1 SNOW CREEK ARCHITECTURAL DESIGN GUIDELINES AND CONSTRUCTION AGREEMENT REVISED MARCH 2019 GENERAL INFORMATION The Arhitetural Review Committee ( ARC ) must review and approve all onstrution that takes plae within the development. This inludes homes, other buildings, grading, landsaping, driveways, fenes, walls, gates, antennas and anything else plaed on the lot. The ARC onsists of members of the Board of Diretors plus a onsultant who reviews all submittals. The ontat person is: Howard Reihsfeld N. Tatum Blvd. Ste Phoenix, AZ Telephone: hreihsfeld@aol.om All onstrution appliations are sent to Howard. Howard manages plan review and onsite inspetion for the Assoiation. Howard performs an initial review of all submittals to determine if they are omplete. After the submittal is omplete, Howard meets with the other members as needed and the review is proessed as soon as possible. If it is inomplete, Howard will ontat the owner or builder for the additional information before the review is started. If you have questions regarding the review proess, please ontat Howard. In addition to assisting in plan review, it is Howard s job to onfirm that all onstrution is in aordane with approved plans. Howard will be inspeting all onstrution whih takes plae in Snow Creek. If you have any questions about issues whih need to be addressed on site, give Howard a all. The most important key to a quik approval of your projet is a omplete submittal. The Assoiation will not start a review, look at plans or onsider materials until the submittal, together with all required samples, plans and a hek for the review fee are reeived. The ARC will not review or omment on partial appliations or plans whih do not show adequate detail. All submittals, hanges and responses must be in writing. No member of the ARC has the authority to approve any request verbally. A omplete submittal with aeptable detailed plans an generally be reviewed and a response given in around two weeks. After the initial review, we will notify you in writing of any required hanges. You will need to submit samples of exterior siding, roofing materials and other items. In an attempt to avoid the submittal of any more samples than neessary, inluded are brand names of materials whih have been approved in the past. If you intend to use one of these brands, you will only need to submit style and olor information. This list will be modified in the future to inlude other manufaturers as we approve them. Upon final approval of your appliation, Howard will release it to you upon reeipt of your onstrution deposit in the amount of $5, payable to Snow Creek POA. After reeipt of the 1

2 written approval you will submit your plans and a opy of the written approval from the ARC to the City in order to obtain a building permit. After the City issues permits, the Owner must provide to the ARC a opy of all building and/or grading permits and emergeny telephone numbers for the ontrator and Owner. Constrution must be started within one (1) year of approval. If onstrution is not started within one (1) year of approval, you must re-submit your appliation. Detahed Guest Rooms are permitted by the Assoiation and the City of Show Low. Guest Rooms an have a refrigerator and sink area but no ooking failities. City zoning does not permit detahed Guest Rooms if they have full ooking failities. Detahed garages are permitted, An attahed or detahed parking garage housing two ars is required If you are onerned that we might not approve a home you are onsidering, you an submit a floor plan and elevation for a preliminary opinion by mailing it to Howard. This proess an be tedious for you and for the ARC. Try to be patient and remember that our sole purpose is to protet the aestheti integrity of Snow Creek for all owners and thereby protet your investment. Cory J. 4 REQUIRED PLANS 1. SITE PLAN Two opies of a site plan to sale on 11 by 17 paper must be submitted as a part of your appliation. All site plans must have topography lines with minimum two foot ontours. If you were not provided with topography for your lot at time of purhase, you an purhase a base map of your lot with topography from Painted Sky Engineering ( ) Details of all proposed site grading must be shown. We enourage you to keep all grading to a minimum. If a driveway is built aross a slope, a ross setion showing how you intend to handle ut and fill must be inluded. NOT INCLUDED APPLICABLE THE SITE PLAN MUST INCLUDE THE FOLLOWING: GRADING & TOPOGRAPHY SHOW ALL LIMITS OF CUT & FILL HOUSE LOCATION ON LOT & SETBACKS DRIVEWAYS & ALL SLABS OTHER BUILDINGS (STORAGE, ETC.) DRIVEWAYS All driveways must be fully paved. Indiate the type of finished surfae your driveway will have. The surfaes desribed below are pre-approved. Provide speifi information under other if you wish to submit something else for approval. Driveways should avoid mature trees where possible. BE AWARE THAT EXPANSIVE SOILS ARE KNOWN TO EXIST IN THE AREA AND ADVISE YOUR CONTRACTOR TO DESIGN THE FOOTERS ACCORDINGLY. SPLITFACE BLOCK Color STONE VENEER - Type Color STUCCO - Color OTHER 3. FENCING Perimeter fening of lots is not permitted. No fening is permitted in front yards. Rear yard fening for animal enlosures must be within the building envelope and onstruted of aeptable material