SAM KMN September 15, 217 JOINT PUBLIC NOTICE U.S. ARMY CORPS OF ENGINEERS MISSISSIPPI DEPARTMENT OF ENVIRONMENTAL QUALITY OFFICE OF POLLUTION CONTROL MISSISSIPPI DEPARTMENT OF MARINE RESOURCES DMR-1835 PROPOSAL TO CONSTRUCT BELLE FONTAINE SUBDIVISION, OCEAN SPRINGS, JACKSON COUNTY, MISSISSIPPI TO WHOM IT MAY CONCERN: This District has received an application for a Department of the Army (DA) permit pursuant to Section 44 of the Clean Water Act. Please communicate this information to interested parties. APPLICANT: Mr. Fred Moran 712 Washington Avenue Ocean Springs, Mississippi AGENT: Mr. Dana R. Sanders, Jr East Central Park Drive Moss Point, Mississippi WATERWAY: Graveline Bayou, Section 6, Tonship 8 South, Range 7 West, Ocean Springs, Jackson County, Mississippi (Latitude North, Longitude West). The area is depicted on the MS-GAUTIER NORTH Quadrangle, United States Geological Survey Topographic Map, Hydrologic Unit Code WORK: The applicant is requesting a DA Permit for permanent impacts to acre of jurisdictional etlands for the construction of a residential subdivision (Belle Fountaine Subdivision). The applicant is proposing to build 82 residential home lots on a acre site. The acre site contains approximately acres of pine savannah etlands. Wetlands on the site drain to the southeast into Graveline Bayou hich flos southeastard into the Mississippi Sound. The proposed project ould consist of access roads originating from Belle Fountaine Road and Fountainbleau Road, internal streets, utilities, curbs, and a detention pond.

2 CESAM-RD-M September 15, 217 SAM KMN Page 2 of 4 EXISTING CONDITIONS: The acre site is undeveloped and vegetated ith sparse trees and dense shrub stratum. The site is located at the southest corner of Belle Fountaine Road and Fountainbleau Road. Graveline Bayou is located southeast of the project site. The site is located approximately 1.5 miles south of Highay 9. The site is bordered to the east by Belle Fountaine Road, to the north by Fountainblue Road, and to the est and south by Oakleigh Circle. PROJECT PURPOSE: Development of a single family residential subdivision. AVOIDANCE & MINIMIZATION: As part of their avoidance measures, the applicant evaluated four different properties as possible locations for the proposed development. The applicant considered several on-site alternatives regarding lot layouts. The applicant is proposing to impact all etlands located on the project site. During construction the applicant proposes minimiation of etland impacts through use of best management practices to ensure that additional etlands outside the project footprint not be affected. The U.S. Army Corps of Engineers (USACE) has not verified the adequacy of the applicant s avoidance and minimiation at this time. MITIGATION: The applicant proposes to mitigate for unavoidable impacts to jurisdictional etlands through the purchase of mitigation credits from a etlands mitigation bank approved by the Mobile District, USACE. USACE has not verified the adequacy of this mitigation proposal at this time. USACE initially determined the basic project purpose is construction of a single family residential subdivision. The project as proposed ould not be considered a ater dependent activity. Additional revies ill be performed by the U.S. Army Corps of Engineers (USACE) and cooperating agencies. The applicant has applied for certification from the State of Mississippi in accordance ith Section 41(a)(1) of the Clean Water Act and upon completion of the required advertising; a determination relative to certification ill be made. The applicant has applied for coastal one consistency from the State of Mississippi Department of Marine Resources in accordance ith Section of the Mississippi Code Annotated. This public notice is being distributed to all knon interested persons in order to assist in developing facts on hich a decision by USACE can be based. For accuracy and completeness of the record, all data in support of or in opposition to the proposed ork should be submitted in riting setting forth sufficient detail to furnish a clear understanding of the reasons for support or opposition. The decision hether to issue a permit ill be based on an evaluation of the probable impact, including cumulative impacts, of the proposed activity on the public interest. That decision ill reflect the national concern for both protection and utiliation of important resources.

3 CESAM-RD-M September 15, 217 SAM KMN Page 3 of 4 The benefits, hich reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors, hich may be relevant to the proposal, ill be considered, including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, etlands, cultural values, fish and ildlife values, protected species, flood haards, flood plain values, land use, navigation, shoreline erosion and accretion, recreation, ater supply and conservation, ater quality, energy needs, safety, food production and in general, the needs and elfare of the people. USACE is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received ill be considered by the USACE to determine hether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, ater quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Any person may request, in riting, ithin the comment period specified in this notice, that a public hearing be held for consideration of this application. Requests for public hearings shall state ith particularity, the reasons for holding a public hearing. Evaluation of the probable impacts involving deposits of dredged or fill material into aters of the United States ill include the application of guidelines established by the Administrator of the U.S. Environmental Protection Agency. In accordance ith Section 16 of the National Historic Preservation Act and Appendix C of 33 CFR 325, the undertaking defined in this notice is being considered for the potential to effect cultural and historic properties ithin the permit area. We are seeking comment from the State Historic Preservation Officer regarding the existence or the potential for existence of significant cultural and historic properties ithin the permit area. In accordance ith Appendix C of 33 CFR Part 325, USACE has determined that the project as proposed ould have no effect. In a letter dated August 23, 217, the Mississippi Department of Archives and History (Project Log # ) stated that no cultural resources are likely to be affect by the proposed project. The U.S. Army Corps of Engineers (USACE) ill consult ith the State Historic Preservation Officer to make a final determination based upon this revie unless comment to this notice is received documenting that significant sites or properties exist hich may be affected by this ork or that adequately documents that a potential exists for the location of significant sites or properties ithin the permit area. Preliminary revie of this application and the U.S. Department of the Interior List of Endangered and Threatened Wildlife and Plants indicate that the proposed activity may affect, but is not likely to adversely affect the Mississippi Sandhill Crane (Grus Canadensis pulla) as the project site is located in the Mississippi Sandhill Crane Consultation Zone. The applicant stated that site reconnaissance as conducted in July 217, to assess on-site habitat types. Site reconnaissance indicated that suitable habitat does not currently exist on-site for any of

The proposed activity should have no effect on the remainder of endangered or threatened species listed for Jackson County.
