1 MITIGATION MONITORING & REPORTING PLAN The following environmental mitigation measures shall be incorporated into the project development as Conditions of Approval (MND 2318). The Project Applicant shall secure a signed verification for the mitigation measures to ensure compliance witheach mitigation measure, as required by the City of Perris to meet CEQA obligations and other requirements (Public Resources Code Section ) Final clearance shall require all verifications applicable to the attached table. The Perris Development Services Department has primary responsibility for monitoring and reporting the implementation of each mitigation measure. AIR QUALITY AQ-1The following measures shall be incorporated into Project plans and specifications as implementation of Rule 403: All clearing, grading, earth-moving, or excavation activities shall cease when winds exceed 25 mph per SCAQMD guidelines in order to limit fugitive dust emissions. The contractor shall ensure that all disturbed unpaved roads and disturbed areas within the Project are watered at least three (3) times daily during dry weather. Watering, with complete coverage of disturbed areas, shall occur at least three times a day, preferably in the mid-morning, afternoon, and after work is done for the day. The contractor shall ensure that traffic speeds on unpaved roads and Project site areas are reduced to 15 miles per hour or less. During Movement and Piling of Dirt AQ-02 The California Air Resources Board, in Title 13, Chapter 10, Section 2485, 3 of the California Code of Regulations, imposes a requirement that heavy duty trucks accessing the site shall not idle for greater than five minutes at any location. This measure is intended to apply to traffic. Grading plans shall reference that a sign shall be posted on-site stating that During Movement and Piling of Dirt Applicant s Superintendent or other responsible representative Page 1
2 workers need to shut off engines at or before five minutes of idling. AQ-03 During grading, activity, all equipment greater than 150 horsepower shall be California Air Resource Board (CARB) Tier 3 certified or better. Additionally, during grading activity, total horsepower-hours per day for all equipment shall not exceed 18, 568 horsepower hours per day and the maximum disturbance (actively graded) area shall not exceed 5.5 acres per day. AQ-04 only Zero-volatile Organic Compounds paints (no more than 150 grams/liter of VOC) and or High Pressure Low Volume (HPLV) applications consistent with South Coast Air Quality Management District Rule 1113 shall be used. BIOLOGICAL RESOURCES During Movement and Piling of Dirt During Movement and Piling of Dirt BIO 1: A qualified biologist shall conduct a pre- survey for burrowing owls no more than 30 days prior to proposed grading or other site disturbances that might impact occupied burrows. If burrowing owls are detected onsite, the owls will be excluded from the site following accepted protocols. Owl exclusion, if necessary, will occur outside of the nesting season (February 1 through August 31). Grading Permits/groun d disturbance Page 2
3 BIO 2: If feasible, the removal of vegetation (trees, shrubs, and groundcover) shall occur outside of the nesting season, which extends from February 1 through August 31. If avoidance of the nesting season is not feasible, then a qualified biologist shall conduct a nesting bird survey to identify any active nests at the Project site. The survey shall be conducted within three days prior to proposed vegetation disturbance. If active nests are identified, then the biologist shall establish adequate buffers around the active nests, and the buffers shall be maintained until the nests are no longer active, and the juveniles are able to survive independently from the nest. BIO 3: To compensate the loss of approximately 0.02 acre of non-westland jurisdictional waters (i.e., Corp, Regional Board, and CDFW jurisdiction), the project proponent shall purchase credits from an approved mitigation bank or in-lieu fee program, such as through Riverside-Corona Resource Conservation District (RCRCD). Credits shall be purchased at a 2:1 ratio. CULTURAL RESOURCES Grading Permits/Groun d Disturbance Grading Permits/Groun d Disturbance Cult 1. grading for projects requiring subsurface excavation that exceeds five (5) feet in depth, a phase I Cultural Resource Study is required to be conducted. If the study determines monitoring is required then the project shall retain a professional paleontologist to verify implementation of the mitigation measures (if any) identified in the Phase I Cultural Resources Study. Cult 2. 4 Coroner must be notified of the find immediately. In the event that human remains (or remains that may be human) are discovered at the implementing development project site during grading or earthmoving, the contractors shall immediately stop all activities in the immediate area of the find. The project proponent shall then inform the Riverside County Coroner and the City of Perris and the coroner would be permitted to examine the remains. If the coroner determines that the remains are of Native American origin, the coroner would notify the NAHC and the Commission would identify the Most Likely Descendent (MLD).Despite the affiliation of any Native American representatives at the site, the Commission s identification of the MLD would stand. The MLD shall be granted access to inspect the site of the discovery of the Native American human remains and may recommend to the project proponent means for treatment or disposition, with appropriate dignity of the human remains and any associated grave goods. The MLD shall complete their inspection and make recommendations or preferences for treatment within 48 hours of being granted access to the site. The disposition of the remains would