6 Agenda item 3 : Amendments to the IMDG Code and supplements, including harmonization of the IMDG Code with the UN Recommendations on the Transport of Dangerous Goods DSC 11/3 (the Editorial and Technical Group) This document contains the outcome of the Editorial and Technical Group meeting held from 3 rd to 7 th October, 2005, and includes the following : Finalization of errata and corrigenda to the IMDG Code (amendment 32-04); Finalization of amendment to the IMDG Code; Polymeric beads (UN 2211) and Plastics moulding compound (UN 3314); Change of flashpoint from 61 C to 60 C - IMO instruments requiring consequential amendments; and Amendments to the EmS Guide. DSC 11/3/1 (Poland) Special provision for Magnesium Nitrate (UN 1474). This document contains a proposal for an amendment to the IMDG Code regarding the possibility of applying special provision 223 to Magnesium Nitrate (UN 1474). The present document informs about the properties and experience in Magnesium Nitrate transportation. DSC 11/3/2 (Germany and Sweden) Transport of dangerous goods on ro-ro ships in sea areas with limited wave heights This document describes the transport situation to and from the Nordic countries when transporting in accordance the IMDG Code. The document proposes a new chapter in the IMDG Code as follows : Sea areas with limited wave heights Competent authorities may jointly authorize any other provision by equivalent arrangement in sea areas with limited wave heights if satisfied that such provision is at least as effective and safe as provided by the IMDG Code. A copy of the arrangement shall be sent to the International Maritime Organization. A copy of the equivalent arrangement or an electronic copy thereof shall be maintained on board each ship transporting dangerous goods in accordance with the arrangement. DSC 11/3/3 (Germany) Use of unpacked dry ice for cooling purposes in cargo transport units. Dry ice has been reported to be used unpacked for cooling purposes in standard freight containers without declaration as dangerous good. When transported under deck the release of carbon dioxide gas will significantly reduce the oxygen content and thus endanger persons. Unpacked dry ice in standard containers might impair the structural safety of the containers. The provisions of the IMDG related to the transport of dry ice appear confusing and require clarification. The Sub-Committee is asked to agree with the interpretation that transport of unpacked dry ice in freight containers is not permitted. The text of special provision 297 should be amended to the wording in SP 297 of the UN model regulations with the exception of the requirements for air transport, which should be omitted. In the subsection.8 should be amended to the following wording : When packages containing carbon dioxide solid (dry ice) are loaded into the container/vehicle the exterior of the container/vehicle is conspicuously marked on two sides WARNING CO2 SOLID (DRY ICE). DSC 11/3/4 (Germany) Missing UN numbers in the IMDG Code. In the 14th revised edition of the UN Recommendations on the Transport of Dangerous Goods are some UN numbers mentioned which are missing in the IMDG Code. DSC 11/3/5 (Germany) Segregation Groups and Index. Under segregation group 1 (acids) the UN 2794 is missing. Furthermore after introduction of a new UN 3401 for ALKALI METAL AMALGAM, SOLID and UN 3402 for ALKALINE EARTH METAL, AMALGAM, SOLID amendment to UN 1389 these amendments are not reflected in the Index. 7 Report of the Working Group on the Review of Annex III of MARPOL 73/78. This submission summarizes the results of the discussions in the Working Group on the Review of Annex III of MARPOL 73/78 during DSC 10 outside normal working hours. All consequential amendments to the IMDG Code as developed by the group are set out in annexes 3, 4, and 5 of this document. The group kept the IMDG Code chapters 2.9 and 2.10 separate. This will enable a full harmonization of chapter 2.9 with the equivalent chapter in the UN Model regulations whilst having all specific maritime regulations on marine pollutants in a dedicated chapter (IMDG Code chapter 2.10). The Group draws the attention of the Sub-Committee to the fact that the revision of MARPOL Annex III and the amendments to the IMDG Code may impact on other IMO documents, e.g., circulars, as well as the relevant model training courses, and these could require consequential amendments. DSC 11/3/7 (Belgium) Transport in portable tanks. This document contains a proposal to delete the Portable Tank Special Provision TP13, which states A self-contained breathing apparatus shall be provided when this substance is transported, from the IMDG Code. At the time when the TP13 was introduced, SOLAS chapter II-2/19 and the former II-2/54 did not exist. The only way to require extra breathing protection was to state the requirement in the IMDG Code. Nowadays almost