Everything You Ever Wanted to Know About GHS but Were Afraid to Ask!... and what does it mean for transport? Presented by: David A. Casavant - Authorized OSHA Trainer Executive Director Sustainable Workplace Alliance 102

GHS: Who, What & Why? Started via international mandate in 1992 at the United Nations Conference on Environment and Development (aka Earth Summit ). Became the UN Globally Harmonized System of Classification and Labeling of Chemicals (GHS) Adopted in the U.S. by OSHA as a rule effective May 25,

Implemented Voluntary In Process Not yet 104

GHS Implementation Effective Completion Date Requirement(s) Who December 1, 2013 June 1, 2015* December 1, 2015 June 1, 2016 Transition Period Train employees on the new label elements and SDS format. Comply with all modified provisions of this final rule, except: Distributors may ship products labeled by manufacturers under the old system until December 1, Update alternative workplace labeling and hazard communication program as necessary, and provide additional employee training for newly identified physical or health hazards. Comply with either 29 CFR (this final standard), or the current standard, or both Employers Chemical manufacturers, importers, distributors and employers Employers All chemical manufacturers, importers, distributors and employers

GHS: Who, What & Why? The production and use of chemicals is fundamental to all economies. The global chemical business is more than a $1.7 trillion per year enterprise. In the U.S., chemicals are more than a $450 billion business and exports are greater than $80 billion per year Ultimately GHS will better facilitate international trade in chemicals. 106

Appendix C of the 2012 HCS states: where a pictogram required by the Department of Transportation under Title 49 of the Code of Federal Regulations appears on a shipped container, the pictogram specified on C.4 for the same hazard shall not appear. However, DOT does not view the 2012 HCS pictograms as a conflict with the requirements of the Hazardous Materials Transportation Act, and for some international trade, both the DOT and the 2012 HCS pictograms may need to be present on the label (think: drum). 119

Therefore, OSHA intends to revise Appendix C In the meantime, OSHA will allow both the DOT and the 2012 HCS pictograms for the same hazard to appear on the label. (according to OSHA Brief OSHA636 ) 121
