INSTRUCTION FOR RTP 1(9) TURUN SEUDUN PUHDISTAMO OY KAKOLANMAKI WASTEWATER TREATMENT PLANT INCREASING THE OUTLET PIPE CAPACITY PIPE JACKING CONTRACT Turun seudun puhdistamo Oy (herein referred to as Wastewater treatment plant, Contracting authority or Customer ) expects your requests to participate in the negotiated procedure on pipe jacking contract for increasing the outlet pipe capacity as detailed in the contract notice sent to be published on the public procurement website Hilma and this instruction for completing and submitting the request to participate and attached to it preliminary Invitation to Tender. 1. Background and subject-matter of the Project Turun seudun puhdistamo Oy is a wastewater treatment service provider that is owned by 14 municipalities and offers high quality and cost-effective wastewater treatment services to its owners and other customers. The company is responsible and provides for the operation and treatment results of the Kakolanmaki wastewater treatment plant. Please find more information of the Contracting authority on website at At the moment, the Kakolanmaki wastewater treatment plant s outlet pipe is connected with the Turku town area storm sewer. The storm sewer capacity is exceeded from time to time and, in addition, the use of storm sewer is expected to increase in the future. According to preliminary plans this is why there will be built a new outlet pipe to the sea. The contract includes, among other things, detailed design, tunneling and piping materials. In the procurement in question, the Customer will select a contractor for contracting the needed outlet pipe capacity improvement. The subject matter and background of this procurement has been preliminarily described in Annex 1, Preliminary Invitation to tender, to this Request to Participate. In the light of current information, the project implementation decision and funding will be confirmed during The contract will depend on these decisions. 2. Contract award procedure The procurement will take place in compliance with the Finnish Act on Public Contracts and Concessions (1397/2016).

2 INSTRUCTION FOR RTP 2(9) The procurement is a building contract, value of which exceeds the EUthreshold. The contract will be awarded through negotiated procedure defined by the law. The application of negotiated procedure is justifiable, because accurate definition of the procurement is not possible without prior negotiations with the tenderers. No compensation will be paid to companies for preparing a request to participate, a tender, presenting or otherwise taking part in the procedure. No compensation will be paid either, if the procurement should later be interrupted. 3 INSTRUCTION FOR RTP 3(9) The Contracting authority s tender documents are available in Finnish and English language. In the event that there is a contradiction between the documents, the documents in Finnish shall be preferential. The candidates / tenderers involved in the procurement procedure may opt to use Finnish or English in the procedure. All the documents in the procedure must be submitted to the Customer either in Finnish or in English. In principle, the negotiations will be conducted either in Finnish or in English depending on the tenderer s language proficiency. If a company wants the tender documents in another language, the translation and the costs involved are the responsibility of the company itself. 3. Mandatory requirements for eligibility The customer has set mandatory requirements for participation in the procurement. Attached, as Annex 2 to these instructions to request to participate there is an ESPD-form, on which the candidate declares that any of the exclusion grounds defined in the Act on Public Contracts does not apply to it. Furthermore, the candidate declares that it meets all the requirements for eligibility set by the customer in the ESPD-form part IV, Selection criteria, section a: Global indication for all selection criteria These requirements are specified in this part. In addition to the ESPD-form, the candidate must submit the completed Reference form, Annex 3 to the instructions to request to participate. On the Reference form, the candidate must define in more detail the contents of its references and turnover value. Fulfillment of eligibility requirements is a prerequisite for participation in the procurement. Eligibility criteria apply to all candidates, tenderers and the selected contractor also for the whole contract period. ENROLMENT IN A RELEVANT PROFESSIONAL REGISTER The candidate is enrolled in relevant professional registers if the legislation in the country of its establishment so requires (in Finland trade register). ECONOMIC AND FINANCIAL STANDING Yearly turnover The minumum requirement for yearly turnover is at least euro/year for the last three years. The information must be stated on the Reference form, Annex 3.