all ships have to comply with SOLAS II-2/19 (or II-2/54) and are required to have two self-contained breathing apparatus in addition to the two self-contained breathing apparatus already required by the fire-fighting equipment (SOLAS 74, as amended). The foregoing indicates that on board there are already four self-contained breathing apparatus, which is considered to be enough for dealing with an emergency situation. DSC 11/3/8 (Canada) Incident regarding stowage and handling of explosives. This document is submitted to highlight the need for clarification in Part 7 of the IMDG Code concerning the requirements for damaged packages containing explosives. While part (Wetness) does address such packages being affected by water whilst on board, this part provides insufficient requirements concerning damage to packages, possible spillage, the important need to clean up spillage and why. Information describing a recent incident involving a small explosion that highlighted the need for this proposal is also included. This document proposes that Section should be expanded to include provisions required to safely deal with spillage of material due to damaged packaging, in addition to wetness. There is also danger from wetted material of Class 1 drying and not being properly detected. It is proposed to add a new general clause as follows : In the event that any package of Class 1 is found to be damaged, expert advice shall be obtained for its safe handling and disposal. The responsible person supervising the handling shall ensure that spillage is immediately collected and safe arrangements are made for its repackaging or disposal. Unloading procedures and equipment used shall be of such a nature that sparks are not produced, in particular where the floors of the cargo compartment are not constructed of close-boarded wood. All cargo handlers shall be briefed by the shipper or receiver of the possible risks and necessary precautions, prior to commencing the handling of the explosives. DSC 11/3/9 (Germany) Alkaline storage batteries (household) involved in an accident. This submission summarizes the results of an independent maritime casualty investigation on a fire onboard a German container vessel. According to this investigation there is an urgent need for a review of the transport provisions in particular those for UN 3028 BATTERIES, DRY, CONTAINING POTASSIUM HYDROXIDE, SOLID electric storage. DSC 11/3/10 (Belgium, France and the Netherlands) Segregation provisions. In response to the invitation by the Sub-Committee at its tenth session, Belgium, France and the Netherlands reviewed the segregation requirements. This document contains proposals to correct some inconsistencies and to delete the competent authority approval for away from stowage in containers and the necessary consequential amendments. DSC 11/3/11 (the United States) Inclusion of segregation groups on the transport document. A minor revision to the text of of the IMDG Code is proposed to clarify how to include the appropriate segregation group in the transport document. 8 DSC 11/3/12 (Secretariat) Difficulties encountered with shipment of the IMDG Code class 7 radioactive materials. This document provides information relevant to the consideration of issues regarding the difficulties encountered with shipment of the IMDG Code class 7 radioactive materials. DSC 11/3/13 (the Islamic Republic of Iran) Harmonization of Labelling/Placarding Location on Containers carrying Dangerous Goods. This document provides proposals by the Islamic Republic of Iran to avoid misinterpretation of beneficiaries including operators, liners and shippers regarding exact location of labelling/placarding. DSC 11/3/14 (the Republic of Korea) Deletion of SP 911 for Carbon Dioxide UN This document presents that 911 in SP column of DGL (Dangerous Goods List) and SP 911 in paragraph for Carbon Dioxide (class 2.2, UN 1013) will be deleted in order to avoid user s confusion. DSC 11/3/15 (the United States) Comments on the use of UN 3166 and UN This document provides comments on the paper DSC 11/3/4 to include UN 3166 and UN 3171 in the dangerous goods list of the IMDG Code. Furthermore, alternative technologies such as lithium ion batteries and hydrogen fuel cells have been developed to power vehicles and equipment. Dangerous goods within vehicles are not subject to the tests specified in the UN Manual of Tests and Criteria. Additional precautions may be necessary to safely transport these types of vehicles and equipment. DSC 11/3/16 (the United Kingdom) Stowage and segregation provisions. This paper comments on DSC 11/3/10 and makes a proposal to review the current stowage and segregation provisions of the IMDG Code. DSC 11/INF.5 (Finland) Study on the concept low wave height area (LWHA). This document provides supporting information regarding the concept low wave height area (LWHA) as an example for sea areas with limited wave heights. 