Department of Health and Environmental Control y for a permit to construct a marina in waters of Mr. Palmer Simmons Simmons Family Holdings, LLC Clo Mr. Mark Renew Sea sland Land Survey, LLC 4D Mathews Court Hilton Head sland, South Carolina BROAD CREEK at a location, 11 Simmons Road, on Hilton Head sland, in Beaufort County, South Carolina (Latitude: N, Longitude: W), Bluffton Quad. n order to give all interested parties an opportunity to express their views NOTCE is herey given that written statements regarding the proposed work will e received y the Corps until 15 Days from the Date of this Notice, and SCDHEC will receive written statements regarding the proposed work until 30 Days from the Date of this Notice from those interested in the activity and whose interests may e affected y the proposed work. facility. The proposed work consists of removing the existing dock and constructing a new marina n detail, the applicant proposes to construct a 20' x 20' covered pierhead attached to high

2 REGULATORY DVSON SAC May 2018 ground y an 8' x 250' walkway. n addition, a 12' x 13' four pile oat lift will e installed on the upstream side of the pierhead accessed y a 4' x 12' catwalk. At the waterward end of the pierhead the applicant proposes to install a 6' x 40 aluminum ramp leading to a 20' x 90' floating dock with an 8' x 108' center float. Six 6' x 45' finger piers will e attached to the 20' x 90' center float. Finally, a 6' x 66' "L" shaped kayak pier is to e installed at the upland side of the 20' x 98' floating dock as shown on the attached plans. According to the applicant, the marina will provide 630 linear feet of dockale slip space. Based on an assumed average oat length of 20, the proposed marina will accommodate 28 oats in wet slips. The largest single slip face is 98 linear feet. The applicant states that the marina will operate without power output, water supply, waste facilities or fueling equipment. The applicant stated that mitigation is not proposed as there are no impacts to aquatic resources that would require mitigation. The purpose of the proposed work is to provide day time mooring of oats to provide access to the inland property as well as storage and launching of unpowered kayaks. NOTE: This pulic notice and associated plans are availale on the Corps' wesite at: The District Engineer has concluded that the discharges associated with this project, oth direct and indirect, should e reviewed y the South Carolina Department of Health and Environmental Control in accordance with provisions of Section 401 of the Clean Water Act. As such, this notice constitutes a request, on ehalf of the applicant, for certification that this project will comply with applicale effluent limitations and water quality standards. The work shown on this application must also e certified as consistent with applicale provisions of the Coastal Zone Management Program (15 CFR 930). This activity may also require evaluation for compliance with the S. C. Construction in Navigale Waters Permit Program. State review, permitting and certification is conducted y the S. C. Department of Health and Environmental Control. The District Engineer will not process this application to a conclusion until such certifications are received. The applicant is herey advised that supplemental information may e required y the State to facilitate the review. This notice initiates the Essential Fish Haitat (EFH) consultation requirements of the Magnuson-Stevens Fishery Conservation and Management Act. mplementation of the proposed project would have minimal impact on estuarine sustrates and emergent wetlands utilized y various life stages of species comprising the shrimp, and snapper-grouper management complexes. The District Engineer's initial determination is that the proposed action would not have a sustantial individual or cumulative adverse impact on EFH or fisheries manag'ed y the South Atlantic Fishery Management Council and the National Marine Fisheries Service (NMFS). The District Engineer's final determination relative to project impacts and the need for mitigation measures is suject to review y and coordination with the NMFS. Pursuant to the Section 7 of the Endangered Species Act of 1973 (as amended), the Corps has reviewed the project area, examined all information provided y the applicant, and the District Engineer has determined that the project not likely to adversely affect any federally endangered, threatened, or proposed species or result in the destruction or adverse modification of designated or proposed critical haitat. This pulic notice serves as a request for written concurrence from the U.S. Fish and Wildlife Service andor the National Marine Fisheries Service on this determination. Pursuant to Section 106 of the National Historic Preservation Act (NHPA), this pulic notice also constitutes a request to ndian Tries to notify the District Engineer of any historic. 2

3 REGULATORY DVSON SAC May2018 properties of religious and cultural significance to them that may e affected y the proposed undertaking. n accordance with Section 106 of the NHPA, the District Engineer has consulted South Carolina ArchSite (GS), for the presence or asence of historic properties (as defined in 36 C.F.R. 8.16)(D(1 )), and has initially determined that no historic properties are present; therefore, there will e no effect on historic properties. To ensure that other historic properties that the District Engineer is not aware of are not overlooked, this pulic notice also serves as a request to the State Historic Preservation Office and any other interested parties to provide any information they may have with regard to historic properties. This pulic notice serves as a request for concurrence within 30 days from the SHPO (andor Trial Historic Preservation Officer). The District Engineer 1 s final eligiility and effect determination will e ased upon coordination with the SHPO andor THPO, as appropriate and required and with full consideration given to the proposed undertaking 1 s potential direct and indirect effects on historic properties within the Corps-identified permit area. Any person may request, in writing, within the comment period specified in this notice, that a pulic hearing e held to consider this application. Requests for a pulic hearing shall state, with particularity, the reasons for holding a pulic hearing. The decision whether to issue a permit will e ased on an evaluation of the proale impact including cumulative impacts of the activity on the pulic interest. The enefit which reasonaly may e expected to accrue from the project must e alanced against its reasonaly foreseeale detriments. All factors which may e relevant to the project will e considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fier production and, in general, the needs and welfare of the people; A permit will e granted unless the District Engineer determines that it would e contrary to the pulic interest. n cases of conflicting property rights, the Corps cannot undertake to adjudicate rival claims. The Corps is soliciting comments from the pulic; Federal, state, and local agencies and officials; ndian Tries; and other interested parties in order to consider and evaluate the impacts of this activity. Any comments received will e considered y the Corps to determine whether to issue, modify, condition or deny a permit for this project. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other pulic interest factors listed aove. Comments are used in the preparation of an Environmental Assessment andor an Environmental mpact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a pulic hearing and to determine the overall pulic interest of the activity.
