A water quaity certification is required in accordance with statutory authority contained in the Louisiana Revised Statutes of 1950, Tite 30, Chapter 11, Part V, Section 2074 A(93) and provisions of Section 401 of the Cean Water Act (P.L ). Comments concerning the appication can be fied with the Office of Environmenta Services within 20 days of this notice to the foowing address: Office of Environmenta Services, Post Office Box 4313, Baton Rouge, Louisiana The Louisiana Department of Environmenta Quaity has additiona information on fie in their office in Baton Rouge which may be inspected at any time between 8:00 a.m. and 4:30 p.m. weekdays. Copies may be obtained from the Louisiana Department of Environmenta Quaity upon payment of cost of printing. Law Requiring a Permit: Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403), which appies to structures or work in navigabe waters of the United States, and Section 404 of the Cean Water Act (33 U.S.C. 1344), which appies to discharges of dredged or fi materia into waters of the United States. 2 Location of Work: Section 1, T20N-R1W, within the Bayou D'Arbonne drainage basin, Union Parish, Louisiana. Description of Work: (See encosed map and drawings.) The foowing description of the proposed project and associated impacts are based upon information provided by the appicant. The appicant is appying for a Department of the Army permit for the discharge of dredged and/or fi materia associated with recaiming eroded waterfront. Foey Beach Deveopment, LLC is proposing an acre deveopment consisting of a dock, marina, bait shop, restaurant, condominiums, and a waterfront hote. The appicant proposes to mechanicay dredge, via an excavator, approximatey 12,250 cubic yards of sit/sand from the bottom of Lake D' Arbonne. The dredged materia woud be deposited aong the adjacent, nonwetand existing water ine for recamation. After approximatey 50-70% of the materia has been paced in the fi area, a bukhead, constructed of composite sheet pies and timbers, composite decking, and hot dipped gavanized hardware woud be instaed aong the ength of the fi area. The bukhead woud run west to east approximatey 950 feet and woud be instaed 50 feet off of the existing water ine. Dredged materia woud be paced on the eastern side of the bukhead and protect the fied area from further erosion unti the area has been fied to the required eevation. Approximatey 12,250 cubic yards of ake bottom sit/sand woud be used a fi materia. Approximatey 3.81 acres of other waters woud be fied. The appicant proposes to mitigate for a jurisdictiona impacts by purchasing credits from an approved mitigation bank. The pacement of dredged and/or fi materia in waters of the United States, requires a Department of the Army Permit. Upon reviewing this notice, you shoud write to this office to provide your opinion of the impacts this work wi have on the natura and human environment, and address any mitigation you beieve is necessary to offset these impacts. Other comments are wecome, but the above information wi further our review of the appicant's pan, as proposed. CommentS of a genera nature are not as hepfu as those specific to the impacts of the subject project. State Water Quaity Permit: The State Poution Contro Agency must certify that the described work wi compy with the State's water quaity standards and effuent imitations before a Corps permit is issued. 2

3 Cutura Resources: The Reguatory Archaeoogist has reviewed the atest pubished version of the Nationa Register of Historic Paces, ists of properties determined eigibe, and other sources of information. The foowing is current knowedge of the presence or absence of historic properties and the effects of the proposed undertaking upon these properties: The permit area was created in modern times and has had no human habitation: therefore, itte ikeihood exists for the proposed project to impinge upon a historic property. Copies of this pubic notice have been sent to the State Historic Preservation Officer, Federay Recognized Tribes, and other interested parties for comment on potentia effects to historic properties that coud resut from the proposed activity. Endangered Species: The foowing threatened or endangered species are known to preside in Union Parish: Red-cockaded woodpecker (E). This proposa is being coordinated with the U.S. Fish and Widife Service, and any comments regarding endangered species or their critica habitat wi be addressed in our evauation of the described work. Food Pain: n accordance with 44 CFR Part 60 (Food Pain Management and Use), participating communities are required to review a proposed deveopment to determine if a food pain deveopment permit is required. Food pain administrators shoud review the proposed deveopment described in this pubic notice and apprise this office of any food pain deveopment permit requirements. Evauation Factors: The decision whether or not to issue a permit wi be based upon an evauation of the probabe impact of the proposed activity on the pubic interest. That decision wi refect the nationa concern for both protection and utiization of important resources. The benefits which may be expected to accrue from the proposa must be baanced against its expected adverse effects. A factors which may be reevant to the proposa wi be considered; among these are conservation, economics, aesthetics, genera environmenta concerns, historic vaues, fish and widife vaues, food damage prevention, and use cassification, navigation, recreation, water suppy, water quaity, energy needs, safety, food requirements and, in genera, the needs and wefare of the peope. Evauation of the proposed activity wi incude appication of the guideines pubished by the Environmenta Protection Agency under authority of Section 404(b) of the Cean Water Act. Pubic nvovement: The purpose of this notice is to soicit comments from the pubic; Federa, State, and oca agencies and officias; ndian Tribes; and other interested parties. These comments wi be used to evauate the impacts of this project. A comments wi be considered and used to hep determine whether to issue the permit, deny the permit, or issue the permit with conditions, and to hep us determine the amount and type of mitigation necessary. This information wi be used in our Environmenta Assessment or mpact Statement. Comments are aso used to determine the need for a pubic hearing. 3

4 Opportunity for a Pubic Hearing: Any person may make a written request for a pubic hearing to consider this permit appication. This request must be submitted by the pubic notice expiration date and must ceary state why a hearing is necessary.
