1 Emergency Management Plan Terrorism Response Annexure

2 PURPOSE: The purpose of this document is to support the 2008 History Alive Festival policy of preparing for, and responding to any and all threats to the patrons and community members. The specific focus of this document is to address potential and actual terrorist events. It augments HAF s current Emergency Policy as well as the Emergency Management Plan, which guides the overall response to emergencies and disasters. This document will provide planning guidance for: The integration of federal, state and local government as well as private business into a cohesive terrorism response organisation at a local level; The identification of terrorism response planning requirements and shortfalls; The development of terrorism response plans and procedures; and The identification of training needs and requirements to support terrorism efforts. This document is created pursuant to the Commonwealth National Counter-Terrorism Plan.

3 SCOPE: This document provides direction to 2008 History Alive Festival stakeholders involved in protecting the public, and preparing and responding to terrorist events. It is also intended to specifically clarify the roles and relationships between all stakeholders at a local, state, commonwealth and private sector agencies in dealing with the threat or actual occurrence of terrorism or an act of mass violence. This document builds upon the existing concepts of operations by addressing the unique authorities, responsibilities, assumptions, situations, and concept of operations that will be applied for crisis and consequence management as necessary. A terrorist act is defined under Australian law as an act or threat, intended to advance a political, ideological or religious cause by coercing or intimidating an Australian or foreign government or the public, by causing serious harm to people or property, creating a serious risk to the health and safety to the public, or seriously disrupting trade, critical infrastructure or electronic systems. (Criminal Code Act 1995 (Cwlth) A terrorist incident is a combination of circumstances or conditions which may lead to or result from a terrorist act, and which require preventative and/or responsive action. (Commonwealth National Counter Terrorism Plan) In the event of a terrorist act or incident the Chief Warden will defer all command and control to the senior Queensland Police Service officer upon their response and to render any and all assistance as requested.

4 RESPONSIBILITIES: The Australian Government: maintains counter-terrorism capabilities within the agencies listed; maintains national counter-terrorism and related policies, legislation and plans; determines Australian Government prevention strategies and Australian Government operational responses to threats; supports the States and Territories in responding to terrorism within their jurisdictions; leads the management of intelligence; determines and promulgates the national counter-terrorism alert level; where appropriate, in the event of terrorist incident or threat, declares a National Terrorist Situation, with the agreement of the affected States or Territories; and in a National Terrorist Situation, determines policy and broad strategies in close consultation with affected States or Territories. The State and Territory governments: maintain counter-terrorism and related policies, legislation and plans within their jurisdictions; maintain counter-terrorism and consequence management capabilities in the agencies listed; have primary operational responsibility to respond to terrorist incidents within their jurisdiction; determine prevention strategies and operational responses to threats; may seek assistance from, or provide assistance to, other jurisdictions;

5 in the event of a terrorist incident or threat, actively consider the requirement for the declaration of a National Terrorist Situation; and in a National Terrorist Situation, contribute to the national strategy. Within this inter-governmental framework, the following bodies have significant responsibilities for strategic-level coordination of counter-terrorism policy and related security response.

7 The above two diagrams are taken from the Commonwealth National Counter Terrorism Plan, and they illustrate the inter-jurisdictional interaction with respect to responding to the threat or actual occurrence of terrorism.

8 In an endeavour to best prepare and respond to the threat of a terrorist act or terrorist incident at the 2008 History Alive Festival, it is advisable that current National Threat Level be assessed in accordance with intelligence reports and information gleaned from various agencies. ASSUMPTIONS: The following assumptions have been considered in the development of this document: a) A terrorist incident may be made readily apparent to the responding agencies by the characteristics, impact or a declaration on the part of the organisation/group/person committing the act; or it may be very difficult to initially detect and identify because of the uncertainty as to the cause or extent of the situation; b) Hoaxes regarding terrorist events can occur and rumours amongst the community and staff are possible; c) The characteristics of a terrorist incident will vary. It may well be a hoax, a threatened incident that has not yet occurred, a single-event emergency situation that has ended or a continuing event of unknown duration and extent; and d) Secondary explosive, chemical, biological and although unlikely in Australia nuclear devices that could be placed at the scene of a terrorist incident to intentionally endanger emergency response personnel, damage response resources, disrupts response operations, results in additional victims or cause further damage. A terrorist incident could involve hostages, gunfire or other situations that must be resolved prior to initiating all or part of the emergency response; The resources and/or expertise of the 2008 History Alive Festival and local community could quickly be depleted by a response to a terrorist

9 incident. Therefore the principles of the Queensland Government s Department of the Premier and the Cabinet s Guidelines for Critical Infrastructure Protection together with the Commonwealth of Australia s National Counter Terrorism Plan incorporate agreed state and federal response; Specialised resources, as well as those normally utilized in disaster situations, will be needed to support a response to a terrorist incident. Such resources may not be located in the local environs; Resources from local, state and federal agencies as well as from other government and non-government agencies, will be made available on a timely basis upon request; and Any response to a terrorist incident will be in accordance with the Queensland Government s Department of the Premier and the Cabinet s Guidelines for Critical Infrastructure Protection together with the Commonwealth of Australia s National Counter Terrorism Plan, which may require partial or full evacuation form the festival site(s). The evacuation is to be conducted in accordance with the 2008 History Alive Festival s Emergency Management Plan

