Suite 100 Houston, TX 056 Phone: (13) Toll free: (00) Address Phone *** Phone: Fax: Project XXXX Rig Rig Name Purpose Under the requirements of Federal Regulation 30 CFR Part 250 (Regulation), Apache (the Operator) and Contractor X (the Contractor) must agree to the Safety and Environmental policies and practices to be used at each facility and clearly define roles and responsibilities under such policies and practices prior to performance of oil, gas and sulphur activities in the Gulf of Mexico. This Agreement specifies the expectations regarding safety and environmental management between the Operator s SEMS and the Contractor s safety and environmental policies and practices. Operator is defined to mean the person the lessee(s) designates as having control or management of operations on the leased area or a portion thereof. An operator may be a lessee, the BOEMRE approved designated agent of the lessee(s), or the holder of operating rights under a BOEMRE approved operating rights assignment. Contractor is defined to mean the individual, partnership, firm or corporation retained by the owner or operator to perform work or provides supplies or equipment, and shall include subcontractors. This Agreement does not supersede the requirements of any applicable regulations or any other Service Agreements between the Operator and the Contractor. Please ensure that all supervisors receive copies and discuss the contents with their respective crews. The primary objective is that all work be performed safely, in compliance with regulatory requirements, and in an environmentally responsible manner. The goals can only be achieved through the cooperation of all parties involved in the project. The manuals and other documents referenced are available onboard the drilling rig, at the shorebase, and at Apache and Contractor X at the addresses identified above. All supervisory personnel involved in the drilling and completion program are expected to review the relevant documents. Apache and Contractor X This shall govern the various emergency response and operational safety procedures to be followed while drilling and completing the project subsea well(s) to ensure compliance with Apache s safety and environmental management system (SEMS) requirements. Please read, understand, and acknowledge receipt of this information. Then, sign and return the acknowledgement receipt included for your convenience. The following tables indicate whether the Apache or Contractor X manuals, policies, responsibilities, and procedures prevail during the term of this agreement. All Contractor X documents indicated in the table must be delivered to Apache before starting work on the project. Page D-29-A-1

6 Certification Contractor X agrees to and certifies: All Contractor X personnel performing work for Apache have the skills and knowledge to perform their assigned duties All Contractor X personnel are knowledgeable of Apache SEMS requirements that apply to the assigned work Contractor X has Safe Work Practices (SWPs) for all work (except domestic services) and these are consistent with the Apache SEMS program All activities performed by Contractor X personnel will be conducted in accordance with the requirements in the Apache SEMS program and the Contractor X Safe Work Practices All records required under 30 CFR 250, Subpart S, will be maintained in an orderly manner, readily identifiable, retrievable, and legible and are available for review by Apache and appropriate regulatory authorities on request ation is readily available to personnel including safety policies and procedures ation of personnel skills and knowledge to perform their job in a safe and environmentally sound manner per 30 CFR (b) is readily available Apache agrees to and certifies: Apache completed an assessment of Contractor X before starting work on this project Contractor X ensures conformance with the Apache SEMS during all covered operations Apache evaluated the safety and environmental performance of Contractor X and found it acceptable Contractor X has been provided with appropriate site-specific safety, environmental and emergency evacuation information and training before starting work on this project Apache will retain Contractor X personnel injury and illness log for 2 years, related to Contractor X work performed on this project Page D-29-A-6
7 The Apache assessment of Contractor X included verification that Contractor X employees have the skills and knowledge to perform their assigned duties and can conduct these activities in accordance with the requirements in the Apache SEMS program per 30 CFR (c)(2). Acknowledgement and Receipt I acknowledge receipt of this. I further acknowledge that I have read the document and agree to abide by the safety rules, practices, codes, standards, and regulatory requirements that apply to the projects, and will disseminate appropriate information to my employees, contractors, and subcontractors. In addition, Contractor X has supplied Apache with the documents indicated above for evaluation and approval.