9 Agenda item 4 : Amendments to the BC Code, including evaluation of properties of solid bulk cargoes DSC 11/4 (the Chairman of the Working Group) This document provides the report of the working group at DSC 10 on Amendments to the BC Code (agenda item 4) and its Mandatory application (agenda item 5). DSC 11/4/1 (Australia and Japan) Report of the Correspondence Group - Part 1. This document informs the Sub-Committee of the correspondence group s progress on clarification on the classification of Seed Cake, on a schedule for Direct Reduced Iron (DRI) Fines and on the amendments to the BC Code. DSC 11/4/2 (Venezuela) Analyses of Direct Reduced Iron (A) Briquettes, hot-moulded Fines. This document also includes results of analyses conducted on industrial representative samples of Direct Reduced Iron (A) Briquettes, hot-moulded Fines from Venezuelan producers. Analyses were conducted by an independent laboratory in the USA and by the producers laboratories. DSC 11/4/3 (Venezuela) Hazards and risks associated with the carriage of Direct Reduced Iron (A) Briquettes, hot-moulded Fines. The purpose of this document is to present the results obtained to identify the hazards and risks associated with the transportation of Direct Reduced Iron (A) Briquettes, hot-moulded Fines, as requested in DSC.1/Circ.36. Therefore, a proposed schedule for the classification of the Direct Reduced Iron (A) Briquettes, hot-moulded has also been included for consideration. DSC 11/4/4 (Venezuela) Safe practices for the carriage of Direct Reduced Iron (A) Briquettes, hot-moulded Fines. The purpose of this document is to define the appropriate practices for the transportation of Direct Reduced Iron (A) Briquettes, hot-moulded Fines, implemented by Venezuelan s Maritime Authority, as requested in DSC.1/Circ.36. DSC 11/4/5 (Germany) Classification of sulphur. Sulphur (lump and coarse grained) is listed in the BC Code in group B (cargo with chemical hazard) under class 4.1 UN This classification appears inconsistent with UN 1350 SULPHUR class 4.1 in the IMDG Code where UN 1350 does not apply to sulphur formed to a specific shape. This could lead to misinterpretation and confusion. For clarification it is proposed to amend the entry in the BC Code to MHB. DSC 11/4/6 (Italy) Transport of chopped tyres in bulk. This document contains new information about properties of products obtained from used tyres and new proposal to include a new entry for CHOPPED TYRES in coarse size in Group C of the BC Code. DSC 11/4/7 (the United States) Establishment of criteria for Materials Hazardous only in Bulk (MHB). The establishment of criteria for MHB is proposed to clarify which solid bulk cargoes that are not classified as dangerous goods in the IMDG Code and possess a chemical hazard that could give rise to a dangerous situation on a ship. Based on the criteria, the MHB classification is proposed for AMMONIUM NITRATE BASED FERTILIZER (Non-Hazardous), CHROMITE ORE, and TAPIOCA. DSC 11/4/8 (Canada) Self-heating of a cargo of coal. This document is submitted to highlight the need to be aware of the characteristics of cargo provided by the shipper, and the type of vessel used to carry it. In this instance, the cargo is coal with a history of self-heating that was carried on a self-unloader type vessel. The main aim of this proposal is to facilitate how to correctly assess the suitability of a vessel type for certain types of cargoes based on the characteristics of the cargo to be loaded. DSC 11/4/9 (Australia) Transport of fuzzy cotton seed. This document proposes that the carriage of fuzzy cotton seed is regulated in the BC Code and provides a suggested schedule for inclusion as a Group B, MHB commodity. 10 DSC 11/4/10 (the Republic of the Marshall Islands and INTERCARGO) Comments on the report of the correspondence group - Part 1. The purpose of this paper is to provide additional comments on and recommendations to annex 2, Draft Schedule for DRI (A) Fines, made necessary as the result of information gained subsequent to the deadline for the submission of Part 1 of the Correspondence Group s report. DSC 11/INF.6 (Australia) Fuzzy cotton seed laboratory test report. This document provides the results of laboratory tests on fuzzy cotton seed samples that exclude its categorisation as a dangerous good. 11 Agenda item 5 : Mandatory application of the BC Code Executive LR Synopsis on part of DSC 11 agenda item 5 Background : The problems involved in the carriage of bulk cargoes were recognized at the 1960 International Conference on Safety of Life at Sea, but at that time it was not possible to include detailed requirements, except those for the carriage of grain. The Conference did recommend, however, that an internationally acceptable code of safe practice for the shipment of bulk cargoes be drawn up under the sponsorship of the IMO. This work