not more than four feet high. Type of material, height and loation of fening must be approved by the ARC. Trash storage areas, wood storage areas and air onditioning enlosures must be sreened. All sreening shall be of the same material and olor as the house siding. SCREENING TO MATCH APPROVED HOUSE SIDING 4 FOOT HIGH BROWN VINYL CLAD CHAIN LINK FENCING STONE FENCING. EXTERIOR LIGHTING If you intend to use exterior lighting, other than normal wall mounted entry and patio lighting, we need omplete details. Indiate the type of lighting below and show the loation of the light fixtures on the site plan. Seurity lighting, motion deteting lighting, and lighting for night time rereation areas will not be approved. I DO NOT INTEND TO USE OUTDOOR LIGHTING I WISH TO USE OUTDOOR LIGHTING AS DESCRIBED BELOW AND HAVE SHOWN THE LOCATION ON MY SITE PLAN. TYPE: BRAND: 5

Gutters and downspouts, vent pipes, aps and skylights must be painted to math roof or trim. 6. WINDOWS Indiate the type of windows you intend to use. If aluminum, they must be painted or bronze anodized. Stainless steel, polished aluminum or other shiny metal may not be used. Provide a brohure from the window manufaturer together with a olor sample or olor indiated in the brohure. VINYL WINDOWS WOOD WINDOWS ALUMINUM CLAD WOOD WINDOWS VINYL CLAD ALUMINUM WINDOW COLOR: BRAND: STYLE: 7. DOORS Indiate the type of exterior doors you intend to use. MATERIAL: COLOR: BRAND: STYLE: PLEASE SUBMIT PICTURES OR BROCHURES ON EXTERIOR DOORS. 8. GARAGE DOORS Indiate the type of garage doors you will use. We reommend wood or metal doors with raised panels and window lights. Galvanized or other high gloss surfaes will not be approved. Color should blend with exterior house olor. White and other light olors are not aeptable. Garage doors that are visible to the street annot be taller than 9 without the approval of the ARC. RV garages, either freestanding or integrated with the home, may be approved on a ase by ase basis. BRAND STYLE 6

If you intend to use something other than a pre-approved siding, inlude a sample with your submittal. Aluminum, masonite and vinyl siding are not aeptable. LP Siding, Smart Siding, Hardi Plank and Wood Tone Rusti Series are aeptable. All other types of siding need to be approved by the Committee. ENGINEERED WOOD SIDING 1/2 MIN. Indiate how your siding will be finished and provide a olor hip. Paints, stains and stuo shall be omplimentary earth tone olors. Refletive olors are not permitted. All paint must be flat or low sheen. If you are using different olors on different portions of any struture, indiate the olors on your plans. If you are using the same olor on the entire exterior, simply fill in the information below and provide the olor sample. STAIN OR PAINT Color 10. TRIM Indiate the type and size of trim you will be using and the olor. Provide a paint hip or indiate that the olor is the same as the siding. Show omplete onstrution details on your building plans inluding information on how the outside will be finished, details on railing and olumn supports. Please hek as many of the following as are appliable. If you have more than one patio or dek and they are onstruted differently, make a opy of this page and submit separate information for eah patio. 8 12. OTHER BUILDINGS All other buildings must be shown on the site plan and renderings must be provided. Use a opy of this form to provide all of the same information on eah additional building whih is provided for the home. Arhiteture and exterior materials of additional buildings must math the main struture. Other buildings inlude detahed garages, sheds, gazebos, arports, guest houses or any other struture. THIS APPLICATION DOES NOT INCLUDE ANY BUILDINGS OTHER THAN THE HOME I AM CONSTRUCTING OTHER BUILDINGS, HAVE SHOWN THEM ON THE SITE PLAN AND HAVE INCLUDED DETAILED CONSTRUCTION INFORMATION ON EACH OTHER BUILDING #1 IS A OTHER BUILDING #2 IS A OTHER BUILDING #3 IS A 13. CULVERTS AND TEMPORARY DRIVEWAYS No onstrution may be started on any lot until the owner has installed a temporary driveway from the street to the front of the garage loation surfaed in rok, inders or gravel. A ulvert must also be installed if needed to prevent the driveway from obstruting drainage. Due to topography, some lots do not require ulverts. If in doubt about the requirement for a ulvert, ontat Howard. When the permanent driveway is installed, Culvert ends should be finished in approved rok. 14. CLEARING OF LOTS The CCR s allow the removal of all dead vegetation on lots the learing of a reasonable buffer around the improvements and the thinning of trees to promote forest heath and minimize fire risk. Trees and brush 4 and smaller in diameter may be removed without obtaining the onsent of the ARC. Any further learing may not be done without first submitting a speifi learing plan and obtaining the approval of the ARC. No learing may take plae until the ARC has approved a omplete submittal, reeived the Constrution Agreement and Constrution Deposit, and a permit from the City of Show Low has been applied for. 15. SIGNS Pursuant to the CCR s, owners are allowed to plae a For Sale sign on their property. Offsite signs are not permitted. The sign should be removed immediately on ompletion of the sale. During the onstrution of a home, a single sign with the name of the general ontrator or owner may be installed. Additional signs for sub-ontrators are not permitted. Constrution signs must be removed immediately upon ompletion of the projet. No sign may exeed 18 by 24 and all signs should be of quality onstrution and mounted on a post. Signs may not be nailed on trees. Paper or plasti signs purhased from the loal hardware store saying No Trespassing or anything else are unaeptable. 