4 Windfarm Planning Activities (February March 2015) Utility company requests use of TxDOT s load zoned roadway (FM 1847) for the purpose of wind farm development Utility company secures financial portfolio, investors, work schedules, subcontractors, etc. and ready to start the project Utility company s schedule shows critical milestones in place within months of notice to TxDOT challenging to get agreements in place. TxDOT s Mission and Goals Economic Development, Work with Others 4
5 Windfarm Planning Activities (April May 2015) TxDOT in general agreement with use of load zoned roadway provided utility company signs Highway Crossing Agreement for damages incurred. Set at $3.6 M ($ 400 K/ mile) for reconstruction efforts (gentleman s agreement). Pavement evaluation performed by District Lab showing two years of remaining service life General understanding that roadway repairs are to be handled through utility company s contractor Highway Crossing Agreement executed with pre-existing damage to roadway TxDOT s Mission and Goals Economic Development, Work with Others 5
6 Windfarm Construction (May July 2015) Roadway deficiencies identified early on TxDOT crews performed roadway repairs while utility company tries to finalize work with roadway contractor. Repaired pavement section includes 15 of cement treated limestone and 1 of coldmix Damage claim set up in Maintenance Management System (COMPASS) tracking labor, materials, and equipment 6
7 Windfarm Construction (July September 2015) Roadway deficiencies continue and more extensive due to plant setup, influx of sub-contractors and Super Heavy deliveries TxDOT crews continue to repair damaged roadways and thus placing a strain on Maintenance Section Utility company unsuccessful in securing roadway contractor due to high cost for repairs. Requests TxDOT to perform the service and will pay damages incurred. TxDOT s Mission and Goals Work with Others 7

15 Windfarm Construction (October 2015) Roadway repairs account for approximately 70% of the 9 Mile Load Zone Roadway TxDOT crews mobilize from other sections and address the deficiencies to keep the roadway safe and passable Windfarm project complete ~ 8 Month duration TxDOT provides cost via a damage claim for their review ~ $ 2 M. 15

17 Project Closeout/Negotiations (November 2015 September 2016) Utility company questions validity of Highway Crossing Agreement, responsibility, and remaining service life. Utility company offers to place 2 of hotmix to cover up roadway patches ~ $ 500 K Two rounds of negotiations with utility company TxDOT receives $ 700 K for damages incurred (estimated cost to bring roadway back to existing conditions) 17
18 Lessons Learned Before Donation Agreement During Agreement Process Project Closeout/Nomination Advance coordination with utility company to identify scope of work, haul roads, plant location, project duration, sub-contractors, and responsibilities. Complete District checklist to estimate damages Utilize Donation Agreement to maximize reimbursement efforts Evaluate alternate off-system routes to relieve stress on roadway Owner is to perform roadway repairs through the duration of the project at their cost Continue to Work With Others Establish weekly drives identifying repair work and locations Continual communication Document correspondences (phone calls, s, etc.) Determine middle ground and justifiable costs Know that TxDOT will need to pay for some costs 18
