The property owners also repaired and replaced metal flashing where needed. The application has been submitted retroactively, as the property owners were not aware that a heritage permit was required for the change in roofing material. Staff reviewed the proposal in relation to policy in the Old Sydenham Heritage Conservation District (HCD) Plan. Metal roofing is understood to be an appropriate roofing type for the age and architectural style of the property, and the style and colouring installed complements the brick town house. The roofing replacement is consistent with policy direction in the Old Sydenham HCD Plan. Staff recommends approval of the proposed application, subject to the conditions outlined herein. 1

4 Page 4 of 6 Options/Discussion: Proposal/Background The subject property is located on the west side of Bagot Street between Earl and William Streets in the Old Sydenham Heritage Conservation District. The existing side gable town house was built by 1892, and is recognized as a Significant contributing heritage property in the Old Sydenham HCD. Prior to designation as part of the HCD in May 2015, the property was Listed on the City s Register of Heritage Properties. It was brought to Planning Staff s attention by a member of the public on November 28, 2015 that a roofing replacement was underway at Bagot Street. Staff followed up with the property owners, who were unaware that a heritage permit was required for such work. The asphalt shingle roofing had reached the end of its serviceable life and new roofing was required. The owners have submitted retroactive applications for a heritage permit. The application requests approval for the installation of standing seam metal roofing. The photographs in Exhibit A illustrate the asphalt shingles. The photograph in Exhibit B illustrates the metal roofing installed. Reasons for Designation The property is designated under Part V of the Ontario Heritage Act as part of the Old Sydenham Heritage Conservation District (By-Law Number ). The Old Sydenham Heritage Conservation District Plan property evaluation provides the following description of Bagot Street. This building extends the row which includes 168 Bagot and to the east generally approximating the scale and detailing of 168. The two units mirror each other, with two bays each with the main entrance at the respective 'outside' bays Bagot is a well-built three bay, side gable town house. The parapets walls are supported by moulded cut stone corbels. The brickwork is laid up in stretcher bond. The window and door openings at both storeys all have cambered arches with those on the first storey composed of complex voussoirs. The brick walling rests on a scrabbled, regularly coursed limestone foundation. The original wood window type appears to be the 2/2 units remaining at 164 and unlike 168 there are limestone sills at both storeys. It appears that Lot 6 was sold by John Counter to George Romanes prior to 1855 when, as with Lot 7, Romanes sold to Thomas Paton. It was purchased by Michel Donaghue in 1864 for $ and turned over for the same price to Bridget Dwyer in The double house does not appear on the 1865 Innes Map nor corresponds to the Brosius view (1875) though the construction details do suggest a pre-1875 date. The building is definitely in place by It may have replaced earlier (likely frame) buildings as suggested by the Gibbs' map of Bagot Street is an integral component of the row which occupies a substantial section of the block. It extends the general rhythm of openings and parapets walls over the side gabled brick terrace*. 4
5 Page 5 of 6 Previous Approvals Not applicable Comments from Agencies and Business Units The following internal departments were circulated on this application: Building: A building permit is not required for the proposed scope of work. Property Standards: No open property standards cases at these addresses. Engineering: The eaves troughs on this dwelling are encroaching onto the City of Kingston rightof-way. An encroachment permit is required from the City s Engineering Department. Built Heritage Analysis Staff reviewed the application in relation to applicable policy in the Old Sydenham Heritage Conservation District (HCD) Plan. The application of metal roofing qualifies as an alteration, and the applicable policy sections are contained in Section 5 of the HCD Plan. In general, policy in the HCD Plan indicates that the roof profile visible from the street should remain unaltered, and replacement roofing material should be compatible with the age and architectural style of the specific property. The roofline of the subject property has not been altered, and it is generally understood that metal roofing is an appropriate roofing type for the age and architectural style of the property. There is no original roofing remaining on the subject property, and therefore the application of metal roofing does not involve the loss of historic fabric. The new roofing material has a minimal visual effect, as the style and colouring complements the red brick of the town house. It should be noted that the Old Sydenham Heritage Conservation Plan discourages the application of new roofing over existing roofing material (policy 4.3.1), which appears to have occurred in this case. The applicants are encouraged, going forward, to remove existing roofing first before applying new material. Staff recommends approval of the proposed application, subject to the necessary conditions, as metal roofing is an acceptable roofing material for a 19 th century dwelling in the Old Sydenham Heritage Conservation District, and the replacement roofing is intended to conserve the existing structure. Conclusion That the Ontario Heritage Act Application Numbers P and P be approved, subject to the conditions outlined herein, as metal roofing is an acceptable roofing material according to policy in the HCD Plan and the proposed change is intended to conserve the existing structure. 5
