1 Date: July 22, 2013 Submitted By: Chief Rick C Tanksley Agenda Item O Village Manager s Office Review : CLP Agenda Item Title: Resolution Authorizing a Contract with O Hare Towing For a Three-Year Period to Provide Towing Services X\ Hare Towing to Provide Towing Services for the e Synopsis: The Police Department is frequently required to tow vehicles as a result of arrest, outstanding parking fines, traffic obstruction or other safety reasons. It is desirable to have a service provider that meets the needs of the department in its ability to provide timely service 24 hours a day and the ability to move and remove all sizes and types of vehicles. It is also important that the service provider be available to provide the release of vehicles, and that they provide a secure location for vehicles in their care and that they provide efficient and courteous service to vehicle owners and their agents. The Police Department seeks a three year agreement ending in March Recommendation: The Police Department recommends O Hare Towing as the most responsive bidder. Fiscal Impact: O Hare Towing provides their service at no cost to the Village. Towing fees for privately owned vehicles are set by contract and paid for by the vehicle owner. The only time the Village incurs an expense for towing is if the car is used in the commission of a crime and the car is towed for evidence. In 2012, the Police Department paid less than $3,000 to O Hare Towing. Background: Contracting with a tow service provider will serve to enhance the police department s ability to address quality of life issues related to arrest of offenders, outstanding parking fines, traffic obstructions, abandoned vehicles or other safety issues. Periodically the Department seeks competitive proposals through a Request for Proposal (RFP) process for this service to keep the rates paid by the private vehicle owner competitive. Four companies responded. Only O Hare Towing submitted all of the information as requested in the RFP. The other bids were missing information regarding the general history, description of the agency, number and size of tow trucks owned or leased and in one case the insurance did not indicate the minimum auto liability per occurrence as requested.

2 The Village has a long history of awarding the contract to O Hare Towing and is our current vendor. Especially in the past when the Village conducted snow towing, the Village needed bidders that were equipped with a large lot to tow a number of vehicles at one time during a snow removal event. During both the past and recent contracts, the Police Department has received few if not any complaints from private owners regarding theft of personal property or damages to their vehicles while in the possession of O Hare Towing. In the last decade the Village has ceased much of the snow towing operation which has allowed for other smaller companies to competitively respond to the request for proposals. O Hare Towing remains competitive and is one of the largest fleets compared to all of the other bidders (i.e. 44 drivers compared to between 4-9 drivers from the other responses, and in the case of one respondent, only 1 driver with a CDL) which allows for a general response time within minutes after every incident. Alternatives: There were three other service providers that submitted proposals for towing services in response to the Village s bid, however the other bids did not provide all of the information as requested. Previous Board Action: The Village Board awarded the previous award for services to O Hare Towing. 3 R E S O L U T I O N AUTHORIZING A CONTRACT WITH O HARE TOWING FOR A THREE YEAR PERIOD TO PROVIDE TOWING SERVICES BE IT RESOLVED by the President and Board of Trustees of the Village of Oak Park, Illinois, Cook County, Illinois, that the Village Manager is hereby authorized and directed to execute agreements necessary to accept and administer the Towing Services Contract. Said agreement shall substantially conform to the agreement attached hereto as Exhibit A. THIS RESOLUTION shall be in full force and effect from and after its adoption and approved as provided by law. Settlement Processing Services Synopsis The Village has discussed an amendment to the 2011 Settlement Agreement with the other two parties, School Districts 97 and 200. The amendment will allow the Downtown Oak Park TIF District to retain the increment generated by specific parcels as related to any potential economic development occurring on the site commonly referred to as Colt- Westgate. This exemption is identical in spirit to one already contemplated in the agreement specific to development on the site commonly referred to as Lake and Forest. Recommendation Approve the resolution. Fiscal Impact This amendment will provide the opportunity for the TIF District to utilize potential increment to offset any costs it may occur as a direct result of the project. Background In December of 2011, the Village of Oak Park, School District 97 and School District 200, came to an agreement as to the future of the Downtown Oak Park TIF. This agreement replaced previous agreements made between the parties in 1985 and The outcome of the agreement is that after certain eligible expenses are accounted, any remaining incremental property taxes collected by the TIF are to be distributed back out to taxing bodies. The eligible expenses are for existing debt service, monies collected from Special Service Area #1 (partially contained within the TIF district) and any increment generated from development on the Lake and Forest parcel. This amendment to the agreement has already been contemplated and approved by the school districts. Alternatives Not applicable

THIS AGREEMENT is made and concluded on July 22, 2013 by and between the Village of Oak Park, 123 Madison St., Oak Park, IL acting by and through its President & Board of Trustees and O Hare Towing Service, 2139 N. Mannheim Road, Northlake, IL (Contractor) 2. The following documents set forth the terms of this contract and are incorporated herein: a. The 2012 Village of Oak Park Illinois Request for Proposals Towing Services, and b. Contractor s Proposal dated December 21, 2012; 3. Contractor agrees, at its own proper cost and expense to do all the work, furnish all materials and all labor necessary to complete the work in accordance with the terms of this contract and the requirements of the Chief of Police under it. 4. Contractor affirms that the individual signing this contract is authorized to execute agreements on behalf the Contracting entity. 5.
