2 Regulatory Place holder for Landfill Bioreactors (What NYS s Regs say today) NYS s 6 NYCRR Part (a) A general description shall be provided stipulating how this facility will be operated in an environmentally resource conscious manner. Active landfill management techniques to encourage rapid waste mass stabilization and alternative energy resource production are encouraged and should be addressed in the landfill s engineering report and in the operation and maintenance manual. 6 NYCRR Part (j) Regulatory requirements for leachate recirculation. 6 NYCRR Part (k) Bulk liquids prohibition. Induction - How & How Much Operations Plan Bioreactor Lf Monitoring Plan

4 NYS DEC Permitting (Current Regs) Leachate Recirculation vs Bioreactor Concepts Current Regs Allow Leachate Recirculation. Need Double-Liner Cell Must be in operation for at least 6 months. Recirculation on soil covered areas prohibitied. The same unless proposing to liquids other than leachate. If taking liquids other than leachate the proposal must be approved under our RD&D requirements with necessary variances and required monitoring and reporting. Must maintain 20 gpad primary liner performance. Stability demonstration. O&M must address process. We re currently confirming with EPA that our 1993 RD&D requirements apply. Demonstration for stability, and odor and gas controls.

Requires active horizontal gas collection system at all MSW Lfs based on designers specifications. Requires proactive odor control plan in O&M manual. Improved regulatory coordination between Parts 360 and 208.

9 Federal RD&D Rule (cont d) MSWLF Criteria for Which RD&D Variances Would Not be Allowed: Location Restrictions Ground Water Requirements Corrective Action Requirements Financial Assurance Requirements Explosive Gases Control in the Operating Criteria Procedures for Limiting Hazardous Wastes Proposed rule would require approved states to apply to EPA for authorization to adopt the federal RD&D provisions.

10 Federal RD&D Rule Revised Part 258 to allow Directors of approved States to issue RD&D permits on a site-specific basis. Permits would allow for variances from only certain MSWLF criteria. Owner/operator would be required to demonstrate facilities could be operated w/o adverse impact & safely under the RD&D proposal. Permit issued for 3 years, with up to 3 additional renewals of the permit - Total of 12 Years

11 Proposed RD&D Rule (cont d) Crafted to allow flexibility for the following MSWLF Criteria: RD&D may provide variance from the existing 40 CFR 258 requirements for: Run-on Controls Systems, Liquid Restrictions, etc. Final cover systems, etc. 5 states had their RD&D Provisions Approved by EPA: (1)MI, 10/31/06; (2) WI, 3/21/06; (2) MN, 2/15/06; (3) IL, 1/21/06; and, (4) IN, FR on 11/10/05. EPA OSW indicated that they are aware of at least 8 other states that are in the process of applying for RD&D authorization. He noted that both California and Iowa are very close to finalizing their rule-making process to incorporate 40 CFR Part 258's RD&D provisions into their State regulations.

Flexibility in PLCRS for MSW & C&D LFs On slopes <10% PLCRS divided to require the lower 12 to have min perm of 1 cm/sec, with upper 12 having a min perm of 0.1 cm/sec. For slopes > 10% entire 24 must have min perm of 0.1 cm/sec.