10 Agency roles and Responsibilities States Department of Communities assist individual and community recovery through the coordinated provision of emergency and ongoing assistance. Department of Transport maintains standards for the security and transport of dangerous substances. They also are responsible for coordinating surface transport operations and ensuring the implementation of security arrangements for those operations that are security identified. Department of Emergency Services provide consequence management in the event of a terrorist incident, consistent with State and Territory plans and structures. Department of Main Roads and Department of Public Works assist the recovery of physical infrastructure. Department of the Premier and the Cabinet coordinates the whole of government preparedness and response. Department of Health participates in the development and maintenance of biological hazard plans; provide hospital treatment and on-going care for victims. Queensland Police Service has operational responsibility for preventing and responding to terrorism and will investigate terrorist activity, threats and incidents. Australian Government Air services Australia provides air traffic management, air navigation infrastructure services and aviation rescue and fire fighting. Attorney-General s Department provides legislative advice, and policy coordination of critical infrastructure protection, including national information infrastructure. The PSCC and EMA are divisions of the department.

11 Australian Customs Service facilitates and monitors the movement of people and goods across the border in a manner that protects the community, intercepts prohibited and restricted items, identifies illegal movement of people and maintains compliance with Australian law. Australian Defence Force maintains capabilities to assist civil authorities in emergencies under Defence Assistance to the Civil Community and Defence Force Aid to Civilian Authorities arrangements (Part IIIAAA of the Defence Act 1903). DACC and DFACA may apply when a specific threat or incident is beyond the capabilities of the civil authorities. DACC applies where the use of force is not envisaged; DFACA, where force may be required. Call-out under DFACA must be authorised by the Governor-General, on the advice of the Federal Executive Council. Australian Federal Police investigates Australian Government terrorist offences, is Australia s international law enforcement representative, provides protective services and performs a state policing function in the ACT. The AFP also provides physical protection services and counter-terrorism first response, and the Australian Bomb Data Centre, which collects data and advises on the illegal use of explosives. Australian Radiation Protection and Nuclear Safety Agency is responsible for protecting the health and safety of people, and the environment, from harmful effects of radiation. Australian Safeguards and Non-proliferation Office, within DFAT, regulates nuclear safeguards within Australia to ensure that Australia meets nonproliferation and security treaty commitments and implements the Chemical Weapons Convention and Comprehensive Test Ban Treaty. ASNO is also involved in the development of domestic verification arrangements for the Biological Weapons Convention.

12 Australian Secret Intelligence Service obtains intelligence on the capabilities, intentions and activities of people or organisations outside Australia. Australian Security Intelligence Organisation is the national security intelligence body and the authority for assessing threats to security. It collects analyses and distributes relevant intelligence. It manages the National Intelligence Group during an incident and maintains a Technical Support Unit to provide technical intelligence to police or the ADF at the scene of a terrorist incident and the National Threat Assessment Centre (NTAC). Civil Aviation Safety Authority conducts the safety regulation of civil air operations in Australia and the operation of Australian aircraft outside Australia under the Civil Aviation Act Department of Communications, Information Technology and the Arts is responsible for regulating elements of the communications sector, including interception, radio spectrum and submarine telecommunications cables. Department of Foreign Affairs and Trade conducts international liaison that seeks to enhance international counter-terrorism arrangements and provides advice in relation to the protection of foreign dignitaries and ensures appropriate consultation with their governments. Department of Health and Aging maintains stockpiles of antidotes and vaccines and plans for dealing with disease outbreaks. Department of Immigration and Multicultural and Indigenous Affairs maintains the Movement Alert List and administers Australia s visa regime. Department of Industry, Tourism and Resources has particular policy responsibility for offshore petroleum infrastructure and installations and a strong coordinating role with respect to onshore energy infrastructure.

13 Department of the Prime Minister and Cabinet advises the Prime Minister on matters relating to countering terrorism, coordinates Australian Government policy responses to terrorism, chairs the NCTC, participates in risk management decisions on dignitary protection and provides the secretariat for SCNS and NSC. Department of Transport and Regional Services coordinates national transport security policy and provides advice on the impact of security developments on the transport industry. It also regulates the security of airports, airlines, sea ports and, with State and Territory authorities, other forms of transport. DOTARS also works with the States and Territories to develop national standards for the regulation of other forms of transport. Emergency Management Australia coordinates emergency and consequence management assistance to States and Territories and maintains the Crisis Panel of Experts and a reserve of equipment. Joint Offshore Protection Command is a combination of ADF and Customs assets, is responsible for the implementation, coordination and management of offshore maritime security. Office of National Assessments provides intelligence assessments on terrorist activities outside Australia. National Office of the Information Economy contributes to the protection of the national information infrastructure. Protective Security Coordination Centre, a division of AGD which coordinates protective security and counter-terrorism arrangements between Australian Government, State and Territory agencies and channels communications between the Australian Government, States and Territories during an incident.

