3 1. Introduction Traditionally, Electronic Navigational Charts 1 (ENC) have been licensed using the same model as paper charts. Users have bought a license to all ENC data to be used during navigation and have been able to view and access all subscribed ENC data for planning and operational purposes. A license key is issued to the user and used by his application to validate access to subscribed ENC data. License keys are normally provided prior to going to sea, but online distribution services are available to support delivery of license extension while the vessel is at sea. Traditionally a re-routing to a new destination would require delivering new license keys to access the new ENC data outside the current coverage. This would require communication and data exchange with the vessel and the distributor. However, use of ENC data combined with online communications has potential to improve the safety of navigation by enabling new and more efficient modes of operation on board a vessel. Recognizing this potential, PRIMAR supports innovative methods of distribution of ENC data that contribute to improving safety and efficiency of navigation. The approval of the distributor s proprietary pay-as-you-sail (PAYS) service by PRIMAR would allow PRIMAR ENC data 2 to be passively installed on a navigation system. The data can be freely viewed and accessed for planning purposes. The distributor must establish a mechanism whereby the use of all ENC data accessed during navigation is registered accurately and the ENC display and usage information is transmitted automatically to the distributor. This will also ensure the user has immediate access to additional ENC coverage in case of re-routing due to operational or contingency purposes. This document defines the terms and conditions of PRIMAR towards a distributor wishing to develop an innovative PAYS ENC distribution service. The onus is on the distributor to demonstrate and prove that the system complies with these terms and conditions. 1 Electronic Navigational Chart (ENC) official digital chart data authorized by National Hydrographic Office in accordance with the ENC Product Specification in the International Hydrographic Organization s (IHO) S-57. IMO Definition: ENC (Electronic Navigational Chart). ENC are authorized by National Hydrographic Office in accordance with the International Hydrographic Organization s (IHO) product specification S Reference to Schedule 2 of the PRIMAR distributor agreement for an overview of the nations who approve PAYS for their ENC data and for detailed subscription terms for PAYS. 3

IMO MSC.232(82), para Summary In order to obtain approval of PRIMAR for their proprietary PAYS service the distributors have to initiate a formal project with the objectives of enhancing the efficiency of ENC distribution and safety of navigation while protecting the copyright of data providers at the same time. The project should clearly demonstrate the tangible benefits to the end-user in terms of operational ease, reduction in administrative burden and perpetual access to ENCs to enable emergency preparedness. The project should be based on the current ENC licensing terms and conditions of PRIMAR and must comply with the requirements listed under par Approval Process 4.1 The distributor wishing to develop a PAYS service submits a formal request and provides a comprehensive project plan 4.2 The project plan is evaluated by the PRIMAR management and reported to the PRIMAR Marketing Group for review 4
5 4.3 If the plan is found satisfactory the distributor will be asked to conduct trials for a minimum period f 3 months. PRIMAR will provide trial data. 4.4 During the trial the distributor must address an authorized certification body to verify: compliance with the specification test result from the trial 4.5 The distributor submits a detailed report to the PRIMAR management including the results of the trial. Approval of the service will be subject to successful completion of the trials and the distributor s ability to clearly demonstrate compliance with all the requirements stated in par. 6 of this document. The onus is on the distributor to demonstrate compliance rather than on the PRIMAR management to verify compliance 4.6 When the service is approved, schedule 6 of the PRIMAR distributor agreement is signed by both parties and access to PAYS is granted 4.7 PRIMAR management notifies the PRIMAR Marketing Group of the final result. 6 5 Distributor responsibilities - pre-requisites 5.1 An existing PRIMAR distributor 5.2 Valid business model focused on PAYS 5.3 A test user-group appropriate for conducting trials and to deliver valid results 5.4 Detailed trial plan describing test period, user group, technical framework and description of what constitutes valid results 5.5 Independent verification of results performed by a certification body. 6 Requirements (subject to the features of the service and technology used) Relevant documentation must be submitted which clearly demonstrates that the service: 6.1 Properly promotes voyage planning and ensures such usage is always fairly encompassed in the licensing and subsequent sales reporting 6.2 Ensures that all ENC products actually displayed and used 3 for navigation are properly licensed and reported to PRIMAR, or at least to a 99.8% level of accuracy where the actual products displayed and used are not explicitly logged. 6.3 Real time reporting of first time usage. A maximum of 48 hours from first time usage to it is registered in the PRIMAR database. The applicant must successfully complete and pass RTR acceptance test: Describes measures to ensure that no misuse of the data is taking place 6.5 Describes procedures that are in place to uninstall all PAYS license keys from the system configuration when the user changes distributor or terminates his license 6.6 Has been developed and is delivered with appropriate quality management solutions, with robust systems and procedures that ensures the quality of all outputs, and thereby gives added confidence that each of the considerations above are met in a reliable manner. 3 Displayed and used: cell bands displayed or used by ECDIS for monitoring functions.
