2 1.0 OPENING OF MEETING/APPROVAL OF AGENDA/INTRODUCTIONS The meeting opened at 1:00 p.m., with 9 members of the Committee in attendance. A motion was made to approve the agenda, as modified. 2.0 MINUTES/NOTES FROM PREVIOUS MEETING A motion was made to approve the Minutes of the October 11, 2017 meeting, as modified. 3.0 ACTION ITEMS - PEO staff reported on the status of the Action Items. - There was a discussion regarding the following action item: Get feedback from LMCBO with regard to the data matrix forms that are not consistent throughout all municipalities. An EABO member questioned about the type of data matrix; staff will find out and bring more information for a discussion at next meeting. - An OAA member advised that OAA has two data matrix forms; one data matrix for Parts 3 and 9, and another data matrix for Part 11. Both data matrix forms are available on OAA s website. OAA s data matrix forms have 8 path compliance. - EABO members suggested that PEO staff make contact with municipalities that use a different data matrix form which is not consistent with others. - An EABO member advised that the City of Richmond Hill has a form with a different matrix for review. It was advised that PEO staff follow up with the Building Official from the City of Richmond Hill to get more information. - An OAA member advised that the City of Ottawa is proposing a data matrix form that can be understood by anyone who is not an expert. - An EABO member indicated that Building Code references to standards are outdated; for example, the Building Code reference to CSA 1996 and a revision made to CSA in which version would be enforced in this situation? - There was a discussion on the following action item: Send PEO s response to the comments that were received from LMCBO/OBOA on the Structural Engineering Design Guideline. Staff advised that a new protocol will be followed to send a memo EABO Minutes: 2017-May-11 2.
3 to all participants of any public consultation on guidelines, outlining the major changes in the guideline. - There was a discussion on the following action item: Verify if it would be possible for OAA members to get free access to the Build Right Ontario website. An EABO member advised that he would contact the working group for this website to discuss how best to get access for OAA members. Staff to contact the Building Official from the City of Richmond Hill regarding their data matrix. 4.0 SITE PLAN CONTROL The following points were discussed regarding site plan sealing requirements: - The City of Markham has updated their SB10 form, which requests an engineer s seal on the application of design. An EABO member believes the Ministry of Municipal Affairs is working on a revised SB10 form. - OAA recommended that other municipalities request an engineer s seal on their SB10 form as well since it is recommended to have professionals at the early stage of any project to override future issues. - The OAA Practice Committee has reviewed the City of Markham s SB10 form, and the intent is to support this form. - The intent is to provide design excellence and guidance for designers at an early stage. - It was suggested that EABO provides recommendations to municipalities; however, cannot set permit requirements. - EABO could propose the proper and appropriate quality and completeness of submission of the application form; however, the content of the submission is up to the municipalities. 5.0 COORDINATION BETWEEN PROFESSIONAL DESIGNERS The Coordinating Licensed Professional Joint Subcommittee has been formed, and subcommittee members will meet on June 7, EABO Minutes: 2017-May-11 3.
4 6.0 INFORMATION There was nothing new to report. 7.0 TRAINING - An EABO member reported that there is workshop coming up sometime in September/October 2017 on Energy Efficiency. This workshop will be open for designers, regulators, and other stakeholders. - EABO members questioned if a certificate would be provided at the end of the workshop to add any credit to professional development. - EABO members advised that it would be appropriate that we share maintenance points or credit. - There was a discussion on the PEAK program, and it was requested to get more information on this program. B. Ennis to send some information on the PEAK program to the EABO members. 8.0 PLANNING ACT There was nothing new to report. OAA to report on what traction this report has received. PEO staff to schedule a separate meeting with PEO staff, CEO, OAA, OBOA and LMCBO to outline the issues with OPPI. 9.0 NEW BUSINESS 9.1 Airport Review Form PEO staff provided a copy of the General Review Commitment Certificate that is used at Toronto Pearson International Airport for general review. The Toronto Pearson International Airport is a Federal project and the Ontario Building Code is not the governing regulation. When the Ontario Building Code applies, General Review is required per the table. The Toronto Pearson International Airport still uses a general review form, but different than the EABO General Review Form. EABO Minutes: 2017-May-11 4.
