3 FEDERAL REGULATIONS 1972 EPA Clean Water Act Gave EPA and State Authority to Regulate Stormwater Discharges Municipal Separate Storm Sewer Systems (MS4) EPA/States Implementation of Regulations 1990 Stormwater Regulations Phase I Large and Medium MS4s (>100,000 population) Stormwater Management Program 1999 Stormwater Regulations Phase II Small MS4s Pottawatomie Urbanized Areas Permit Effective January 1, 2015

4 Future Development The need for a Stormwater Management Program has been driven by the anticipated future development in the study area. Based on the Manhattan Area 2035 Comprehensive Master Plan

6 KDHE MS4 NPDES PERMIT REQUIREMENTS Develop, implement and enforce a program to reduce the discharge of pollutants from the MS4 to the Maximum Extent Practicable. Stormwater Discharge Regulated just like Water and Sewer Systems The SMP is the outline of the program intended to meet the permit requirements Establish legal authority to implement program Permittee must submit a report each year KDHE Kansas Department of Health and Environment MS4 Municipal Separate Storm Sewer System NPDES National Pollutant Discharge Elimination System SMP Stormwater Management Plan
