Approve Minutes of the December 17, 2012 meeting. Introduction Staff will give background information and introduce agenda item, followed by applicant further detailing of the nature and reason for application/request. Public Comments Citizens wishing to speak to the Lake Ray Roberts Commission will need to sign in. Pursuant to State Open Meetings Law, the Lake Ray Roberts Commission is restricted in discussing or taking action on items not posted on the agenda. In order to expedite the flow of business and to provide all citizens the opportunity to speak, the Lake Ray Roberts Commission may impose a three-minute limitation on persons addressing the Commission. Please address all comments to the Presiding Officer. V. Consider Discuss, Approve and/or Take Any Appropriate Action on the request: Lake Ray Roberts Request for Special Use Permit Muir-Switzer Addition Block 1, Lot 3R5-2, Precinct One Texas Government Code (A)-(B) Consultation with Attorney in a closed meeting when the governmental body seeks the advice of its attorney about pending or contemplated litigation; or a settlement offer; or on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551. Call to order II. III. R. Scott Alagood called meeting to order at 12:04 pm. Approve minutes of the August 20, 2012 meeting Jim Engelbrecht made a motion for approval of the August 20, 2012 minutes. Richard Bullwinkle seconded the motion. The motion carried unanimously 6-0 (David Doughty had not yet arrived). Introduction Alfredo Perez-Lozano addressed the Planning and Zoning Commission, and explained the request on the Agenda. Mr. Perez-Lozano explained that Don Hall, the applicant, was requesting a rezone of his property from the current PD Planned Development Zoning to the R/C Recreational/Commercial Zoning, so that he may be in compliance for his planned camper site in the future. Mr. Perez-Lozano showed the Commission the subject property on the County s Landmark GIS mapping tool and explained that the Lake Ray Roberts Land Use is currently R1-R2-R3, but the surrounding properties are currently zoned a mix of PD Planned Development and R/C Recreational Commercial. There are also some surrounding
3 Denton County Lake Ray Roberts Planning and Zoning Commission Minutes Monday, December 17, 2012 Page 2 properties that have been annexed by the City of Sanger, some of which will have commercial use (no longer in the Lake Ray Roberts Land Use Jurisdiction). After staff introduction, Mr. Hall continued to explain the nature of his request. Mr. Hennen asked him if he planned to go forward with the RV camp site in the near future, to which Mr. Hall replied that right now the plans are very preliminary and he would have to consider feasibility, but that he would like rezone now to have the option to go forward and be in compliance of the ordinance in the future when that time comes. IV. Public Comments Citizens wishing to speak to the Lake Ray Roberts Commission will need to sign in. Pursuant to State Open Meetings Law, the Lake Ray Roberts Commission is restricted in discussing or taking action on items not posted on the agenda. Consider, discuss, approve and/or take any appropriate action on the request: Lake Ray Roberts Request for Rezone - Abstract A0029a R. Bebee, Tr 22G, 10 Acres, Precinct One Chairman R. Scott Alagood opened the discussion for request on the agenda. Mr. Alagood asked the Commission Members if anyone wanted to speak on the agenda item. Mr. Alagood asked the Commission if they had any questions for staff or the applicant. Mr. Alagood asked Mr. Perez-Lozano if the properties in the corridor surrounding the subject property were zoned commercial, to which Mr. Perez-Lozano replied that to his understanding, Sanger proposes that area to be a commercial/industrial corridor. Mr. Perez-Lozano noted that another property in the corridor was recently rezoned commercial for a trucking company by the Lake Ray Roberts Planning and Zoning Commission, and that the new Denton County Road and Bridge East facility has just been built there as well. Mr. Alagood asked if the County had proposed the Road and Bridge property to be annexed by the City, to which Mr. Perez-Lozano responded yes. Mr. Springer asked if the existing storage units would also be rezoned, to which Mr. Perez-Lozano replied the entire property would be rezoned, and the storage units would be in compliance if the rezone is approved. Mr. Alagood asked if any Commission Members or anybody else had any more questions. Richard Bullwinkle made the motion to approve and Roger Hennen seconded the motion. The Commission voted unanimously 7-0 to recommend approving the rezone as requested, from PD Planned Development, to R/C Recreational/Commercial.

5 BRIEFING MEMORANDUM TO: LAKE RAY ROBERTS PLANNING & ZONING COMMISSION FROM: ALFREDO PEREZ-LOZANO, ENGINEER-IN-TRAINING SUBJECT: SPECIAL USE PERMIT REQUEST DATE: March 1, 2013 (revised 3/18/12) P & Z MEETING: March 18, 2012 March 18, PUBLIC HEARING AGENDA ITEM Consider Discuss, Approve and/or Take Any Appropriate Action on The Request for a Rezone on Abstract A0029a R. Bebee, Tr. 22G, 10.0 Acres, Precinct One. The applicant, Pamela Satterfield, submitted her Application for Request for Special Use Permit on 2/20/13. The applicant is requesting a special use permit to add an Accessory Dwelling Unit to the existing building structure on the property to be used as a temporary quarters for the property owners until the main residence is constructed. Once the permanent principle residence is built, this dwelling unit will become accessory to it. As currently zoned the old R-2 Residential 1-Acre Minimum the property requires a Special Use Permit to be issued for any proposed Accessory Dwelling Unit. SURROUNDING LAND USES Surrounding tracts of land in the A0029a R. Bebee abstract are currently zoned a mix of AG Agricultural District and old R-2 Residential One Acre Minimum from the Lake Ray Roberts Land Use Ordinance.
6 PUBLIC HEARING NOTICE SUP Pursuant to Texas Local Government Code , Notice is hereby given that the Lake Ray Roberts Planning and Zoning Commission will hold a Public Hearing to consider a request for a Special Use Permit as stated in the amended Lake Ray Roberts Zoning Ordinance, effective February 24, The applicant, Pamela Satterfield is requesting for the Commission to grant a Special Use Permit for a proposed accessory dwelling unit on her property. The building will be used as living quarters while the main residence is under construction, and will become an accessory dwelling unit once the main dwelling is construction. The property is zoned the old R-2 Residential 1 Acre Minimum, which requires a Special Use Permit for any Accessory Dwelling Unit.
