5 What we do to help people using services get their Human Rights Our job is to make sure that health and care services in England are: 1. Safe. 2. Doing what they are meant to be doing. 3. Caring. 4. Meeting the needs of everyone. 5. Well-led.? These are the 5 main questions we ask about all services. We also want to make sure everyone is treated equally, fairly and gets their Human Rights. 1

Why we need to look at Human Rights We need to work in this way because: it helps make sure everyone using services gets good safe care. it will help us include Human Rights in the way we check services We want to make sure we include treating people equally and their Human Rights at every point in our new way of checking services. We will make sure that: we collect information about human rights in each health or care service, where we can 2
7 we include human rights in what we look at on inspections our inspectors know about checking human rights We want to make sure that: we always think about people using health and social care services human rights are included in the right way in our inspections everybody involved in inspections can look at human rights with help from human rights experts if they need it. 3
8 We will: try out new ways of inspecting for human rights report on how health and social care services across England are making sure that people get their human rights check that our work on human rights is making a difference for people. 4
9 2. What do we mean by Human Rights? We believe that: people should be treated fairly and be involved in decisions about their care and treatment people should be respected, treated as individuals and listened to people should be treated equally and have their needs met, including people from groups who can sometimes be treated unfairly people should be treated properly with kindness, even if they are not able to say what their needs or wishes are 5
10 people should have choice and control over their care and treatment and other areas of their life people should have the right to life staff should have their human rights and be treated equally and fairly. Staff should be supported to help the people using their services get their human rights. 6
11 3. Using human rights to check services We are using the list of what we believe about Human Rights to check services We will be looking at each of our 5 main questions and checking we include Human Rights in each of them. There is a longer list of what is included for each of the 5 questions called a topic list. Human Rights will also be included in the new Department of Health rules that services will have to meet. 7
12 4. Helping staff include Human Rights in our work checking services We need to make sure our staff checking services are able to make decisions about Human Rights. They also need to work in different ways for different types of service We have 5 main ways to do this: 1. We are using new ways to get information about services to find out if there are any worries about them. 2. We will check to make sure we include Human Rights in this information. 3. Our staff will need ways of checking Human Rights in services. The way they do that will be different for different types of service. 8
13 We have tested this way of working and we will keep checking to make sure it is the best way. We have worked to make sure lots of different people can tell us what they think about this work. We will also be working with local groups and organisations so they can tell us what they think. We will also make sure our staff, who check to see if new services can go onto our lists to give a service, include Human Rights. 9
14 4. How good this way of working is will depend on how good our staff are in including Human Rights in their jobs. We will make sure: our staff have Human Rights training our staff will share with each other what they know some of our staff will become experts in this area our staff are treated equally and fairly as well. 10
15 5. Telling other people what we do about Human Rights Telling services what we do about Human Rights will: help them think about what they do about them help explain our job to people. Telling people using services and others what we do about Human Rights will: help them understand their rights help us get information about how well services are meeting people s Human Rights. 11
16 5. The things we believe about using Human Rights in our work All the points so far show what we believe about working in this way. These are: including Human Rights in our work checking services making sure staff who are not experts on Human Rights can still work in this way. This includes Experts by Experience (people who have used services who help with our work) making sure staff can talk to Human Rights experts when they need more help. 12
17 We have a team of experts called the Equality and Human Rights Team that staff can talk to when they need them. They can also get help from the the Equality and Human Rights Commission, if they need to. We will also find out more about what members of staff know about Human Rights so we can use them more. 13
18 6. Getting better all the time We are checking how well the Human Rights way of working is going. We check to see if it is making things better for people using services.? We will use our 5 main questions to check and see if care is safe and works well for people. We ask people who use services, families and friends, the services and others what they think about how well we are doing. We might use what we find to look at some areas of care in more detail. 14
19 We want this way of working to help us: check services in a better way talk about what we have found out about people being treated equally and getting their Human Rights make services better. We will look at how this way of working helps us in other areas of our work. 15
