Development Quality Manager Reasons for Refusal 1. The height of the proposed turbine is not considered to relate to the surrounding landscape it is therefore considered to be visually dominant and would have an adverse impact on the visual amenity of the area which would be contrary to Environment and Resources Policy 14 of the Perth and Kinross Structure Plan, Policy 1 of the adopted Perth Local Plan 199 as well as Scottish Planning Policy and Planning Advice Note 45: Renewable Energy Technologies. 2. That approval of this application would establish a precedent for developments of a similar nature to the detriment of the overall character of the area which would undermine and weaken the established Development Plans and supplementary planning guidance. 799

5 REPORT OF HANDLING DELEGATED REPORT Ref No Ward No 10/00674/FLL N8 PROPOSAL: LOCATION: APPLICANT: Installation of 22kW Hannevind wind turbine West Blair Glenfarg Perth PH2 9QW Mr Alistair MacLean RECOMMENDATION: Refuse the application SITE INSPECTION: 26 May 2010 OFFICERS REPORT: Sections 25 and 37(2) of the Town and Country Planning (Scotland) Act 1997 require that planning decisions be made in accordance with the development plan unless material considerations indicate otherwise. The adopted development plans that are applicable to this area are the Perth and Kinross Structure Plan 2003 and the Perth Area Local Plan This application is for the erection of a 22 kw Hannevind wind turbine at Westblair Glenfarg which has a hub height of 24.5m. The site is located in the open countryside on the ridge of Blair Hill. A body of water is located to the west while a standing stone is located to the South. The determining issues in this case are whether: - the proposal complies with development plan policy; the proposal complies with supplementary planning guidance; or if there are any other material considerations which justify a departure from policy. Environment and Resources Policy 14 of the Perth and Kinross Structure Plan is supportive of renewable energy schemes subject to a number of criteria being met. Two of the criteria against which such schemes are to be assessed are the immediate and wider impact of the proposal on the landscape and wildlife resource and the cumulative effects of similar developments on the wider area. The reasoned justification for the policy makes clear that such developments, especially on a large scale, may have significant local impacts on the environment. Additional information and advice on the technologies for harnessing renewable energy is contained in Planning Advice Note 45: Renewable Energy Technologies, the appropriate Local Plan policy is Policy 1: Landward Area. Micro-wind turbines must be erected in a manner that keeps the environmental impact to a minimum whilst still ensuring they provide sufficient power. Sensitive siting and design can reduce visual intrusion and play a part in making these installations an accepted feature. In this case the main factor in the determination of the application is the potential impact on the landscape. Particular care is required to 801

6 ensure a balance is struck between height requirements and the visual prominence of the turbine in relation to existing buildings and surrounding landscape features. Having had the opportunity to undertake a site visit and view the site from surrounding vantage points I consider that the erection of this structure which has a blade tip height of 31.2m to have an adverse impact on the open landscape, especially due to its location at the summit of the hill contrary to Environment and Resources Policy 14 of the Perth and Kinross Structure Plan and policy 1 of the adopted Perth Area Local Plan. While the proposal would contribute to the aim of the Scottish Government to increase the amount of electricity generated from renewable energy sources, that aim is subject to a number of caveats. PAN 45 (revised 2002): Renewable Energy Technologies makes clear (paragraph 78) that developers should seek to ensure that, through good siting and design, landscape and visual impacts of wind turbines are limited and appropriate to the location. Overall I am satisfied that the proposal would result in an unacceptable impact on the existing landscape character and visual amenity of the area and that it offends Environment and Resources Policy 14 of the Perth and Kinross Structure Plan as well as Policy 1 of the adopted Perth Local Plan 1995, Scottish Planning Policy and Planning Advice Note 45: Renewable Energy Technologies. The recommendation in this report for refusal of this application has potential implications for the applicant s Human Rights in terms of his entitlement to peaceful enjoyment of his possessions (First Protocol, Article 1). For the reasons referred to elsewhere in this report justifying the present recommendation in planning terms, it is considered that any actual or apprehended infringement of such Convention Rights, is justified. Any interference with the applicant s right to peaceful enjoyment of his possessions by refusal of the present application is in compliance with the Council s legal duties to determine this planning application under the Planning Acts and such refusal constitutes a justified and proportionate control of the use of property in accordance with the general interest and is necessary in the public interest with reference to the Development Plan and other material planning considerations as referred to in the report. DEVELOPMENT PLAN Policy 01: Perth Area General Policies Developments in the landward area, as shown in Proposals Map A on land which is not identified for a specific policy, proposal or opportunity will generally be restricted to agriculture, forestry or recreational and tourism projects and operational developments including telecommunications development for which a countryside location is essential. Developments will also be judged against the following criteria:- The site should have a good landscape framework within which the development can be set and, if necessary, screened completely. In the case of built development the scale, form, colour and design of development should accord with the existing pattern of building. The development should be compatible with its surroundings in land use terms and should not cause unacceptable environmental impact. 802

7 The local road network should be capable of absorbing the development and a satisfactory access onto that network provided. Where applicable, there should be sufficient spare capacity in local services to cater for the new development. The site should be large enough to accommodate the development satisfactorily in site planning terms. 16 Technology & security Technical description of Hannevind s wind power stations. The 5,5-45kW wind power stations utilizes a motor to follow the wind direction. The power stations are three bladed and attached to the gearbox s main axle via a hub which was developed by Hannevind. The generator is asynchronous, meaning that when a power interruption occurs, the power station loses its magnetism and therefore its ability to deliver power. This protects line personnel from turbine generated power in the event of an outage. This also causes the brakes to activate and prevents the turbine from overrunning and causing damage. Apart from power interruption there are additional protections which stop the turbines when, for example, imbalance or storms occur. During normal operation in wind velocity up to m/s, the turbine performs normally, and when the wind increases over these values it is yawed out of the wind approximately 45 degrees, but continues to deliver power. In this situation, the wind is measured at 15 minute intervals, and if peaks exceeding the specified values continue to be measured, the power station remains in this position. If the wind decreases, the power station is yawed toward the wind again. At wind velocity over 18-20m/s the power station is yawed 90 degrees out of the wind and is shut down with the brakes. This is controlled by a computer which is preprogrammed for standard wind conditions, but also easily can be adjusted to customer specific parameters. Surpluses of the energy can be used to heat water or can be sold to your electricity supplier. Hannevind wind turbines which are connected to the power grid are always connected on the customer s side of the electricity meter. As soon as the rotor reaches the correct rotating speed, it begins to deliver electricity proportional to the wind velocity

17 Requirements for a successful result Requirements for a successful result Yearly average wind speed of 5-6m/s. No physical obstructions to the wind s flow. Appropriate distances from neighbors. Soil conditions which are appropriate for constructing the foundation of the wind power station. It is incumbent upon the customer to conduct the soil assessment and calculate the concrete foundation. Approval of the utility owner for the connection, to ensure that the cable/ wire gauge capacity is adequate for the wind power stations output