4 INSTRUCTION FOR RTP 4(9) Professional risk indemnity insurance The candidate declares that it has a covering and sufficient in euro professional risk indemnity insurance. TECHNICAL AND PROFESSIONAL ABILITY Tools, plant and technical equipment The candidate declares that it has sufficient for subject matter of the contract tools, plant, technical equipment and personnel available for the whole contract period. Technical advisers The customer will set specific requirements for designated technical advisers skills and experience in the final invitation to tender. At this stage, however, the customer wants to ensure that the candidate has in its disposal the following resources for the whole contract period: The supervisors of the jacking pipe (micro-tunneling) works contract and the persons designated for contractual cooperation have good command in Finnish. The supervisors of the jacking pipe (micro-tunneling) works contract and the persons designated for contractual cooperation have good knowledge of Finnish legislation (occupational safety in particular), adopted in Finland code of building regulations and methods of construction. 5 INSTRUCTION FOR RTP 5(9) * Degree of complexity is assessed based on the requirements set by environment, building conditions and methods used in the work. Urban area means a closely built and densely populated urban environment where the work phases must be integrated with, among other things, neighboring real estate as well as uninterrupted bicycle and pedestrian traffic and vehicle traffic. The project used as a reference has consisted of underground network construction with at least 40 per cent or at least with value of euro of the project (e.g. construction of a water supply system, drainage system or electricity grid). The reference project has been implemented in winter conditions corresponding to Finland's climate (safety and weather phenomena taken into account in project phasing). b) Reference for jacking pipe (micro-tunneling) with minimum inner diameter 2 m and minimum length 800 m without intermediate shafts. c) Reference for detailed planning of jacking pipe (micro-tunneling) project. The presented jacking pipe (micro-tunneling) reference object must be of minimum inner diameter 2 m and minimum length 800 m. References taken into account in comparison Among the candidates who request to participate, the Contracting authority will select six (6) tenderers to negotiated procedure. If it is necessary to shortlist the number of candidates to be selected, the customer will compare experience of candidates based on references below. The candidates will be ranked by the points they gain for references below. The presented for comparison references must be from the last ten (10) years. This means that the project in question has been completed on 29 May 2007 or thereafter, but not later than on 29 May d) The candidate has several references for complex* excavation projects in urban area* with value over euro (total investment value). It is not acceptable to present for comparison the same reference shown as proof of fulfillment of the mandatory reference in section b) above. f) Reference for jacking pipe (micro-tunneling) with minimum inner diameter 1 m and minimum length 100 m in dense rock with strength more than 200 MPa. Scoring: 6 points / reference. A candidate is allowed to present at most ten references for comparison. It is not acceptable to present for comparison the same reference shown as proof of fulfillment of the mandatory reference in section b) above. QUALITY ASSURANCE SYSTEMS AND ENVIRONMENTAL MANAGEMENT STANDARDS 4. Contract award procedure The candidate declares that it has adopted the following certificated quality asurance systems: Certificated ISO9001 quality assurance system Certificated ISO14001 environmental management system Certificated OHSAS occupational health and safety management system. 4.1 Selection of the candidates In order to participate in the negotiated procedure, the candidates interested in procurement must submit: - Request to participate (Annex 4) - Completed ESPD-form in pdf-format (Annex 2). The ESPD must be completed by the candidate, all the members of a group as well as subcontractors, on whose resources the candidate relies in order to meet the eligibility criteria set in section 3.1 of the request to participate

7 INSTRUCTION FOR RTP 7(9) - Information on references and yearly turnover in the Reference-form (Annex 3). If the request to participate includes information, which constitute candidate's trade or professional secrets, such information must be marked as confidential. A candidate can enter in the procurement as a group, or use subcontractors. A candidate is allowed to rely on capacities of other entities in implementation of the procurement regardless of the legal nature of the relationship between them; however, the candidate shall furnish the Customer with proof that these capacities are available. If the candidate invokes the capacities of a subcontractor, the relevant subcontractor must actually be involved in the implementation of the procurement. The candidate has no right without a valid reason to change the subcontractor whose capacities he has put forward in the Request to Participate. If the candidate has corporations under its control, capacities of those corporations shall not be automatically assessed as candidate s capacities. Should the candidate want invoke these kind corporation capacities, the Request to participate has to be composed as a consortium, so that it includes those corporations as members. This means that the corporation must actually be involved in the implementation of the procurement. For increasing the outlet pipe capacity, the customer has earlier invited tenders on contracts for soil testing, design and professional services, administrative project management, project management and control services. These service providers contribute to preparing the jacking pipe (micro-tunneling) tender and control the implementation of contract work. Due to this, these service providers (or tenderers of the same ownership basis) are biased to participate in the jacking pipe (micro-tunneling) contract work in role of candidates / tenderers, members of consortium or subcontractors. The invitation to negotiate will be sent to the selected tenderers in June. The tenderers selected to the negotiations will be asked for a preliminary tender based on the preliminary invitation to tender and supporting confidential additional documentation. The additional documentation will be submitted to the selected tenderers.

8 INSTRUCTION FOR RTP 8(9) The negotiations will be based on the preliminary invitation to tender, supporting additional documents and the tenderer s preliminary tender. The negotiations will be conducted in the metropolitan area or in Turku in the beginning of September. The customer will conduct negotiations separately with each tenderer. The customer shall not reveal any solutions or confidential information given by the tenderer. During the negotiations, the plan proposals, draft invitation to tender, and its annexes are in course of preparation. Negotiations may cover all items relevant to the contract work, among other things: - Questions concerning technology - Definition of appropriate comparison criteria - Decision on pricing model - Guarantee period - Amount of indemnity insurance - Construction schedule The Contracting Authority will ask by written invitation to tender for written tenders within a set deadline when the negotiations have ended. 5. Questions concerning the Instruction to Request to participate A company, interested in the procurement can request additional information by ing questions to by no later than at 2.00PM (Finnish local time). You are kindly asked to name the on the topic field PPKT Questions. The questions and the same responses to the questions will be sent simultaneously to all tenderers who have sent questions and their contact details to the address above by Fri In the event, that a party should be later interested in the invitation to tender, interested parties can request for the questions and answers at the above-mentioned address of the Contracting Authority. Name of the inquirer, or other information concerning the candidate, shall not be revealed in connection with questions and answers. Each company is responsible for taking into account in its application to participate the questions and answers to them, as well as possible elaborations to information provided. 6. Submitting of the request to participate The Request to participate with all its attachments must be submitted by no later than Mon at 2.00PM (Finnish local time) to the following address: hankinnat@ptcs.fi.
