolutionize the LGs development drive and ensure PSP and LG PPPs with its attendant benefits, under Bureau s strict guidance. There are however, contingent responsibilities across board to make the administration's widely applauded policy succeed through the principle of common but differentiated responsibilities exhibited through: i. Adherence to the State PPP Law 2014 ii. Adherence to the State PPP Procurement Governance and Public Procurement Laws iii. Inter-MDA synergy

6 Achievements- March 2016 to Date Establishment of Bureau s 5 nos Directorate architecture achieved Establishment of Desk Offices across MDAs and the Department of LG&CA (attached) Attainment of 65% posting by MDAs of critical Desk Officers PPP Sensitization and capacity building outreach for Desk Officers, Permanent Secretaries and Directors, Hon. Commissioners and other Political Appointees achieved PPP Cross Sector strategy development meeting agenda developed. Local Government, Education, Transport, Tourism and Agric. sector PPP STRATEGY development at advanced stage Peer review visit to Kaduna, Ekiti States achieved. Kogi State is highly rated as a PPP participating State First State open Government to Business Sector consultative meeting held with formal presentation of the GYB Development Blueprint to the OPS for support. Kogi State Business and Innovation Desk established to provide the platform for innovation to business and entrepreneurial opportunities More than 60 potential investors are currently being processed across different sectors with outline and full business case certificates due for issue after HE s statutory approval.

7 Achievements- March 2016 to Date Movement to a working Office Space achieved Procurement of start-up work tools/furniture achieved (attached) Outline and full Business Cases developed for 3 investment proposals Outline and full Business Case Compliance certificates issuance commenced Partnership for investment mobilization established with Arewa Youth Consultative forum Kaduna, Kogi Diaspora Foundation Kano, USA. State PPP Guideline, Procedures and Screening Template in place Capacity Building for Desk Officers, Directors and Ag. Permanent Sec. including some Political Appointees and Honourable Commissioners. LG sector PPP Desk Office established at Dept. of LG&CA; Desk officer nominated and posted More than 60 potential investors are currently being processed across different sectors with outline and full business case certificates due for issue.

8 Achievements- March 2016 to Date Collaboration visit to the ICRC, AfDB, UNIDO, NIAF to ganner support for the newly established B P3 with promising results. 3 NO State Infrastructure and Asset currently under solicitation for EOIs, namely Confluence Beach Hotel, Lokoja Mega Bus Terminal and a State of the art multi-functional Business Mall. No Objection (NO) for the MoE&NR to solicit for Expression of Interest (EOIs) for 3No Environment sector PPPs No Objection Declined to MoE&NR for 4No Environment sector EOIs solicitation bid. The Ministry was advised to consider traditional procurement method in the instance. Technical and financial Closure achieved for Franchise management of Confluence Express Service and awaiting transaction agreement signing and Flag off. Ticketing should commence at the Terminal before end of Q 1 Ticketing Plan for Concept note for 30year State PPP Infrastructure Master Plan development finalization ongoing

9 Challenges Understanding and Support by MDAs to deepen and consolidate the substantive PPP framework (Kogi State PPP Law, 2014, Procedures) using the PPP national and global best practices. This include Executive buy-in to the Bureau s comprehensive menu of actions to drive and offer coherent and consistent PPP engagement procedures. Constitution and inauguration of the Bureau Board, to advance efforts and mechanisms that will ensure strict policy development, implementation and guidance to the Bureau Logistics support in terms of vehicles and funding to meet increasing need to convey potential investors to project sites for inspection, due diligence, etc.

11 Lessons Learned MDAs and all administration stakeholders need a greater understanding that PPPs require a complex functional and transaction execution skill sets which is still being built in the state MDAs. These have been a key constraint in the PPP procurement process. Successful PPPs involve finite and structural processes, procedures and guidelines throughout the project life cycle. PPPs are able to bring much needed investment/financing for supporting the attainment of the objectives of the State development Blueprint, in the initiation, planning, procurement and execution of the PPPs. The process is also building the much needed technical capacity in transaction completion. Social and environmental priorities can be achieved under PPPs whilst meeting government broader economic development objectives within financial viability parameters

12 Next Steps Progressive MDAs, Stakeholders sensitization, training and advocacy visits Movement to appropriate Office space and provision of tools for official transactions Procurement of official vehicular needs to facilitate strategic and critical follow up of bureau transactions within and outside Lokoja, ensure Kogi PPP visibility in appropriate cycles for the needful impact. Deployment of Consultants for necessary Project Development Studies, including State Infrastructure Master Plan Inauguration of the Board of the Bureau PPP Law Domestication for Local Government PPPs enablement Engagement with Line Ministries for Sector Strategy documents Technical and Financial Closure of the concession of Greater Lokoja Water works Progress to stage 2 of RFP and RFP on the concession of the CBH, LMBT and State of the Art Lokoja MALL Completion of Enumeration task for the water users in Lokoja Urban

13 Next Steps Development of Private Sector led Site and Services Scheme for identified Dormant Layouts in Metropolitan Lokoja Delineation of PPP Sites/Lands for potential investors Designation of State PPP Infrastructure and Assets Nomination and inauguration of State PPP Champions and Ambassadors. List is been finalized. Approval for Bureau by HE to deploy Statutory revenue streams Updates of Kogi State PPP Guidelines, Procedures and Master Plan Continuous Capacity Building for Desk Officers, Directors and Permanent Secretaries, the Legislature and All Political Appointees Urgent State PPP External experience sharing visits to selected Asia Countries (India and Bangladesh), Capacity Building and training by the Bureau select MDAs, Commissioners and the Legislature. This is planned for the 2 nd Quarter.