14 CRISIS AND CONSEQUENCE MANAGEMENT Overview The Commonwealth of Australia s National Counter Terrorism Plan introduces two terms unique to terrorism to the emergency management field: Crisis Management and Consequence Management. Crisis Management is how History Alive Festival, Sunshine Coast Regional Council, the State of Queensland and the Commonwealth Government would respond to potential of actual effects of terrorism, whilst Consequence Management relates to the response with respect to emergency and medical services, contamination etc. Response Actions The following is taken directly from the Commonwealth of Australia s National Counter Terrorism Plan (Page 4:2) 69. The ramifications of any terrorist incident will necessitate high level decisionmaking within the Australian Government, States and Territories, taking into account public anxiety and any international dimension of the incident. The scale or complexity of the incident may also dictate special cooperative responses. Throughout the response, minimising loss of life, preventing further incidents and recovery are primary goals. 70. State and Territory governments and their agencies are responsible for the operational response to a terrorist incident in their jurisdiction. This response is in cooperation with Australian Government agencies as appropriate. Operational responses to terrorist incidents will largely replicate responses to other criminal acts or disasters.

15 71. The circumstances of a terrorist incident will determine whether or not it is declared a National Terrorist Situation. Operational arrangements 72. Police and other emergency services will respond first to an incident, which may subsequently be identified as the result of a terrorist act. As soon as there is a reasonable suspicion that the incident is terrorism related, police will assume control and notify the PSCC. At locations where the AFP maintains or has in place a CTFR capability, the first response will be provided by attending Protective Service Officers until incident control can be passed to attending Police. 73. A Police Forward Command Post, under the control of a Police Forward Commander, may be established where an incident site has been identified. Other responding services will work closely with the Police Forward Commander. 74. The Police Forward Commander in conjunction with emergency services, will seek to minimise loss of life and further risk to the community, and will manage the on-site investigation. To this end, the Police Forward Commander will, in accordance with local procedures, exercise control over, and share information with, other responding services and agencies. 75. The Police Forward Commander reports to the Police Commander who will establish a Police Operations Centre (POC). The POC will draw upon liaison staff and other specialist support as necessary to manage the overall incident and investigation.

16 76. Other consequence managers must take police operational requirements into account when protecting public health and safety, restoring essential services and providing emergency relief to individuals. 77. A Joint Intelligence Group will be established by the responsible State/Territory in support of the POC to provide all possible intelligence support to operational commanders and will include at least ADF, AFP and ASIO liaison officers. 78. The Australian Government may also provide other operational support from agencies such as ASIO, AFP, ADF (under DFACA or DACC arrangements), DIMIA, DOTARS, ARPANSA and Customs. In view of this, should a terrorist incident take place at the 2008 History Alive Festival, then the Chief Warden will refer command and control of the emergency situation to the most senior Queensland Police Officer. Furthermore, if deemed necessary the Chief Warden will execute the festival Emergency Management Plan and evacuate the site. The Chief Warden will remain at the site until advised otherwise, to render any and all assistance required in compliance with the Commonwealth of Australia s National Counter Terrorism Plan.

17 The following table provides generic guidelines for suggested security considerations aligned with the National Counter-Terrorism Alert Level. These guidelines are not exhaustive, but they do form a basis for further security measures to be implemented by the 2008 History Alive Festival. LOW Alert Level Identify the risks associated with the normal business operating environment, for example natural disasters and accidents. Ensure a security audit is undertaken and security plans are developed. Establish and communicate risk management philosophy and articulate the level of acceptable risk, beyond which risk must be managed. Employ standard security measures. Ensure Business Continuity Plan has been developed. Report unusual activity or phone calls to police. Have the necessary systems, plans and processes in place to respond to increased levels of risk or threats. Ensure police are updated with after-hours contact details of key personnel. Detect security breaches within 48 hours. MEDIUM Alert Level Includes considerations for Low plus: Reinforce security practices and policies. Increase vigilance using existing resources. Activate warning system, including notifying key personnel of the increase in the Alert Level. Establish contact with local people. Pay particular attention to abandoned packages or unusual articles.

18 Have the necessary systems, plans and processes in place to respond to increased levels of risk or threats. Identification checks on entry and exit points; visitors to be escorted. Ensure Business Continuity Plan has been tested and apparent shortfalls rectified. Detect security breaches within 24 hours. HIGH Alert Level Includes considerations for Low and Medium plus: Deploy additional security resources, particularly on entry/exit points. Compulsory identification of staff and visitors at all times. Activate operations centre as required and consider preliminary activation of the Business Continuity Plan. Heightened alert to unattended vehicles and equipment external to premises. Screening of packages, mail deliveries and external deliveries to facility. Facilitate closer liaison with police and emergency services. Have necessary systems, plans and processes in place to respond to increased levels of risk or threats. Detect security breaches within 12 hours. EXTREME Alert Level Includes considerations for Low, Medium and High plus: Continuous patrols of critical assets. Restrict access to essential personnel only. Deploy resources to provide constant monitoring and guarding. Implement perimeter security and restrict parking in the near vicinity. Activate operations centre on a 24/7 basis.