be determined in consultation with the City of Perris, the project proponent, and the MLD. The City of Perris would be responsible for the final decision, based upon input from the various stakeholders. If the human remains are determined to be other than Native American in origin, but still of archaeological value, the remains would be recovered for analysis and subject to curation or reburial at the expense of the project proponent. If deemed appropriate, the remains would be recovered by the coroner and handled through the Coroner s Office. Coordination with the Coroner s Office would be through the City of Perris and in consultation with the various stakeholders. The specific locations of Native American burials and reburials would be proprietary and not disclosed to the general public. The locations would be documented by the consulting archaeologist in conjunction with the various stakeholders and a report of findings shall be filed with the Eastern Information Center (EIC). 5 GEOLOGY GEO-01 GEO-02 HYDROLOGY All grading shall be accomplished under the observation and testing of the project Geotechnical Consultant in accordance to the recommendations of the Preliminary Geotechnical Investigative report. The Geotechnical Consultant shall review the tentative tract map, all grading plans, retaining wall plans, and foundation plans prior to submitting to the City of Perris. The Geotechnical Consultant shall provide a letter stating that liquefaction would not impact the project due to proposed foundations and importing of dirt to raise foundations. HYD-01 the issuance of a stock pile permit/grading permit, the project proponent shall file a Notice of Intent (NOI) with the Santa Ana Regional Water Quality Control Board to be covered under the State National Pollutant Discharge Elimination System (NPDES) General Construction Permit for discharge of stormwater associated with activities. The project proponent shall submit the Waste Discharge Identification Number to the City of Perris as proof that the project s Notice of Intent (NOI) has been filed with the Santa Ana Regional Water Quality Control Board. 6 HYD-02 the first issuance of a stock pile permit/grading permit by the City for the project, the project design shall receive approval from the City of Perris a Storm Water Pollution Prevention Plan (SWPPP). The SWPPP shall include a surface water control plan and erosion control plan citing specific measures to control on-site and off-site erosion during the entire grading and period. In addition, the SWPPP shall emphasize structural and nonstructural best management practices (BMPs) to control sediment and non-visible discharges from the site. Some of the BMPs to be implemented may include (but shall not be limited to the following: City Engineer Sediment discharges from the site may be controlled by the following: sandbags, silt fences, straw wattles and temporary debris basins (if deemed necessary), and other discharge control devices. The and condition of the BMPs would be periodically inspected during, and repairs would be made when necessary as required by the SWPPP. All materials that have the potential to contribute nonvisible pollutants to stormwater must not be placed in drainage ways and must be contained, elevated, and placed in temporary storage containment areas. All loose piles of soil, silt, clay, sand, debris, and other earthen material shall be protected in a reasonable manner to eliminate any discharge from the site. Stockpiles would be surrounded by silt fences. The SWPPP would include inspection forms for routine monitoring of the site during the Page 6
7 phase to ensure NPDES compliance. Additional BMPs and erosion control measures would be documented in the SWPPP and utilized if necessary. The SWPPP would be kept on site for the entire duration of project and will also be available to the local RWQCB for inspection at any time. HYD-03 The superintendent or other representative shall be responsible for performing and documenting the application of BMPs identified in the SWPPP. Weekly inspections shall be performed on sediment control measures called for in the SWPPP. Monthly reports shall be maintained by the superintendent or other representative and available for City inspection. In addition, the superintendent or other representative would also be required to maintain an inspection log and have the log on site available for review by the City of Perris and the representatives of the Regional Water Quality Control Board. NOISE Applicant s Superintendent or other responsible representative NOISE 1: Any equipment activity and equipment maintenance is limited to the hours between 7:00 a.m. and 7:00 p.m. Per Zoning Ordinance, Noise Control, Section , it is unlawful for any persons between the hours of 7:00 p.m. of any day and 7:00 a.m. of the following day, or on a legal holiday, or on Sundays to erect, construct, demolish, excavate, alter or repair any building or structure in a manner as to create disturbing excessive or offensive noise. Construction activity shall not exceed 80 dba Page 7 During grounddisturbing grading and

NOISE 2: Stationary equipment that generates noise in excess of 65 dba at the project boundaries must be shielded and located at least 100 feet from occupied residences. The equipment area with appropriate acoustic shielding shall be designated on building and grading plans. Equipment and shielding shall remain in the designated location throughout activities. NOISE 3: Construction routes are limited to City of Perris designated truck routes. The applicant must provide property owners within 300 feet of the project site a activity schedule and routes 30 days in advance of activities. The applicant must submit copy of schedule and mailing list to the City prior to initiation of any earth movement.
