22 (b)(3) Maintaining a planked and decked floor A fully planked or decked floor or nets shall be maintained within two stories or 30 feet, whichever is less, directly under any erection work being performed.

Can an employer's requirement that workers be protected by fall arrest equipment at all times above 15 feet (or less) take the place of nets and temporary floors? Answer: Yes. Where an employer establishes, communicates and enforces a requirement to be protected by fall arrest equipment at all times above 15 feet (or less), the failure to comply with (b)(3) is considered a de minimis violation and will not be cited.