5 9.2 Ontario Sign Association There was nothing new to report. An EABO member previously reported the following: - The letter from the Ontario Sign Association relied on a legal opinion that did not note that the practice of professional engineering and the requirements to seal engineering documents are contained in the Professional Engineers Act and O. Reg Sign structures are exposed to loads and forces imposed by self-weight, wind and seismic forces, etc. If a sign of any significant size, weight or cost were to fail, it could endanger public safety, property, economic interests and/or public welfare. To prepare the structural (or mechanical or electrical) design of a sign requires the application of engineering principles as it involves force analysis, the strength of materials, consideration of matters of stress and strain, and application of engineering design standards. An EABO member commented that Building Officials often request that the engineering design calculations show the forces involved. PEO staff reported that PEO responded to the letter of January 5, 2017, from the Ontario Sign Association, clarifying that the design of sign structures falls within the definition of the practice of professional engineering, as defined under the Professional Engineers Act. There was a discussion regarding BCIN, and an EABO member indicated that, on some buildings, a BCIN does not qualify one to design a building because of professional design requirements; for example, a new Part 3 building. 9.3 Applications for Site Plan Approval There was nothing new to report. An EABO member previously reported that OAA submitted a letter to all Directors of Planning and Chief Building Officials in the Province of Ontario regarding the Applications for Site Plan Approval, indicating that there continue to be instances where non-architects have been preparing the architectural designs accompanying applications for site plan approval under the Planning Act. The designs submitted as part of the site plan approval process are intended to govern the construction, enlargement or alteration of buildings. EABO Minutes: 2017-May-11 5.
6 Subject to the qualifications and exemptions set out in the Architects Act, designs accompanying the site plan application should be prepared, sealed and signed by an architect. An EABO member advised that the above information can be published in the Ontario Planning Magazine for information and education. 9.4 Projects without Permits PEO staff received interesting comments on the General Review Guideline from some EABO members. Perhaps, legal advice will be required. 9.5 Definition of Townhouse Relative to Back-to-Back and Stacked Townhouses There was a discussion on the letter that was sent on behalf of EABO to the Ministry of Municipal Affairs and Housing. An EABO member suggested that the letter should have indicated that barrier-free access should be part of the development. Stacked townhouses are a very affordable option and should not disappear. An EABO member indicated that the City of Pickering Council is looking for more barrier-free access in residential housing. An EABO member advised that losing stacked townhouses is an issue and that the Ministry of Municipal Affairs should consider this issue. An EABO member indicated that the intent of the letter that was sent to the Ministry of Municipal Affairs and Housing was to look at when barrier-free access applies and when it does not. 9.6 City of London - Commitment Form An EABO member advised that a request was received from the City of London to add a new line for Address in the General Review Undertaken by Architects and/or Professional Engineers form that was endorsed by EABO. Furthermore, the City of London had a comment regarding the Fire Protection line in the above-mentioned form. Some consultants assume that fire protection falls under Mechanical while others would add it under Other, which may cause confusion. EABO members suggested getting further clarification to understand who the fire protection category is intended for. An EABO member advised that an architect EABO Minutes: 2017-May-11 6.
7 is responsible for fire protection, such as fire hydrant coverage, concrete cover on reinforced concrete slab applications. An EABO member will get more information, and this item will be discussed at the next meeting. 9.7 Colour Drawings An EABO member indicated that paperless drawings would be acceptable to the municipalities, and that color drawing would not be an issue. Prior to submitting for a permit, applicants are always reminded to check the municipality building by-law for application (building permit) requirements. 9.8 Post Disaster A question was posed regarding why post disaster buildings are included in the OAA Part 3 Data Matrix. An OAA member suggested sending comments to move the post disaster to the Data Matrix Part Brainstorming - EABO Terms of Reference An EABO member provided the following points: - EABO appears to be dysfunctional, meeting 3-4 times per year, with little follow-up and progress between meetings. - Action items rarely are acted upon and remain on the agenda. - There is no follow-up on action items. - There are no functioning working groups. - Items remain on the agenda under New Business. It was suggested changing the layout of the agenda. The following suggestions were provided at the meeting: - Establish meeting protocols (i.e. voting, motions and final decisions). - Rotate the chairing role and responsibilities between all Associations for equal responsibility (three-year term). Perhaps, the role Chair should be for a oneyear term. - The meeting location to remain at the PEO Offices (good highway and TTC subway access). EABO Minutes: 2017-May-11 7.
8 - The Minutes should be sent within 2-3 weeks following the meeting to the EABO members for review and revision. - Set a meeting schedule for the year as a meeting every three months is not sufficient to discuss all items outlined on the agenda. - The meeting agenda should be distributed a minimum of one week in advance of a scheduled meeting, which should list all the Action Items from the previous Minutes (i.e. Business Arising from Previous Minutes). - Inviting observers from Ministries is very important. It was recommended that the existing EABO Committee review the above concerns. EABO will establish a small working group made up of members from PEO, OAA and Building Official. The working group will review these recommendations and report back their findings to EABO by August D. Dengler, D. Cradock, M. Seiling and W. Derhak to work together to revise the EABO Terms of Reference. PEO staff to change the layout of the agenda. PEO staff to invite observers from the Ministry of Municipal Affairs and Housing. Change the hours of upcoming EABO meetings; for example, from 11:30 p.m. to 4:30 p.m., with lunch between 11:30 a.m. to 12:00 p.m. PEO staff to send Robert's Rules of Order to the EABO members. 9.9 Barrier-Free Access, Number of Elevators and Emergency Power It was reported that the OAA Practice Committee is reviewing the Regulation change regarding the suitable number of elevators in buildings; for example, what is the required number of elevators in buildings over 20 storey. 9.