was undertaken and several editions of the Code of Safe Practice for solid Bulk Cargoes (BC Code) have been published, since the first edition in The prime hazards associated with the shipment of solid bulk cargoes are those relating to structural damage due to improper cargo distribution, loss or reduction of stability during a voyage and chemical reactions of cargoes. Therefore the primary aim of the BC Code is to facilitate the safe stowage and shipment of solid bulk cargoes by providing information on the dangers associated with the shipment of certain types of solid bulk cargoes and instructions on the procedures to be adopted when the shipment of solid bulk cargoes is contemplated. LR position : LR fully support the mandatory application of the BC Code to all appropriate ships, as this is consistent with the way we recommend application in it s current form. Implications : Owners : Noticeable impact related to the mandatory application for all appropriate ships, in particular the extra equipment to be provided and procedures to be adopted. Shipbuilders / Equipment manufacturer : None. National Administration / Recognised Organisation : Noticeable impact related to this mandatory application and the issue of the necessary documentation / certification. Application : Currently, this agenda item is due to be completed in 2007, at DSC 12. When approved and adopted, by MSC, the mandatory application of the BC Code would affect all ships carrying solid cargoes in bulk. Approval of these amendments by MSC should not be expected before 2008, with adoption not before 2009, so that the entry into force will not be before DSC 11/5 (Australia and Japan) Report of the Correspondence Group - Part 2. This document informs the Sub-Committee of the correspondence group s progress on redrafting of "Foreword" and new section 1 and the amendments to chapter VI and VII of the SOLAS Convention for mandatory application of the BC Code. DSC 11/5/1 (Australia and Japan) Report of the Correspondence Group - Part 3. This document informs the Sub-Committee of the correspondence group s progress on identification of mandatory and recommendatory parts and redrafting work of the text for mandatory application of the BC Code. DSC 11/5/2 (Australia) Identification of mandatory and recommendatory parts of the BC Code, including consequential amendments. Requirement for exemption provisions once the BC Code has mandatory application. This document identifies areas for improvement on the outcomes of the Correspondence Group on the Mandatory Application of the BC Code, regarding redrafting of the current text to enable mandatory application. 12 Agenda item 6 : Casualty and incidents reports and analysis DSC 11/6 (Germany) Explosion on board m/v RICKMERS GENOA. In March 2005 the general cargo ship RICKMERS GENOA collided with the general cargo ship SUN CROSS in the Yellow Sea. SUN CROSS sank, and RICKMERS GENOA sustained hull damage to the port side. Her number 1 hold was flooded up to six meters. Subsequently an explosion occurred and the chief officer was reported as missing. The investigation showed that the cargo, which was not declared as dangerous, reacted with the sea water under evolution of flammable gas. Most probably, an explosive atmosphere was generated in the hold which was ignited when the chief officer checked the water level. DSC 11/6/1 (Canada) Results of inspections on packaged dangerous goods. 15 Agenda item 9 : Review of the SPS Code Executive LR Synopsis on part of DSC 11 agenda item 9 Background : In 2004 at MSC 78, it was considered the there was need to update the Code of safety for special purpose ships (SPS Code) to reflect recent amendments to SOLAS chapter III and the adoption of the LSA Code. Since the adoption of the SPS Code in 1983, many requirements of the SOLAS Convention have been amended and considerable experience gained in the Code s application. It was, therefore, considered be a good opportunity for a review of the whole of the SPS Code, as a high priority item on. Two sessions were considered necessary to complete this item, in the work programmes of the DE (as co-ordinator), COMSAR, DSC, FP, NAV and SLF Sub-Committees. LR position : LR has been involved with this review at most sessions of the Sub-Committees, therefore we fully support this review. Implications : Owners : Noticeable impact related to the mandatory application for all appropriate ships, in particular the additional equipment to be provided and procedures to be adopted. Shipbuilders / Equipment manufacturer : Noticeable impact related to the related to the mandatory application for all appropriate ships, in particular the possible need to redesign these ships and the provision of the additional equipment. These additional costs will need to be passed to the owner. National Administration / Recognised Organisation : Noticeable impact related to approval