16. BUILDING HEIGHT AND TWO STORY STRUCTURES Regarding building height, the CCR s state that no building shall be taller than 28 feet from peak of roof to natural grade on any side. The CCR s also state that two story homes annot have an upper story that is in exess of 50% of the square footage of the living area of the lower floor. Exeptions may be made at the disretion of the Committee based on site issues. In reviewing the site loation of a proposed two story home, the Review Committee will take into onsideration the impat on surrounding lots. The Review Committee may alter the plaement of a two story home on the lot to redue the impat on surrounding lots. 8

9 17. MISCELLANEOUS Above ground pools are not permitted. Above ground spas are ok provided they are sreened and or built into a landsaping omponent and approved by the Review Committee. Metal sheds are not permitted. Satellite dishes are permitted subjet to ARC approval of loation. Solar panels are permitted subjet to ARC approval of loation. 18. LANDSCAPING LANDSCAPING The CCR s require that all landsaping be approved by the ARC. This provision will be stritly enfored. The general poliy of Review Committee is to enourage the use of native materials and to maintain lots in a natural ondition. Keep in mind that learing of lots and removal of living trees requires approval from the ARC. When onstrution of a new home is ompleted, some portion of the lot is invariably sarred and needs to be restored. Coneptually, this is an effort to return the lot to a natural ondition with materials that our naturally. Pine ones and pine needles are readily available for this purpose and an be aquired inexpensively. The advantage in using pine ones and needles to restore your lot is that it ends up appearing very natural and requires no further maintenane. Colored bark may not be used and will not be approved. Wood hips also aomplish the goal but are not as natural looking. The extensive use of rushed rok as a ground over will not be approved. Limited use of rushed rok and artifiial turf are aeptable within pet enlosures, subjet the ARC approval. The approved materials list for rok used for erosion ontrol is as follows. Large blak inders (1-2 ) work well around the sides of homes to deflet water oming off roofs. Leah rok also works well for this purpose and blends in fairly well. Keep in mind that these materials may not be used for extensive ground over and their use is limited to four feet around the edges of a home. Crushed rok that has an unnatural or artifiial appearane will not be approved. Larger rok should be used along drainage hannels. Approved rok for drainage hannels inludes native sandstone, river run and large malapai. All use of rok must be approved by the ARC. If your projet inludes non-native materials, terraing, elaborate landsaping or yard art please ontat Howard to have your plans reviewed. Owner must submit a 11 x 17 base map of lot showing the proposed area of learing around the home together with details on landsaping to be installed. 19. 11 SNOW CREEK PROPERTY OWNERS ASSOCIATION CONSTRUCTION AGREEMENT This Constrution Agreement ( Agreement ) is entered into between the Snow Creek Property Owners Assoiation In. ( SCPOA )and the undersigned property owner ( Owner ). Owner wishes to onstrut a residene on Owners lot ( the Property ) and agrees to do so under the following terms and onditions. 1. GENERAL a) Owner hereby represents that Owner has read, understands and agrees to all of the terms and onditions of the CCR s, the Design Guidelines, the Snow Creek Community Poliies and this Constrution Agreement. Owner aknowledges reeipt of a opy of all the above douments. b) Owner is responsible for all ations of Owners ontrators, their subontrators and employees, vendors, owners representatives and agents (olletively Contrator ) working on the Property. The Owner is responsible to the Assoiation for any and all damages aused by Contrator. This inludes, but is not limited to, all violations of this Agreement inluding damage to POA property, damage to adjaent properties and violations of the Constrution Agreement by Contrator. Any and all fines levied against Contrator are the responsibility of Owner and will be deduted from Owners onstrution deposit. ) Owner represents that Owner has provided a opy of this Constrution Agreement to Contrator. d) Owner represents that this doument is an aurate and omplete desription of all onstrution details and that onstrution will be ompleted as desribed herein. Owner agrees to submit a written appliation for any proposed hanges and agrees not to proeed with the hanges until written approval from the ARC is obtained. e) Owner grants the ARC unlimited aess to the Property, without requirement of notie, during regular business hours until final approval of improvements is given. f) All work must be performed in ompliane with appliable laws of the City of Show Low and the State of Arizona. g) Constrution must be started within one (1) year of approval. If onstrution is not started within one (1) year of approval, you must re-submit an appliation and omply with the urrent regulations. 