Grannis Commissioner January 11, 2010 Dear Facility Owner/Operator: Re: Annual/Quarterly Reporting by Landfills, Municipal Waste Combustion Facilities, Regulated Medical Waste Facilities, and Annual Reporting by Construction and Demolition Debris Processing Facilities, Transfer Stations, Waste Tire Storage Facilities, Household Hazardous Waste Collection & Storage Facilities and Recyclables Handling and Recovery Facilities Regulated Under Revised 6 NYCRR Part 360, March 10, 2003 This letter is to remind you that your 2009 Annual Report is due no later than March 2, 2010, in accordance with 6 NYCRR Part 360. Copies of the 2009 Annual Reports forms are available online at along with a brief description of each type of solid waste management facility. Please note that several of the reports have changed this year, requesting information that is different or in a different format than previous years. DO NOT use previous years= forms! You are responsible for completing and submitting the appropriate forms for all of your permitted and registered solid waste management facilities. For facilities at which multiple activities or operations occur (i.e., transfer stations, c&d debris processing, recyclables handling & recovery, etc ) please complete the appropriate forms for each of these activities. If you have any questions about which forms to use, please contact the DEC Regional Office for the Region in which your facility is located or contact the Central Office at (518) The submission of the completed form does not relieve you from any additional reporting responsibilities that are identified as special conditions in your 6 NYCRR Part 360 permit or that may be required for inactive or closed facilities, or other types of solid waste management facilities not referenced above.
5 To complete the annual report submission process: 1. Please download the forms applicable to your facility or facilities. 2. Please print the forms double sided. Fillable forms will be available online shortly. 3. Fill out the Annual Report Form(s) completely and sign the form(s). 4. Make a copy for your records. 5. Fax the completed Annual Report Form(s) to the New York State Department of Environmental Conservation's Central Office at (518) or it to bwrrfann@gw.dec.state.ny.us. This fax number and address have been set up specifically for the annual reports referenced above. If you cannot fax or the form(s) or if there are lengthy attachments to the annual report(s), make a second copy and submit to the Central Office at the address in the letterhead above. 6. Mail the original completed form(s) to the New York State Department of Environmental Conservation (NYSDEC) Regional Office that has jurisdiction over your facility. 6 New York State Department of Environmental Conservation Division of Solid & Hazardous Materials Albany, New York ACTIVE (MUNICIPAL SOLID WASTE, IUSTRIAL, OR ASH) LAFILL A landfill is a solid waste management facility where solid waste is disposed. This form applies to municipal solid waste, industrial, and ash monofill landfills. Further information and a listing of the landfills are available online at Note: If you operate a construction and demolition debris, land clearing debris landfill, or a Long Island landfill, DO NOT use this form. Forms for all solid waste management facilities and a brief description of each can be found at Annual/Quarterly Report For use of this form as an Annual Report, complete line A and complete Sections 1 through 13 and 19 through 21. The Annual Report form is to be used to meet annual reporting requirements (excluding results from annual sampling events which require the use of the Quarterly Report form as noted in the following paragraph). Submit the Annual Report no later than March 2, For use of this form as a Quarterly Report, complete line B and complete Sections 1 and 14 through 21. The Quarterly Report form is to be used for reporting of quarterly, semiannual, or annual results from each sampling event without regard for whether the sampling event is required on a quarterly, semiannual, or annual basis. Submit the Quarterly Report no later than 60 days after the last day of each calendar quarter or within 90 days of the conclusion of sample collection if Site Analytical Plan requirements must be met. For use of this form as a combined Annual Report and a Quarter 4 Report, complete both lines A and B and complete all Sections. Reporting of the information indicated on this Active Landfill Annual/Quarterly Report form is required pursuant to 6 NYCRR (c); (e)(1)(ii); (e)(2), (i)(1); (j)(3); (c)(5)(iv), (d)(5), (d)(6); (a)(2)(vi); (a), (t); (b)(1)(ii), (c)(1)(ii), (d)(1)(i); (d); and Failure to provide the required information requested is a violation of Environmental Conservation Law. Timely submission of a properly completed form to the Department s Regional Office that has jurisdiction over your facility and to the Department's Central Office is required to meet the Annual/Quarterly Report requirements of 6 NYCRR Part 360. Where the Annual/Quarterly Report requirements have been modified, appropriate Sections (as necessary to reflect the modification) must be completed and submitted with a copy of the Department's written notification which allows the modification. Entries on the report forms should be either typewritten or neatly printed in black ink. Attach additional sheets if space on the pages is insufficient or supplementary information is required or appropriate. Please note that where reference is made to a "Quarter" such as in line B, Quarter 1 is from January 1st to March 31st, Quarter 2 is from April 1st to June 30th, Quarter 3 is from July 1st to September 30th and Quarter 4 is from October 1st to December 31st. For purposes of estimating tonnage where only the volume is known, assume each cubic yard of construction and demolition debris is equivalent to 0.75 tons of solid waste, each cubic yard of compacted solid waste is equivalent to 0.5 tons, and each cubic yard of uncompacted solid waste is equivalent to 0.1 tons.
