1 Policies and Procedures Policy number HR9 Start Date October 2017 Date of review October APPLICATION This document covers the following policies and procedures: Code of Conduct Communications Policy Disciplinary Policy and Procedure Fitness for Work Policy and Procedure Flexible Working Policy Issue Resolution Policy and Procedure Performance Management Policy and Procedure Workplace Behaviour Policy and Procedure (Workplace Behaviour Framework) Each document in the Workplace Behaviour Framework should be considered in relation to the others, and will operate within the Applicable Laws.

2 2 DEFINITIONS Unless specifically otherwise stated in a policy, these definitions will apply to the Workplace Behaviour Framework: Term Meaning Applicable Laws All laws in connection with the carrying out of work or the School including: Age Discrimination Act 2004 (Cth) Australian Human Rights Commission Act 1986 (Cth) Children, Young Persons and their Families Act 1997 (Cth?) Disability Discrimination Act 1992 (Cth) Fair Work Act 2009 (Cth) Racial Discrimination Act 1975 (Cth) Road Safety (Alcohol & Drugs) Act 1970 (TAS) Sex Discrimination Act 1984 (Cth) Anti-Discrimination Act 1998 (Tas) Workers Rehabilitation and Compensation Act 1988 (Tas) Work Health and Safety Act 2012 (Tas) Education and Care Services National Law Act 2010 Board The School Board collectively or any individual Board Member acting with authority of the Board. Confidential Information Any information, with the exception of information in the public domain other than as a result of a breach by the Staff member or Contractor disclosed, or communicated to the Staff member or Contractor by, or on behalf of, the School, that; 24/01/2017 Page 2 of 6

3 (a) (c) (d) is marked or designated as Confidential ; would at law be considered confidential information of the School; the Staff member or Contractor might reasonably expect the School to regard as confidential; or which comes into the Staff member s or Contractor s possession, or is learnt, accessed or generated by the Staff member or Contractor, in the course of the Staff member s or Contractor s employment or engagement, whether or not the information was originally supplied by the School; and (i) (ii) relates to the School s transactions, dealings, student lists, financial position and arrangements, funding, general affairs, contracts entered into, program planning and consultant s advice, promotional information, planning information, equipment, techniques used or any of the above matters for the School s business, and Staff or Contractors; or without limiting the generality of the above, relates to internal the School management, the structure of the School, the School personnel, information about Staff or Contractors, policies, marketing programs, strategies, plans, investments or aspects of its future operations. Contractor A person, who carries out work in any capacity for the School, including work as: (a) (c) (d) (e) a contractor or subcontractor; an employee of a contractor or subcontractor; an trainee; a student gaining work experience; or a volunteer. EAP Means the Employee Assistance Program provided by the School with Newport and Wildman 24/01/2017 Page 3 of 6

4 Staff A person who carries out work for the School as an employee of the School. Relevant Manager Means those employees who manage or hold responsibility for other staff. Leadership Team Members of the Leadership Team are the: (a) Principal; Deputy Principal; (c) Chief Operating Officer; (d) School Chaplain Senior Management Team Members of the Senior Management Team are the: (a) Principal; Deputy Principal; (c) Chief Operating Officer; (d) Heads of School; (e) Chaplain; (f) Director of ICT; (g) Head of Marketing and Communications; (h) Head of Enrolments; and (i) Director of Early Learning. Other Persons at the School Any person at the School who is not staff, including parents and visitors but not including Students. School Christ College Trust, trading as St Michael s Collegiate School, and any place where work is carried out for the School. Student Any student of the School. 24/01/2017 Page 4 of 6

5 3 INTERPRETATION The following interpretation applies to the Workplace Behaviour Framework: (a) (c) (d) (e) (f) (g) (h) The singular includes the plural and vice versa. A reference to any legislation includes all delegated legislation made under it and amendments, consolidations, replacements or re-enactments of any of them. A reference to policy or procedure means any approved policies or procedures of the School unless otherwise stated. Including and similar expressions are not words of limitation. A reference to a document (including any of the Workplace Behaviour Framework) is to that document as amended, novated or replaced unless otherwise stated. Where a word or expression is given a particular meaning, other parts of speech and grammatical forms of that word or expression have a corresponding meaning. Examples used in the Workplace Behaviour Framework are for illustrative purposes only and are not intended to be exhaustive. The Workplace Behaviour Framework does not form part of any Staff contract of employment and any contract of employment will prevail over those Policies to the extent of any inconsistency. Questions relating to the interpretation, application or enforcement of the Workplace Behaviour Framework should be directed to a member of the Leadership Team or the HR Coordinator. 4 AMENDMENTS The School retains the sole discretion to reasonably vary, terminate or replace the Workplace Behaviour Framework from time to time. The School will consult before material amendments are made and will notify those the material amendments apply to. 24/01/2017 Page 5 of 6

6 5 REQUIREMENTS Persons included in the coverage of a Policy and Procedure in the Workplace Behaviour Framework must comply with that document. 6 BREACHES 6.1 Reporting of Breaches Persons covered under each Workplace Behaviour Policy must reasonably report breaches of that Policy to the School and as otherwise required or permitted by Applicable Laws. 6.2 Breach of Policy Persons covered under each policy or procedure in the Workplace Behaviour Framework who engage in behaviour in breach of that Policy may (as is appropriate and as applicable) be subject to appropriate disciplinary action in accordance with the Disciplinary Policy and Procedure (for Staff), or removal from the School or termination of services (for Contractors or Other Persons at the School). Breaching each policy may also amount to breaches of Applicable Laws: (a) exposing individuals to legal proceedings; and making the School vicariously liable for the conduct of others. 24/01/2017 Page 6 of 6
