2 1 Objective 2 Scope The objective of this Policy is to ensure that the University of Tasmania (the University) fulfils its obligations under the National Greenhouse and Energy Reporting Act 2007 (the NGER Act) and associated Regulations and Determinations. This policy applies to all University Organisational Units (OUs) and to all facilities/activities under the operational control of the University that use or produce energy, or produce greenhouse gas emissions. 3 Policy Provisions 3.1 Reporting Obligations As required under the NGER Act, the University will provide an annual report to the Clean Energy Regulator (the Regulator) relating to the: greenhouse gas emissions; and energy production; and energy consumption; from the operation of the University during the whole, or the part, as the case may be, of that financial year Activities to be Reported The University will report all greenhouse gas emissions, energy usage and energy production resulting from all facilities (activities) deemed by the NGER Act and Regulations to be under the University s operational control, when the quantities of same exceed the reporting thresholds established under the Act. Such reportable facilities (activities) include: activities involving staff and/or agents (e.g. consultants or contractors) of the University, at premises owned, leased or otherwise under the University s operational control; and/or activities in which the University is involved as part of a contractual arrangement, joint venture, trust, partnership or the like. Commercial Services and Development (CSD) and/or the University Legal Office will apply testing to determine those facilities (activities) on which the University is liable to report. Organisational Units (OUs) engaged in, or planning, activities involving parties other than the University that impact upon the University s NGER obligations are required to liaise with CSD and/or the University Legal Office to determine which party has operational control over the facility (activity). 2 National Greenhouse and Energy Reporting Policy (December, 2014)

3 3.1.2 Commodities and Emissions to be Reported The University will report on all reportable commodities and reportable emissions, when levels of same exceed the thresholds for reportability established under the NGER Act. Lists of reportable commodities and reportable emissions are provided at Section 6 of this Policy Emissions and Commodities Data Commodities data will be collated primarily from University financial systems (such as TechOne Finance, the Business Card Management System (BCMS) and University Fuel Card records) and directly from external suppliers. When requested by CSD, OUs must provide data for any reportable commodities, the purchase or use of which has not been identified through central finance systems, and associated emissions. 4 Record Keeping All records relating to the University s participation in the NGERS must be created and maintained in a manner consistent with the University s Records Management Policy and retained for a minimum of five years, in accordance with provisions of the NGER Act. 5 Responsibilities The Vice-Chancellor is responsible for the University s compliance with the NGER Act. The Executive Director, CSD is responsible for assurance and sign-off of the University s annual National Greenhouse and Energy Report and submission of the completed report to the Regulator. The Infrastructure, Planning and Compliance Unit, CSD is responsible for determining, in consultation with the Legal Office, the boundary for reportable facilities (activities) and associated reportable commodities and emissions and providing advice on same to OUs; the annual collection, collation and validation of the University s reportable NGER data, including data on emission sources and reportable commodities from external and internal data providers; production of the University s annual National Greenhouse and Energy Report for submission to the Regulator; ensuring that effective internal controls and adequate records have been established and maintained to facilitate the preparation of reliable documentation related to the National Greenhouse and Energy Report; and ensuring records relating to the completion and submission of the National Greenhouse and Energy Report are created and maintained in a manner consistent with the terms of the University s Records Management Policy and are retained for a minimum of five years in accordance with provisions of the NGER Act. 3 National Greenhouse and Energy Reporting Policy (December, 2014)

4 The Financial Services Section is responsible for providing BCMS and other financial reports to CSD upon request. Organisational Units are responsible for liaising with CSD and/or the University Legal Office prior to entering into a legal agreement in respect of a facility (activity) to determine whether a facility (activity) will entail a reporting liability under the NGER Act, and providing to CSD, annually as requested, data on reportable commodities consumed by the OU and/or purchased with local Budget Centre funds, and associated reportable emissions. 6 Definitions and Acronyms Term/Acronym Clean Energy Regulator Emission External Data Provider Facility Greenhouse gas Internal Data Provider National Greenhouse and Definition The Clean Energy Regulator is the Government body responsible for administering legislation to reduce carbon emissions and increase the use of clean energy. Release of gas into the atmosphere either as a direct result of an activity that constitutes the facility (scope 1 emission) or as a result of activities that consume electricity, heat or steam at the facility (scope 2 emission). A source of data on University emissions and/or energy/fuel usage/production, other than the University. For the purposes of the NGER Act and this Policy, a facility is an activity, or a series of activities (including ancillary activities), that involve greenhouse gas emissions, the production of energy or the consumption of energy and that: a) form a single undertaking or enterprise and meet the requirements of the regulations; or b) are declared by the Clean Energy Regulator to be a facility. Any of the various gaseous compounds (such as carbon dioxide) that absorb infrared radiation, trap heat in the atmosphere, and contribute to the greenhouse effect. For the purposes of the Act and this Policy, each of the following is a greenhouse gas: a) carbon dioxide; b) methane; c) nitrous oxide; d) sulphur hexafluoride; e) a hydrofluorocarbon of a kind specified in the table below; f) a perfluorocarbon of a kind specified in the table below; g) a prescribed gas. A University OU that is a source of data on University emissions and/or energy/fuel usage/production. A national framework introduced by the Commonwealth Government in 2007 under which corporations report on 4 National Greenhouse and Energy Reporting Policy (December, 2014)

5 Energy Reporting Scheme (NGERS) Operational control Organisational Unit (OU) Reportable commodity greenhouse gas emissions, energy use and energy production. The framework was established by, and operates under, the National Greenhouse and Energy Reporting Act 2007 (the Act). For the purposes of the Act and this Policy, a group entity has operational control over a facility if: a) the group entity has the authority to introduce and implement any or all of the following for the facility: i. operating policies; ii. health and safety policies; iii. environmental policies; and meets the requirements of the regulations; or b) the Regulator declares the group entity to have operational control of the facility under Section 55 of the NGER Act. Faculty, School, Centre, University Institute, other University Entity, Division, Section or University Business Enterprise. A fuel or other energy commodity deemed to be reportable under the NGER Act. Reportable commodities are listed in the table below. 8 b) fugitive emissions from fuels, which deals with emissions mainly released from the extraction, production, processing and distribution of fossil fuels; and c) industrial processes emissions, which deals with emissions released from the consumption of carbonates and the use of fuels as feedstocks or as carbon reductants, and the emission of synthetic gases in particular cases; and d) waste emissions, which deals with emissions mainly released from the decomposition of organic material in landfill or wastewater handling facilities. Scope 2 Emissions Scope 2 emissions are a form of indirect emission and are activities that generate electricity, heating, cooling or steam that is consumed by the facility but that do not form part of the facility.
