1 Identified Uses of Petroleum Substances Version 1.0, 26 October Important notes 1.1. CONCAWE definitions for purposes of this communication: Use means a use as defined in Art. 3(24) of the REACH Regulation Identified Use means a use as defined in Art. 3(26) of the REACH Regulation Supported Use means a use for which the risk assessment demonstrates that any risk to human health or the environment is controlled with the implementation of appropriate risk management measures. Petroleum Substances are the substances listed on the CONCAWE Internet website: Categories of Petroleum Substances are listed below. Grouping the substances into categories allows read across of intrinsic (hazard) properties between the substances within a category. Notes allow for differentiation of hazard properties within a category. 1. low boiling point naphthas / gasolines 2. kerosines 3. straight run gas oils 4. vacuum gas oils, hydrocracked gas oils and distillate fuels 5. cracked gas oils 6. other gas oils 7. heavy fuel oil components 8. white mineral oils 9. unrefined / acid treated oils 10. other lubricant base oils 11. foots oils 12. paraffinic and hydrocarbon waxes 13. slack waxes 14. petrolatums 15. untreated distillate aromatic extracts 16. treated distillate aromatic extracts 17. residual aromatic extracts 18. bitumen 19. petroleum coke In addition identified uses for sulphur and MK-1 have also been listed. Because of the extensive overlap of gases from refinery operation and gases from steamcrackers and/or aromatics production units CONCAWE has agreed to collaborate with by the Lower Olefins/Aromatics consortium (LOA). 2 1.2. Identified Uses Under REACH, Downstream Users have the right to make their Use(s) (the Identified Uses) known to their direct suppliers. For substances requiring REACH registration in 2010 there is no obligation for registrants to consider Use communication received from Downstream Users after 30 November Therefore this date becomes in effect the cut-off date for Downstream Users to make their Uses known to their suppliers. Uses made known prior to 30 November 2009 will be reviewed to assess the risks associated with those Uses. If the outcome of this review results in a determination that an Identified Use is associated with an unacceptable risk, it will be flagged as a Use Advised Against as part of the Registration Dossiers prepared by CONCAWE. Any of the Supported Uses may be included by registrants in their relevant substance Registration Dossier. CONCAWE has prepared an initial map of Identified Uses based on input provided from its member companies. The mapping has been done by grouping applications into generic exposure scenario (GES) titles and noting associated Uses according to the Use Descriptor System supported by ECHA. These Use are designed to describe how products are used in the supply chain. More information on Use can be found on the ECHA website 1. The list below shows the Identified Uses for Categories of Petroleum Substances, MK-1 and sulphur. Registrants are obliged to include a brief general description of all Identified Uses in their Technical Dossier and in the Chemical Safety Reports (CSR). Additionally, for substances which require an exposure assessment, CONCAWE is developing, assessing and will communicate exposure scenarios Notes on the list 1. The assignment of Use to Identified Uses may change. 2. The number and the definition of GESs are not final and may be subject to changes during their development. 3. The list of Identified Uses may not be final. The list below will be updated if and when additional Uses have been identified to us. 4. Identified Uses must in no circumstances be confused with Supported Uses. An Identified Use will only be supported if there is no risk or if any identified risk to human health and the environment is controlled with the implementation of appropriate risk management measures Missing Uses If you suspect that a Use which has been identified and be made known to you is missing in the list please take into account that the description of the Uses in the list are in layman s terms. A different description of a Use does not make it necessarily a different Identified Use. 1 Please note that the Use Descriptor System guidance is currently being revised. Recommended action a) Before you start collecting information please familiarise yourself on the ECHA website with the Use Descriptor System the Use information described below 2 3. b) You are a registrant: Inform CONCAWE of the Use which you believe is missing in the list by sending an e- mail to use@super-sief.eu and add the Use information described below. CONCAWE will not consider Uses without accompanied Use information. c) You are a Downstream User: Directly inform your supplier of the Use which you believe is missing in the list and provide the Use information described below. Please note that CONCAWE will not consider notified Uses without accompanied Use information Collection of Use information Before you start collecting information please familiarise yourself on the ECHA website with the Use Descriptor System 4, which consists of the following 5 elements: sector of use (SU), chemical product category (PC), process category (PROC), environmental release category and article category (AC). If you are a registrant we recommend that only thereafter you contact the immediate Downstream User who has made the Use known to you to obtain in accordance with REACH Art. 37(2) the information specified below. Only those Identified Uses for which it can be indicated that they present no risk or if there is any identified risk to human health and the environment, the risk is controlled with the implementation of appropriate operating conditions and risk management measures. Such Supported Uses can be registered under REACH. We anticipated that we have identified all major Uses of Petroleum Substances, MK-1 and sulphur and that few, if any, additional Uses will be identified between now and 30 November Therefore, if via discussions with Downstream Users, registrants become aware of new Uses, to enable CONCAWE to address such Use(s) and in particular to check whether that Use(s) fits into an existing exposure scenario, at least the information listed below is to be provided. According to Article 37 of REACH, the Downstream Users have the obligation to provide sufficient information to allow the manufacturer to prepare the exposure scenario. Without this information the Use cannot and will not be addressed in the risk assessment and the exposure scenarios submitted in SUBSTANCE IDENTITY identity of substance (CAS Registry Number or EC number) 2. Resulting exposures and emissions can be expected to be predictable and well-managed. in professional use, workers have various/different competences, qualifications and skills and there are lower or varying standard of supervision and control as well as lower standard of technical (risk management) measures. Resulting exposures and emissions will often be higher than those encountered in Industrial settings. in consumer use, there is little expertise and/or fewer skills for implementing measures and no technical measures and no individual protection (except for gloves or protective glasses in certain cases). The control of exposures and emissions cannot therefore be expected to rely on strategies which demand trained users or access to specific equipment. CONCAWE will not consider any uses made known to us as Identified Uses that are illegal under current law. 5 cracked gas oils other gas oils that refinery streams and specific cuts of refinery streams are not the same substances in spite of currently being in the market with the same CAS or EC number. The issue can be illustrated as follows: In the past, fractions 1 to 4 of a refinery stream have shared the same descriptor (EC number, substance name, substance descriptions) although in reality the fractions are specific cuts. These specific cuts are mainly used in solvent applications. However, it is not the application as a solvent why fractions 1 to 4 are not the same as the feedstock stream that is manufactured in a typical refinery process; it is rather the fact that the feedstock has undergone a transformation. Also the feedstock could and in practice sometimes is be applied as a solvent. The Hydrocarbon Solvents Producers Association (HSPA) has therefore developed a naming convention for some fractions of certain refinery streams. Please see for a comprehensive paper on the naming convention. The Hydrocarbon Solvents Consortium (HCSC) has decided to register under REACH the 77 substances that were originally listed in the naming convention document. The European Chemical Agency (ECHA) has meanwhile assigned new EC numbers to the 77 substances that had been pre-registered under their name in accordance with naming convention. The refinery streams used as feedstocks are not the same substances as the 77 HCSC substances. Pre-registrants of those 77 substances under the EC number of their feedstocks should be aware that the registration dossiers currently being prepared by CONCAWE for the feedstocks of these 77 substances will only in very exceptional cases address the application of these feedstocks as a solvent. Therefore, if you cannot find on the list below the Use where your substance is applied as a solvent it is likely, in most cases even certain, that your substance is not a refinery stream but a specific cut. In this case you should inform us (info@super-sief.eu ) so that we can remove you from the SIEF and contact HCSC (ian.carruthers@reachcentrum.eu) for joining the appropriate SIEF.