of the arrangements and the issue of the necessary documentation / certification. Application : Currently, this agenda item is due to be completed in When approved and adopted, by MSC, the revised SPS Code would be applicable all ships carrying special personnel, who are not crew or passengers. This document presents the outcomes of the deliberations of the Correspondence Group on the revision of the LHNS and OSV Guidelines. The LHNS Guidelines are the guidelines for the transport and handling of limited amounts of hazardous and noxious liquid substances in bulk on offshore support vessels, currently contained in the Resolution A.673(16). The OSV Guidelines are the guidelines for the design and construction of offshore supply vessels, currently contained in the Resolution A.469(XII). 19 Agenda item 13 : Guidance on providing safe working conditions for securing of containers Executive LR Synopsis on part of DSC 11 agenda item 13 Background : Building on the work carried out at the previous session, DSC 10, the correspondence group have produced a series of proposals for a possible way forward to ensure that container ships have suitable and safe securing access, under a number headings, namely : identification of best design practice for container ships; identification of best design criteria for container ships; improvement in cargo operational procedures; improvement to the containership cargo securing manuals; and identification of additional requirements needed for conventional bulk and general cargo ships that carry containers. While many of these proposals are operational in nature, thus outside of the normal scope of work undertaken by LR, there are a number that fall within this scope, the most significant non-operational proposals being : For the identification of best design practice for container ships : o The 1969 tonnage regulations to be reviewed to consider how they may be amended to encourage ship designers, builders and owners to reduce stack heights so reducing the need for lashing on ships. o Designers/builders to conduct risk assessments at the design stage of the ship to ensure that lashing/unlashing tasks can be carried out safely. o Designers/builders to take into account The ILO Code of Practice for Safety and Health in Ports when designing and building such ships. o There should be a requirement that container ship lashing systems are designed to be both workable and practical. For the identification of best design criteria for container ships : o MSC Circ.886 already provides successful current design ideas; ship owners and designers should be encouraged to adopt and develop these design improvements. For the improvement to the containership cargo securing manuals : o The current guidelines for the preparation of the Cargo Securing Manual (MSC/Circ.745) do not address the issue of safe access for container lashing. o The approved securing plan contained in the cargo securing manual should have a risk assessment carried out as part of its approval process. LR position : LR fully supports any process that improves the safety of ships. Implications : Owners : Significant impact in terms of additional costs related to the possible redesign of container ships and the changes in operational securing procedures. Shipbuilders / Equipment manufacturer : Significant impact, in particular to the possible need to redesign container ships if the 1969 tonnage regulations are amended, and the provision of additional and/or redesigned securing equipment/arrangements, the cost of which would have to be passed to the owner. National Administration / Recognised Organisation : Significant impact related to the approval of the redesigned container ships, the approval of any redesigned securing equipment/arrangements, and the extended approval procedure for the container securing manual. Application : This item is due to be completed this year, that is at this session. Any proposal agreed at this session will have to be considered by other Sub-Committees (namely SLF for the 1969 tonnage regulations aspects and DE for the equipment aspects) before it passes to MSC for approval and adoption. On the basis that there would be at least 2 sessions needed by the SLF Sub-Committee, the earliest they would complete this work is during 2008, the earliest approval by MSC would be 2009 and adoption in 2010, so that the entry into force will not be before These amendments would be applicable, whether on a mandatory or non-mandatory basis, to all ship types that carry containers. DSC 11/13 (the United Kingdom) Report of Correspondence Group on the Guidance on providing safe working conditions for securing of containers. The main task of the group was to identify where improvements can be made in the design and operation of containerships to enhance safe working conditions for securing of containers for both shore workers and ships crew.
