7 Governmental, Legal and Regulatory Framework for Safety Requirement 23: Authorization by the (RB) Authorization by the RB, including specification of the conditions necessary for safety, shall be a prerequisite for those facilities and activities that are not explicitly exempted or approved by a notification process. Requirement 24: Demonstration of Safety for authorization The applicant shall be required to submit an adequate demonstration of safety in support of an application for authorization. Requirement 7: Coordination of different authorities with responsibilities for safety within the regulatory framework. Where different authorities have responsibilities in the regulatory framework for safety, the government shall provide for the effective coordination of their regulatory functions, to avoid any omissions or undue duplication and to avoid conflicting requirements being placed on authorized parties 6

9 Definitions Licence: legal document issued by the RB granting authorization to create a nuclear installation and/or to perform specified activities Licence = Permit = Certificate = Authorization Applicant: person or organization who applies for authorization Licensee: person or organization having the overall responsibility for a nuclear installation ant its activities Licensing process: includes all licensing and/or authorization required throughout the lifetime of a nuclear installation from siting to delicensing 8
10 Objectives To ensure adequate demonstration of safety and compliance with legal and regulatory requirements Authorization is issued when the RB is satisfied there is adequate protection of the people and the environment, At any stage of the lifetime of a nuclear installations, from siting to delicensing; To establish regulatory control over all activities and facilities where safety is concerned a license or other prior authorization shall be in force covering, as appropriate, safety related aspects. 9
11 Objectives Two major players Regulatory Body Defines the safety criteria, requirements, guidelines and documents to be provided by the applicant (operating organization) Establish a mechanism to solve safety issues with the applicant Operating Organization Prepare and submit the required documentation Be prepared to respond to the requests of the regulatory body The public should be given an opportunity to provide their views during certain steps of the licensing process 10

16 Licensing Steps Siting and site evaluation DesignConstruction Commissioning Operation Decommissioning Release Standardized NPP does not exist, licence applicant must be an intelligent customer Be able to perform a safety assessment of the design Design should: be developed according to the defence in depth approach be in accordance with the design basis (conditions, events manageable by the installation) be in compliance with relevant standards, codes and regulatory requirements consider the replacement of heavy and large components during its life (steam generator, reactor pressure vessel heads, etc.) by taking into account: buried pipes and conduits, openings in structures for equipment access, obstructions consider the access of components important to safety for Maintenance, inspection and testing, replacement occupational exposure, decommissioning consider transport of radioactive materials be based on site characteristics 15
17 Licensing Steps Siting and site evaluation Design Construction Commissioning Operation Decommissioning Release Before granting an authorization for the construction, followings should be reviewed, assessed and inspected by the RB: Site evaluation Demonstration of the selected design meets safety objectives and criteria Appropriate organizational and financial arrangements for mid/longterm issues (decommissioning, radioactive waste and spent fuel management) Management system of licensee and vendors as necessary in place covering all aspects of construction 16
18 Licensing Steps Siting and site evaluation Design Construction Commissioning Operation Decommissioning Release Commissioning can be divided into main stages, regarding: Non nuclear testing, before introducing nuclear/radioactive material To ensure, to the extent possible, the installation has been constructed and equipment manufactured and installed properly To prove the design performance SSCs should be put into service after being inspected, tested and approved by the licensee in accordance with the requirements set out in the design as agreed by the RB Nuclear testing after introducing of nuclear or radioactive material To confirm the nuclear installation is safe before proceeding to routine operation, may require an authorization from the RB 17
19 Licensing Steps Siting and site evaluation Design Construction Commissioning Operation Decommissioning Release Before starting a commissioning programme The RB should conduct reviews, assessments and/or inspections to determine whether: The commissioning test programme is complete and contains a set of well defined operational limits, test acceptance criteria, conditions and procedures The commissioning tests can be safely conducted as proposed by the licensee and their justification is appropriate 18

24 Contents of a Licence A sufficiently detailed description of the nuclear installation; The maximum allowable inventories of sources covered by authorizations; The requirements for notifying the regulatory body of any modifications that are significant to safety; Any limits on operation and use (such as dose and discharge limits) The requirements for reporting events and incidents at the installation; The requirements for providing routine reports to the regulatory body The requirements for retention of records; The requirements for arrangements for emergency preparedness; The documentary basis: the documents in support of the application and those prepared and/or used by the regulatory body The licence may refer to the Operational Limits and Conditions 23
25 Contents of a Licence The requirements for retention of records by the person or organization responsible for the nuclear installation and its activities, including the time periods for which records should be retained; The requirements for arrangements for emergency preparedness; The means and procedures for changing any information stated in the licence; The documentary basis: the documents in support of the application and those prepared and/or used by the regulatory body in the review and assessment process, which together form the basis for issuing the licence; The licence may refer to the Operational Limits and Conditions 24
26 Examples of Licensing Documents A draft plan for the project, including phases and anticipated schedule A site evaluation report, which may include a report on the environmental radiation monitoring Reports on the use of cooling sources and discharges to the environment and the and a report on the environmental impact assessment Public inquiry strategy plans and reports according to each State s framework and practices A report on the management and organization of the design and construction project, including responsibilities and a list of contractors 25