2. INSPECTIONS A representative of the ARC will inspet the work and the site periodially as needed. In addition, there are two mandatory inspetions that must take plae before additional work an proeed. First Mandatory Inspetion. Upon issuane of the City of Show Low building permit, Owner shall. Install a trash reeptale on the Property. Install sanitary failities on the Property. Install a temporary driveway of inders, ABC or rushed onrete to the front of the garage. Install a ulvert under the driveway if required. After ARC inspetion and approval Owner may proeed with onstrution of the foundation. Seond Mandatory Inspetion. Upon ompletion of the footers and stem walls, Owner shall: Install a water meter and extend servie to the area of onstrution. Install a 5/8 water hose adequate in length to reah all areas of onstrution. Install an ABC fire extinguisher that will remain on the job until onstrution is omplete. After ARC inspetion and approval, Owner may proeed with framing. 11

12 3. CONSTRUCTION REGULATIONS To the extent possible, all onstrution equipment and materials shall be stored behind the urb. This inludes dumpsters and portable toilets. All trash and onstrution debris must be leaned up at the end of eah day. Pets owned by Contrator are not permitted in Snow Creek. Dumping of onrete washout is not permitted outside the building envelope. Parking is permitted on one side of the street only. No parking is permitted on neighboring lots or in setbaks and shall not blok neighboring driveways or trash olletion. No overnight parking on the street is permitted. The ontrator is responsible for ontrolling dust, mud and noise on the onstrution site. Mud on the streets as a result of onstrution ativity must be leaned up within two days. Playing of radios or other audio equipment by onstrution rews is prohibited. Consumption of alohol by onstrution rews is not permitted in Snow Creek. The speed limit in Snow Creek is 25 MPH. Fines may be levied by the ARC for repeated speeding by Contrators. 4. FIRE PROTECTION Install an ABC fire extinguisher that will remain on the job until onstrution is omplete. A minimum 5/8 diameter water hose onneted to a water supply shall be ready for immediate use to any area of the onstrution site. Propane heaters are permitted. Smoking is prohibited exept inside a vehile. 5. CONSTRUCTION HOURS AND ACCESS Constrution aess is restrited to Monday thru Friday 7am to 5pm. No work is permitted on Saturday, Sunday or national holidays. Constrution will also be restrited during snow removal. When snow levels on the roads exeed three inhes, onstrution aess is prohibited until plowing is ompleted. Entry by Contrators before snow removal is ompleted inreases removal ost and will result in appropriate fines. 6. CONSTRUCTION DEPOSIT No onstrution of a residene may be started until the property owner has deposited the sum of $5, with the Assoiation. The deposit is refundable to the property owner on ompletion of onstrution provided that the onstrution is per approved plan and ompleted in a timely fashion, damage to adjaent properties and the road have been repaired, onstrution debris leaned up, landsaping installed and re-vegetation ompleted. If any damage is not repaired by the property owner in a timely fashion as requested in writing by the Review Committee, the Assoiation may omplete the repairs, use the deposit to pay for the work, and that portion of the deposit shall be forfeited. Any fines levied by the ARC or the Board of Diretors will be deduted from the Constrution Deposit. If the deposit is inadequate to over all osts and fines, the property owner shall immediately pay the shortage to the Assoiation. The hek for the onstrution deposit should be made payable to Snow Creek Property Owners Assoiation. No interest will be paid on the deposit while it is held by the Assoiation. 7. VIOLATIONS AND FINES A member of the ARC shall give written notie to Owner of any violation of this Agreement. At the disretion of the ARC, the notie may be a warning or a fine may be imposed that an range from $100 to $1,000 depending on the severity of the violation and prior history of infrations. If the Owner fails to ure the violation in a timely fashion, the ARC may issue a Stop Work 12

13 Order requiring the Owner to immediately stop all onstrution and other ativity on the Property until the violation has been ured. If a Stop Work Order is issued, the ARC may, in its sole disretion, require the Owner to pay all prior fines levied against the Constrution Deposit in ash so that the balane of the onstrution deposit is returned to the original amount. If the ARC elets to do so, the amount due must be paid before resuming work. 8. ASSOCIATION RECOURSE Owners aknowledges and agrees that if Owner violates the terms of this Agreement, the Assoiation shall have the right to take any or all of the following ations: a) Assess fines deemed reasonable by the ARC in their sole disretion.
