1 July 2010 RF/EMC Regulatory Update International Issue Dear Colleague, We have provided typical questions and answers that represent in most cases technical opinions with justification in international regulatory requirements. The particulars of the product for certification must be considered with respect to the applicability of these questions and answers. You can view archived issues of MultiPoint at our web site. Indonesia - Labeling Requirements QUESTION: Our firm currently markets our netbook product to Indonesian consumers. I heard there may be some new product labeling requirements that come into effect soon. Can you provide details? ANSWER: On September 1, 2010, a new Indonesian Ministerial regulation becomes effective that mandates the inclusion of labels on various kinds of products to provide consumers with accurate information. All manufacturers or importers of regulated goods to be traded on the Indonesian market must include the labeling in the Indonesian language. There is an eighteen month transitional period for products that have been circulating on the market prior to September 1, The regulation requires that an imported product be appropriately labeled before the product enters the customs area. The label information must be submitted for approval to the Director of Supervision of Available Goods and Services, who will in turn issue a certificate within five working days after receipt of the sample. Manufacturers or importers of regulated goods can proceed with business upon receipt of the certificate. The Ministry of Trade of the Republic of Indonesia issued the labeling regulation as No. 62/M-DAG/PER/12/2009 on December 21, 2009 and its revision 21/M-DAG/PER/5/2010 on May 21, The specific products covered are classified into four categories as stated in Annex I to IV of the regulation: Annex I - Household Electronics, Telecommunication & IT devices (46 items) Annex II - Building construction material (8 items) Annex III - Motor vehicle materials (spare parts and others) (24 items) Annex IV - Other commodities (25 items) The labeling specifications require that the Indonesian language be used in a manner that can easily be understood (Arabic digits, Latin letters are allowed if there are no proper equivalent Indonesian terms). The label must also include the following: Name and/or brand name Name and address of manufacturer (for local manufacturing) Name and address of importer (for imported goods) Country of origin Additional information may be necessary depending on the product type. Requirements for label placement, either on the product, on the packaging, or on both, depend on product type.

2 Argentina - Cord and Plug Requirements QUESTION: Our firm has a product that is already approved for sale in Europe. Can we use the same cord and plug in Argentina? ANSWER: No you cannot. Though your product was approved for use in Europe, the power cord itself has to be certified; the connector under IEC 60320, the cable under IRAM 2158 or IEC 60227, and the plug under IRAM 2063 or Chile - Strong in the Latin Market QUESTION: Our marketing team is looking into Latin America as a potential new market for our products. Which country is the most likely to want new technology? ANSWER: Chile is the most mature telecom market in Latin America and the region's pioneer when it comes to new technologies. In fact, Chile was the first country in Latin America to see services such as mobile WiMAX, IPTV, wireless TVoIP, triple play, EDGE, and mobile voice-to-text, among others. It was the second country in the region, after Puerto Rico, to have 3G mobile services. In December 2009, Chile became the first country in Latin America, and the fifth in the world (after Sweden, Norway, Japan, and the USA), to test LTE technology. Chile is viewed as a role model by the international business community for its competitive free market approach. In the Global Competitiveness Report , Chile was ranked thirtieth in the world and first in Latin America, scoring well thanks to a highly developed infrastructure, transparent institutions, and well-functioning goods and financial markets, but doing poorly in terms of its education system. Norway - License Exempt Spread Spectrum QUESTION: In Norway, can the use of spread spectrum be made license-exempt? If so, under what conditions? ANSWER: The use of spectrum requires a license from the NPT unless the relevant spectrum is specifically mentioned in the Regulations of April 20, 2007, No. 439, regarding general authorizations for the use of radio frequencies. Oman - Labeling Requirements QUESTION: We recently had our radio product approved for sale in Oman. What are the label requirements? ANSWER: As of June 23, 2010, the Omani Telecommunications Regulatory Authority (TRA publication, GUD/TA/0066), specified new label requirements. The label must be affixed to the product, the user information documents (i.e, the user guide), and the product packaging. In cases where it's not possible to apply the label to the product itself, the label may be applied to the packing and / or user documentation only, however the TRA must be informed in advance of your intention to do this. Exemptions: there are no labeling requirements for the following products: Modules already integrated in to the host prior to import, and equipment for use in automobiles which is already integrated in to the vehicle prior to import Network infrastructure equipment imported for installation in the public licensed telecom networks Approved products currently being imported into Oman are considered exempt from labeling until June 30, Please see below for the label design and specifications:

3 Minimum permitted label dimensions are 10mm (height), 18mm (width). 'X/NNNN/YY' refers to equipment class, Type Approval No. and year of approval. Dyynnnn refers to the Dealer Registration No. assigned by the TRA. The text "OMAN-TRA", the Type Approval No. and the Dealer No. must be a minimum height of 1.5mm. Russia - Refusal Letter QUESTION: Our company heard of something called a "refusal letter" for Russia. Can you tell us what this is? ANSWER: : A refusal letter is an official document issued by a certification authority which states that no mandatory certification is required for the product, or that the product belongs to a group of products for which compliance can be confirmed with a compliance declaration. A refusal letter must be written on the letterhead of the authority that issues it and must bear the coat of arms seal of said authority. Refusal letters can be issued to customs or to Russian Federation business partners. INTERNATIONAL REGULATORY UPDATES BAHRAIN - ONE YEAR TERM FOR SRD TYPE APPROVAL CERTIFICATES The Kingdom of Bahrain Ministry of Transportation Directorate of Wireless Licensing Frequency & Monitoring (DWLFM) recently announced the release of Circular No. DLM/GEN/18/952: Issue Type Approval Certificate for Short Range Device (SRD). This document specifies that effective June 2, 2010, Type Approval for SRD will normally be granted for a term of one year. An annual renewal fee is required to keep a registration in effect. The renewal application must be submitted at least one month before the expiration date. The DWLFM reserves the right to cancel the Type Approval at any time if it has reason to believe that the relevant regulations and technical requirements have not been observed. TAIWAN - ADDITIONAL BSMI TEST REQUIREMENTS The Bureau of Standards, Metrology and Inspection (BSMI) intends to implement the additional two test items regarding the related testing above 1 GHz and conducted disturbance at telecommunication ports of CNS beginning October 1, (CNS 13438: Information technology equipment - Radio disturbance Characteristics - limits and methods of measurement). Related requirements are as follows: 1. Starting October 1, 2010, the regulated products that are required to comply with CNS must conform with the testing items of radiated disturbance above 1GHz, and conducted disturbance at telecommunication ports of CNS as required in the standard (hereinafter as the legal inspection items). 2. The testing items are applicable to products that have internal emission sources utilizing a frequency more than (and including) 108MHz and / or telecommunication ports such as Information Technology Equipment (ITE), multimedia equipment and similar equipment that are tested to comply with CNS Starting from the implementation date, products covered in this notice shall comply with the newly-added requirements in CNS when the application for the Registration of Product Certification (RPC) or Type Approval (TA) certificate is submitted to BSMI. The BSMI will accept such applications complying with the 2 testing items starting from the date of adoption of the notice. When the BSMI completes the review procedure and approves the application, a certificate will be issued and the applicable inspection standard column will be additionally stated "complete 2006 version". 4. For those products that have been certified before the date of implementation, the certificates that are issued without implementation of the testing items will remain valid until the date of expiration, provided that the products, including main model, are not modified. For products that require that the additional testing be conducted, the certificates may be used until the expiration date; certificate holders may not apply for an extension of validity of the certificate. For products for which the additional testing is not applicable, the certificate holders may apply for an extension of validity. 5. For product certificates that are issued without implementation of the testing items, applications for adding

4 series models are acceptable before the date of implementation. Such certificates may be used until the expiration date and the certificate holders may not apply for an extension of validity of that certificate. If the main model and series models of a certificate are tested and comply with the above-mentioned testing items, the certificate holder may apply for a new certificate. The term of validity of the new certificate will be 3 years and the applicable inspection standard column will be additionally stated "complete 2006 version". 6. When applying for adding series models that intend to comply with the testing items, all the existing main models and series models of the certificate shall be tested and comply with the same requirements. A new certificate will be issued in the same time for such applications. 7. Starting from the date of implementation, for products for which the testing items are applicable and the applicable inspection scheme is Declaration of Conformity, the obligatory inspection applicant shall have their products tested and will comply with the complete test requirements, and will re-declare the conformity (re-issue the declaration of conformity) according to the relevant regulations before putting the product on the market. UKRAINE - NEW REQUIREMENTS Ukraine's requirement for product entry into the Electronic Device Register prior to the start of the certification effort is due to change in the next month or two. The new requirement will be for the product to be listed in the Electronic Device Register prior to importation for sale. This change should result in shorter Type Approval cycle-times in the Ukraine. Only one manufacturing location is now permitted to be listed on each Type Approval certificate. Separate Type Approval certificates are needed for each factory. Ukraine's Type Approval requirements are set to change further. In 2012, it is expected that Ukraine's Type Approval rules will align with EU Directive 1999/5/EC. Harmonization of their type approval standards is currently in process. MEXICO - NOM-121 PUBLISHED On June 21, 2010, COFETEL formally published Regulation NOM-121-SCT which will become effective August 21, After that date, in order to obtain a COFETEL certificate for a product that falls under NOM-121, one sample is required for "in-country" testing in Mexico.
